To Thomas Joy, David P[r]yndragas and John Ochaelly, canons of Tuam. Mandate, as below. The pope has been informed by John Joy, a canon of Annaghdown (Enachdunen.), that David Maglon, priest, obtained papal letters to certain judges in those parts ordering Donald Omolaon to be deprived of the perpetual vicarage of the parish church of Belclar Tuam in the diocese of Tuam, and that he promised to the said judges, or to the judge to whom the said letters had been presented, that if he pronounced a sentence in his favour he would give him certain moveable goods or animals, after which the said judge promulgated a definitive sentence by which he deprived the said Donald, which sentence became a res judicata, and, after receiving the said goods, collated and assigned the said vicarage to the said David, who took possession and has detained it for between about five and six years. The pope, therefore, hereby orders the above three, if the said John will accuse David before them, to summon the latter, and if they find the foregoing to be true, to declare the said collation and provision null, and remove David, and in that event to collate and assign the said vicarage, value 4 marks sterling, to the said John, notwithstanding that he holds a canonry and prebend of Annaghdown, value half a mark sterling, equal to about 1½ ducats. To Philip Oronayn, a canon of Limerick. Mandate to receive David [son] of John de Geraldinis, perpetual vicar of the parish church of Cloenach in the diocese of Limerick, as a canon of the priory of St. Mary, Raghely, O.S.A., in the said diocese, give him the regular habit, and receive his profession, and thereafter to collate and assign to him the said priory, conventual, elective, with cure, and value 8 marks sterling, void by the death of William Oketh extra R. c., and reserved under the pope's reservation of all conventual priories: summoning and removing Thomas Oketh, a canon of the same, who, as David alleges, has retained possession of it for some months, but less than a year, under pretext of a de facto election by the convent; first receiving from the said David the usual oath of fealty according to the form enclosed. Reservation to the pope's gift, for collation to him (who was lately dispensed by papal authority on account of illegitimacy, as the son of a priest and an unmarried woman, [both] of noble birth, to be promoted to all, even holy orders and hold a benefice even with cure, after which he was so promoted and obtained the above rectory, value 12 marks sterling), of a canonry and the prebend called the prebend of Kylmageny (fn. 3) in Emly, value 3 marks sterling, and the of Nalt alias Kylnanala, value 4 marks sterling, and the united perpetual vicarages (which are in the presentation of the preceptor of the preceptory of Any, of the hospital of St. John of Jerusalem, in the diocese of Emly) of the parish churches of Long and Duynmunyn, in the said diocese, value 10 marks sterling, [all] which are to become void by the pope's promotion of Philip, [bishop] elect of Emly, to that church, and by the consecration which is to be conferred on him. The pope hereby dispenses him to receive the said canonry and prebend, rectory of Kilnanala, and vicarages, and to retain them for life with the said rectory of Gallavalyaharlach, or, without the said rectories and vicarages, any three other benefices with cure or otherwise incompatible, and also any benefices with or without cure compatible with one another and with the aforesaid, and to resign them all, simply or for exchange, as often as he pleases, provided that he do not hold more than two parish churches or their perpetual vicarages. To the archdeacon and the chancellor of Ardfert, and Thomas [son] of John de Geraldinis, a canon of the same. Mandate, as below. The pope has been informed by John Machonnchur, clerk, of the diocese of Ardfert, that David Oryede, perpetual vicar of the parish church of Hochowall [in the said diocese of] Ardfert, has alienated both immoveable and precious moveable goods of the said vicarage, and is a notorious fornicator. The pope therefore orders the above three, if John, who is illegitimate, being the son of a clerk and an unmarried woman, and has been made a clerk by authority of the ordinary, will accuse David before them, to summon the latter, and if they find the foregoing to be true, to deprive and remove him, and in that event to collate and assign to John the said vicarage, the value of which and of the rectory of Hochowall (provision of which the pope has this day granted to the same John, as void by the deprivation of the said David) does not exceed 7 marks sterling. To the abbot of Annaghdown (de Cella parva) in the diocese of Annaghdown (Enachdunen.), and David Vulena and Donald Makartayn, canons of Annaghdown. Mandate, as below. The pope has been informed by Cornelius Ohallinoran, clerk, of the diocese of Annaghdown, that after Maurus Okinnailud, clerk, had got provision made to him by papal authority of the deanery of Annaghdown, a major dignity, then void, and had obtained the union thereto of the perpetual vicarage of the parish church of Malcolin in the said diocese, then about to become void, whilst a cause was pending in those parts before a certain judge or executor about the deprivation for certain crimes of Dermit Yhallinoran, then perpetual vicar of the said church, the said Maurus made a bargain with the said Dermit that