4 Sixtus IV.

De Beneficiis Vacantibus.

1475.
5 Id. May.
(11 May.)
St. Peter's, Rome.
(f. 73v.)
To the archdeacon and the provost of Tuam, and Decanus (fn. 2) Oleannayn, a canon of the same. Mandate to grant in commendam for life to Malachy Ykellyd, abbot of St. Mary's, Knockmoy (Collis victorie), O. Cist., in the diocese of Tuam (who was lately dispensed by papal authority on account of illegitimacy, as the son of a clerk and an unmarried woman, to be appointed to the said monastery, if (fn. 3) provision thereof were made to him), the perpetual vicarage of the parish church of Mailacha in the said diocese, value 10 marks sterling, void by the death of John Omothlayn extra R.c., although William Macbrismi, priest, of the said diocese, who is to be summoned and removed, has detained possession of it for about ten years without any title or right. Personam dilecti filii. [2½ pp.]
1475.
18 Kal. May.
(14 April).
St. Peter's, Rome.
(f. 92r.)
To the provost of Tuam, and Dermit Oscara and Thady Obruhin, (fn. 4) canons of the same. Mandate to collate and assign to David Prindragas, priest, of the diocese of Tuam (who is by both parents of noble birth, and to whom the pope recently ordered provision to be made of the rectory, commonly called the rectory of the rural lands, of Rathicurnayn in the said diocese, with cure and value 8 marks sterling), the perpetual vicarage of the parish church of Croswilin in the said diocese, with cure and value 7 marks sterling, to which vicarage certain other benefices are united, so long void that its collation has lapsed to the apostolic see, although John Plemynd, priest, of the said diocese, has detained possession of it for about seventeen years without dispensation on account of illegitimacy, as the son of a priest and an unmarried woman, and without any title, the said John being summoned and removed; whether it be void by the death of Walter Prindragas or William Yconnochayn, or be void in any other way. The pope hereby dispenses him to receive the said vicarage, and retain it for life with the said rectory. Nobilitas generis, vite etc. (At the end: Jo. xxvi. Tercio Kal. Maii anno quarto. Fortin.) [2 pp.]
9 Kal. May.
(23 April).
St. Peter's, Rome.
(f. 94v.)
To the abbot of St. Mary's, Fermoy (de Castrodei), and the prior of Bridgetown (Villepontis), in the diocese of Cloyne (Clonen.), and the official of Cloyne. Mandate to collate and assign to John Roche, rector of the parish church of St. Mary's, Seandon, in the diocese of Cork, the archdeaconry of Cloyne, as below. After the said John had been dispensed by authority of the ordinary on account of illegitimacy, as the son of unmarried parents of a race of earls and barons, to be promoted to minor orders and hold a benefice without cure, and subsequently by papal authority to be promoted to all, even holy orders and hold any benefices with or without cure, compatible with one another and with the said benefice, and to resign them all, simply or for exchange, as often as he pleased, in virtue of which dispensations he had had himself promoted to minor orders and had obtained the said parish church, the present pope ordered provision to be made to him of the precentorship of Cork, a non-major, non-elective dignity with cure, value 20 marks sterling, dispensing him to receive it, and to retain it for life with the said parish church, value 5 marks sterling, or with either of them any one other benefice, or, if he resigned them, any two benefices, with cure or otherwise incompatible, even if parish churches etc., or dignities etc., and to resign them, simply or for exchange, as often as he pleased. The pope now orders the above abbot to collate and assign to the said John the archdeaconry of Cloyne, a non-major, nonelective dignity without cure, value 24 marks sterling, so long void that its collation has lapsed to the apostolic see, although John Fuych, clerk, has without any title detained possession of it for about two years; summoning and removing the said John Fuych. The pope further dispenses the said John Roche to retain for life the said archdeaconry, parish church and precentorship, or without the archdeaconry any other third benefice with cure or otherwise incompatible, and to resign such third benefice, simply or for exchange, as often as he pleases, provided that he do not hold more than two parish churches or perpetual vicarages. Vite etc. (At the end: Jo. lx. Septimo Id. Maii anno quarto. Fortin.) [22/3 pp.]
Prid. Id. April.
