De Provisionibus Prelatorum.
1482. 9 Kal. Oct. (23 Sept.) St. Peter's, Rome. (f. 8r.) |
To the abbot of Kelso (de Calco) in the diocese of St. Andrews. Mandate, motu proprio, to receive Andrew Luderdel, priest, of the diocese of G[l]asgow, as a canon of St. Mary's, Dribu[r]gh, O. Praem., in the diocese of St. Andrews, give him the regular habit, and receive his profession as a canon of the said monastery. Cupientibus vitam ducere regularem. [1 p.—] |

Ibid. (f. 8v.) |
To Andrew Luderdel, priest, of the diocese of Glasgow, M.A. Grant and provision, as below. The pope lately, on the voidance of the monastery of St. Mary, Dribu[r]gh, O. Praem., in the diocese of St. Andrews, by the death of abbot Walter extra R.c., made provision thereof to the late John Crafort, a canon of the same. And upon a dispute arising between the said John and the late Hugh Douglas, a canon of the same monastery, about its rule and administration, the former alleging that provision had been made to him by the pope, and that the latter had unjustly opposed and was opposing the same, etc., and had intruded himself, and was unlawfully detaining possession, and the latter alleging that the said monastery lawfully belonged to him, the pope, at the instance of the former, committed the cause, although not by its nature lawfully devolved to the Roman court, to John bishop of Nocera, residing in the said court and holding the place of a papal auditor, who, proceeding in possessorio, promulgated a sentence in favour of the said John and against the said Hugh, the latter's appeal from which the pope committed to Master Anthony de Grassis, a papal chaplain and auditor, after divers proceedings by whom, short of a conclusion, the said John died at the apostolic see, whereupon the pope called up the cause to himself, extinguished the suit, and made provision to the said Hugh. Subsequently, before the pope's letters had been drawn up, the said Hugh also died at the said see, and, the said monastery being therefore void, the pope has this day ordered the abovenamed Andrew to be received, etc., as in the preceding. The pope now grants to him the said monastery (reserved under his late reservation of the provisions of all churches and monasteries then void and to be void at the said see), in commendam for three months from the date of these presents, and decrees that as soon as he has been received as a canon, taken the habit and made his profession, provision of the said monastery is to be made to him. The pope's will is that during such commenda he may dispose of the fruits etc., as freely as true abbots have been able to do, and that if after the lapse of the said three months he has not been received as a canon and taken the habit and made his profession, these presents and the commenda and provision contained therein shall be null and void. Summi dispositione rectoris. |

Lately, on the voidance of the said monastery by the death of abbot George extraR.c., previously to which the pope had specially reserved the provision thereof to his gift, the convent (ignorant, as is believed, of the said reservation), elected de facto the above William, who (likewise ignorant) consented to the election, and who, upon learning the said reservation, has caused the matter of the said election to be set forth to the pope in consistory. The said election, etc., being therefore null and void, the pope hereby makes to the said William, a monk of the said monastery, professed of the said order, and in priest's orders, and of lawful age, provision of the said monastery. 8 Id. Dec. (6 Dec.) St. Peter's, Rome. (f. 306r.) |
To Odo Odearmadaid and Dermit Maccasarlaid and Wa[l]ter Blach, canons of Tuam. Mandate, as below. The pope has learned that the perpetual vicarage de Calaito (?) (fn. 11) in the diocese of Tuam has been so long void that its collation has lapsed to the apostolic see, although William Macbresym [sic], priest, of the said diocese, has detained it for between one and two years, without any title or right. At the recent petition of Bernard Ysingyn, a canon of Elphin (containing that the fruits, etc., of his canonry of Elphin and the prebend called [the prebend] of the ecclesiastical lands of Cillmacnagyn in the diocese of Elphin are too slight for his support, etc.), the pope hereby orders the above three to summon the said William, and to unite the said vicarage to the said canonry and prebend. value 3 and 1 marks sterling, respectively, for the lifetime only of the said Bernard. Apostolice sedis circumspecta benignitas.) [2⅓ pp.] |
Ibid. (f. 310v.) |
To Carbricus Oberynd and Philip Macqhenri and Murianus Macmnussa, canons of Elphin. Mandate, as below. The pope has learned that a certain perpetual benefice, without cure, called the prebend of the place of Ymlefada in the diocese of Achonry, (fn. 12) is void by the death of Donald Ybrangale, and that the perpetual vicarage of the parish church of the said place is void by the death of Thomas Ychonayn, both extra R.c., although Matthew Ochalanam, priest, has detained the said vicarage for between one and two years, without any title or right. At the recent petition, therefore, of Cornelius Ystanlayn, a canon of Achonry, who alleges that he took an oath by force not to molest the said Matthew in regard to the said vicarage, and that the fruits etc. of his said canonry are of no value, the pope hereby orders the above three to relax the said oath, and to unite the said benefice and vicarage, value 6 marks sterling, to the said canonry for as long as the latter shall be held by the said Cornelius, who, as he alleges, from fear of the power of the said Matthew, who is to be summoned, cannot safely meet him in the city and diocese of Achonry; whether they be void as above, or the said vicarage be void by the death of John Ygarthan, or whether they be void in any other way, etc. Apostolice sedis circumspecta benignitas.
