Upon the perpetual vicarage of Ab[e]rillot in the diocese of St. Andrews becoming void at the apostolic see by the death there of Giles Boys, and ipso facto reserved to the pope, the pope granted provision of it to Andrew Zong, clerk, of the diocese of Glasgow, a continual commensal member of his household, under date 3 Kal. June anno 11 [1482]. The said Andrew having this day ceded the said grant to the pope, before the letters thereof were drawn up, and the vicarage being therefore still void, as above, and still reserved, the pope hereby orders the above canon to collate and assign it, value 8l. sterling, to Alexander Gordon. clerk, of the diocese of Aberdeen, who is in his twentieth year, if he be found fit. Upon the chancellorship of Aberdeen (provision of which, on its voidance by the death of John Nasbet [sic] extra R.c., was made to Giles Boys, clerk, by papal authority) becoming void at the apostolic see, and ipso facto reserved to the pope, by the death there of the said Giles without having had possession, the pope granted provision of it to Andrew Zong, clerk, of the diocese of Glasgow, a continual commensal member of his household, under date 3 Kal. Mandate to make provision to Maurus Yconchuyr, a Friar Minor, of the monastery of St. Peter, Cluynaarridt [sic], O.S.A., in the diocese of Meath, value 12 marks sterling, so long void that its provision has lapsed to the apostolic see, although James de Altun, a canon of the said monastery and order, who is to be summoned, has detained it for between eight and twelve years, without any title or right. He is further to grant to the said Maurus that he may be blessed by any catholic bishop in communion with the apostolic see, without prejudice to the bishop of Meath. As soon as he obtains possession of the rule and administration, he is to wear the habit worn in the said monastery. Solicite considerationis indagine. [1½ pp.]

To the abbot of St. Thomas's, Abberbrochok [sic], in the diocese of St. Andrews. Mandate, as below. The pope lately suppressed the erection which had been made by papal authority of the parish church of Guthre in the diocese of Brechin into a prebend of Brechin, and erected the said parish church, thus restored to its pristine state, into a collegiate church, and instituted in it a provostship (a principal dignity with cure) and divers canonries and prebends, and reserved the patronage and presentation to the provostship, for the first turn and on future voidances, to the temporal lord of the said place of Guthre for ever, the pope's will being that he who should be presented and instituted to the said provostship should be bound to impetrate fresh provision from the apostolic see within four months from such institution. Subsequently, as was contained in the recent petition of David Guthre, a canon of Aberdeen, M.A., the said provostship having been void from its first erection and institution, Alexander, the present temporal lord of the said place, presented the said David within the lawful time to the present bishop of Brechin, who for a reason unknown refused to institute him, wherefore the said David has appealed to the apostolic see. The said petition adding that he doubts whether the said presentation holds good, and the pope having learned that the said provostship is still void, as above, he hereby orders the above abbot to collate and assign it, not elective and value 6l. sterling, to the said David; notwithstanding that he holds a canonry and prebend of Aberdeen, value 20l. sterling. Mandate to collate and assign to Edmund [son] of William de Geraldinis, clerk, of the diocese of Cloyne (to whom the pope has this day granted provision of a certain benefice without cure (simplex) called the parcel or rectory of Ballyrobin in the parish church of Balingcornyrry, in the said diocese, of lay patronage and value 3 marks sterling), the perpetual vicarages of the parish churches in Killmodounock and Ynche in the said diocese, value 12 and 10 marks sterling, respectively, so long void that their collation has lapsed to the apostolic see; whether they be void by the deaths of Nicholas Heyuuad and John Dexeter (? d'Exeter) extra R.c., or be void in any other way. Having learned that he held at the time thereof the subdeanery of Glasgow, and the pope's intention being to dispose thereof, he hereby decrees that it became and is void at the apostolic see by the said provision and appointment only. Confirmation, as below. The recent petition of James Stewart, nobleman, constable of the palace or castle of Spynie (de Spineto), Moray, contained that formerly David, bishop of Moray, (considering that frequently during voidance of the episcopal see of Moray many temporal lords, on account of the lack of a constable or keeper of the said palace, had invaded and taken it, and detained and occupied it until the entry of the future bishop, and that they and their accomplices had partly destroyed and carried away with them the goods etc. therein belonging to such future bishop, whereby he and the said church had suffered great losses in spirituals and temporals), with consent of the dean and chapter appointed the said James constable and keeper of the said palace for the said bishop David and his successors, and for the said office and for the services to be rendered by him granted and assigned to him and three heirs of his body in fee (fn. 5) all the lands of Latilinuerloche and the mill of the same, with all rights and appurtenances, worth 10l. a year of silver of the lawful money of Scotland, situate in the diocese of Moray and the barony of Birneth (fn. 6) of the bishop of Moray and the sheriffdom (fn. 7) of Elgin, also sufficient food for him and two servitors, and fodder (fn. 8) and oats for three horses, as is said to be more fully contained in certain letters bearing the seals of the said bishop David and chapter. To Roger de Carutheris, perpetual vicar of Dumfres’ in the diocese of Glasgow. Dispensation, as below. After he had been dispensed by papal authority on account of illegitimacy, as the son of a priest, of baronial birth, and an unmarried woman, to be promoted to all, even holy orders and hold a benefice even with cure, and after he had been so promoted, and had obtained by canonical collation the parish church of Wamfra in the diocese of Glasgow, he was dispensed by the said authority to receive and retain one other benefice compatible with the said church, (fn. 9) and to resign the said benefices, etc., in virtue of which latter dispensation he resigned the said church of Vamfra and obtained by canonical collation the above vicarage of Dumfres’. The pope now dispenses him to receive and retain for life with the said vicarage any other benefice, or without it any two other benefices, with cure or otherwise incompatible, even if two parish churches, etc., and to resign them, etc. Vite etc. [2¾ pp.]