(12 April).
St. Peter's, Rome.
(f. 98v.)
To the abbot of St. Mary's, Leix (de Legedei), in the diocese of Leighlin, Fintanus Olealur, a canon of Leighlin, and the official of Ossory. Mandate, as below. The recent petition of Donatus Ymallchayl, priest, of the diocese of Ossory, contained that on his failing to pay the collector of the papal camera in those parts a certain sum of money by a certain term, the said collector excommunicated him by papal authority, and that without having obtained absolution he took part in divine offices, but not in contempt of the Keys, and short of the ministry of the altar, thereby contracting irregularity, and that he afterwards made satisfaction to the sub-collector of those parts in respect of the said sum, and was by him absolved from the said sentence; that after John, archbishop of Dublin, had monished all beneficiaries, rectors of parish churches etc. in his province to pay by a certain term their visitation procurations, under pain of deprivation etc., the said Donatus, who was then, as he is now, holding the parish church of St. Fintanus, Duriwach, in the said diocese, was prevented from so paying; and that formerly he carnally knew a certain woman, and had offspring by her. The pope therefore orders the above three to absolve him from the said sentence of excommunication etc., and from his other sins, enjoining a salutary penance, dispense him on account of irregularity, and rehabilitate him, and to collate and assign to him the said parish church, value 12 marks sterling. Sedes apostolica, pia mater. (At the end: Jo. xxv. Septimo Id. Maii anno quarto. Fortin.) [2¼ pp.]
3 Kal. May.
(29 April.)
St. Peter's, Rome.
(f. 101r.)
To the archbishop and the treasurer of Cashel, and Philip Ofahgartho, a canon of the same. Mandate, as below. The recent petition of Thomas de Burgo, clerk, of the diocese of Emly (Imelacen.), contained that he lately obtained the perpetual vicarage of the parish church of Cahirkynlys (fn. 5) in the said diocese, and detained it for more than a year without having himself ordained priest, and without dispensation. The pope has also been informed by him that Walter de Burgo, prior of the priory of St. Edmund, King and Martyr, Hathassel, O.S.A., in the diocese of Cashel, has had several concubines, by whom he has had sons and daughters, has consumed and dilapidated the goods of the said monastery for the use of the said concubines, sons and daughters, wherefore its walls are in ruin and divine worship neglected, has committed simony, has carnally known a certain kinswoman, and has perpetrated many other crimes (flagitia). The pope therefore, hereby absolving the said Thomas, who is of knightly birth, from disability by reason of the aforegoing, orders the above three, if he will accuse the said Walter before them, to summon the latter, and if they find the foregoing to be true, to deprive and remove him, and in that event to cause the said Thomas to be received as a canon of the said monastery and the regular habit to be given to him, and receive his profession, and thereupon to collate and assign to him the said priory, which is conventual, elective, and with cure, value 95 marks sterling, and also to grant to him the said vicarage, value 12 marks sterling, to hold in commendam for life with the said priory. Sedes apostolica, pia mater. (At the end: P. l. Quintodecimo Kal. Maii anno quarto. de Varris.) [3½ pp.]

(12 June.)
St. Peter's, Rome.
(f. 163r.)
To the abbot of St. Mary's, Macosquin (de Clarofonte), in the diocese of Derry (Deren.), and Roger Macchonrii and Senequinus Okahan, canons of Derry. Mandate to collate and assign to Odo Macbloscayg, (fn. 6) clerk, of the diocese of Derry (who alleges that notwithstanding his illegitimacy, as the son of a clerk and an unmarried woman, he was made a clerk, and that under a grant, which is null, made by Nicholas, bishop of Derry, a number of priests called Colidei in the church of Derry detain the fruits etc. of the rectory of the parish church of the place de Thamlattharda alias de Ardo in the said diocese, wherefore its cure of souls is neglected, and divine worship diminished therein), the said rectory, value 8 marks sterling, so long void by the resignation of Odo Yehachayn (fn. 7) that its collation has lapsed to the apostolic see. The pope hereby dispenses him to receive and retain it, notwithstanding the said defect, etc. Vite etc. (At the end: Jo. xx. Kal Julii anno quarto. Fortin.) [2 pp. +]