To Thomas, bishop of Banados (Penaden.). Indult and confirmation, as below. The pope lately made provision to him of the said church, (fn. 10) which is in partibus infidelium, and by other letters granted that he might exercise pontifical offices in the city and diocese of St. Davids, with consent of the bishop for the time being; and subsequently (inasmuch as he had not the money for the expedition of the said letters, and wished to go to England to get it), granted him, by other letters in the form of a breve, indult not to be bound to be consecrated within a year. His recent petition contained that he went to England to get the said money, and sent it to the Roman court for the said expedition, and waited for the said letters for about two years, but that by somebody's fraud the said money was lost, wherefore the said letters could not be expedited; and that Prosper de Camuleo, then collector of fruits etc. due to the apostolic Camera in England, under pretext of a special faculty which he alleged that he had from the apostolic see, granted to him that he might be consecrated and exercise pontifical offices in the said city and diocese, trusting in which faculty he had himself consecrated and has for about two years from that time (ex tunc) exercised the said offices, with the said consent; and that he has recently had the said letters expedited. The pope, therefore, grants him indult to use the said consecration, and confirms all he has lawfully done in regard to the said exercise. Personam tuam. [12/3 pp.]

The recent petition of Richard Walsh, rector of St. Patrick's, Trin [sic], in the diocese of Meath, contained that Edward Welsly, clerk, falsely alleging that he had committed perjury, brought him before James Cosyn, prior of the house of St. John near Trym in the said diocese, under pretext of a commission to the latter from John Whit, archdeacon of Meath, guardian of the spiritualities of that church, then void; that, although he appealed to the apostolic see from certain grievances inflicted on him by the said James, and set out to prosecute his appeal at the said see, the latter, in contempt thereof, and although the said Richard was within the period for prosecuting the said appeal, and without citing him, wrongfully proceeded in the said cause, and promulgated an unjust definitive sentence by which he deprived him of the said church; and that, although appeal was made therefrom to the said see on his behalf, Richard Fichet, acting as a clerk and commissary of the said archdeacon, in contempt of the said appeals, although the said rector Richard was within the time for prosecuting them, made collation and provision of the said church of St. Patrick to the said Edward, and caused him to be inducted therein, wherefore the said rector Richard has again appealed to the said see. At his said petition, therefore, the pope hereby orders the above three to summon the said Edward and others concerned, hear both sides, and, taking cognizance of the principal matter also, decide what is just, without appeal, causing their decision to be observed by ecclesiastical censure.   • 2. The character of the writing of the scribe of this entry may be judged by the fact that the editor began by balancing the claims of ‘Bordoy’ and ‘Boroloy' as possible readings.

  • 11. An instance of what very rarely happens, viz., the registration of the same bull twice.
  • 12. On f. 251r., under date S.P.R. 1483, 13 Kal May anno 12, is a dispensation Vite etc. for William Prepositi, clerk, no diocese mentioned, to be promoted to all holy, even priest's orders, etc., notwithstanding his illegitimacy as the son of a priest and an unmarried woman.