if the latter would acquiesce in the sentence to be delivered against him, he would pay him a certain sum of money, after which the said executor or judge, perhaps in ignorance of the foregoing, promulgated a sentence, which became a res judicata, by which he deprived and removed the said Dermit, in which sentence, after having received the said sum, the latter acquiesced, and the said judge or executor, proceeding to execution, united the said vicarage to the said deanery, under pretext of which said union Maurus took possession of the vicarage, and has detained it with the deanery for about nine years. The pope therefore orders the above three, if Cornelius will accuse Maurus before them, to summon the latter, and if they find the foregoing to be true, to declare the said union null, and remove Maurus, and in that event to collate and assign the said vicarage, value 4 marks sterling, to Cornelius. The recent petition of Ludovicus Oconnochan, priest, of the diocese of Achonry, contained that lately, on the voidance of the perpetual vicarage of the parish church of Clonneochille in the said diocese by the resignation of Thomas Macbreim extra R.c. to Bernard, the present bishop of Achonry, the said bishop made collation and provision of it to the said Ludovicus, in virtue of which he obtained the said vicarage, and is now in possession of it. The said petition adding that he doubts whether the said collation and provision hold good, the pope hereby orders the above three to collate and assign to the said Ludovicus, who holds a canonry of Achonry, the said vicarage, with cure and value 5 marks sterling. The pope has been informed by Bernard Offayrchellaic, priest, of the diocese of Kilmore, that John Machiarnan, perpetual vicar of the parish church of Kylldallan in the said diocese, has, after being suspended from divine [offices], (fn. 4) celebrated mass and [other] divine offices in contempt [of the Keys], and has taken part therein, thereby contracting irregularity, and has committed perjury. The pope, therefore, hereby orders the above three, if Bernard will accuse John before them, to summon the latter, and if they find the foregoing to be true, to deprive and remove him, and in that event to collate and assign the said vicarage, value 3 marks sterling, to Bernard. The recent petition of Dermit Oflaertargh [sic], priest, of the diocese of Annaghdown, contained that on the voidance of the perpetual vicarage of Raphin in the said diocese, by the resignation of William Umullechlaind to Donatus, archbishop of Tuam (the church of Annaghdown being united to that of Tuam), the said archbishop made collation and provision of it to the said Dermit, who, after being made a clerk by authority of the ordinary, had been dispensed by papal authority on account of illegitimacy, as the son of an Augustinian canon and an unmarried woman, to be promoted to all, even holy orders and hold a benefice even with cure, in virtue of which he had himself so promoted, and who, in virtue of the said collation and provision, obtained and at present holds possession of the said vicarage. The said petition adding that he doubts whether the said collation and provision hold good, the pope hereby orders the above three to collate and assign to him the said vicarage, value 3 marks sterling, whether void as above, or by the death of Thady Yolannam, or in any other way. The pope further dispenses him to receive and retain with the said vicarage for life any one other benefice, or without it any two other benefices, with and without cure, compatible with one another and with the said vicarage, even if canonries and prebends, dignities, etc., and to resign them, simply or for exchange, as often as he pleases, and receive and retain instead one or two other similar or dissimilar benefices compatible with one another and with the said vicarage, provided that such dignities be not major in cathedral etc. or principal in collegiate churches, notwithstanding the said defect, etc. (fn. 6)Vite etc. (At the end: Jo. xx. To the archbishop of Patras (Patracen.), the archdeacon of Ardagh (Ardakaden.), and Eugenius Macconkagri, a canon of the same. Mandate, as below. The recent petition of Donald Yfergail, clerk, of the diocese of Ardagh, contained that Pius II (upon being informed by the said Donald that, upon the voidance of the rectory of the rural lands or plebes (fn. 7) of Monterreolis in the said diocese, by the resignation extra R.c. of Donatus Yfergail, certain clerks and priests made a bargain with the ordinary that if he would divide the fruits of the said rectory into seven prebends, and collate one to each of the said clerks and priests, etc., they would pay him a certain sum of money; that he divided the said fruits into seven, erected the said prebends, and collated them to the said clerks and priests; and that they paid him the said money), ordered a certain judge to summon the said priests and clerks and others concerned, and if he found the foregoing to be true, to declare the said division, creation and collations and provisions null and invalid, and, in the event of his making such declaration, to reduce the said rectory to its pristine state, and make collation and provision of it to the said Donald, as is contained in letters of Paul II, the said pope Pius having died before his letters in regard to the said mandate were drawn up; that, inasmuch as the said judge was very negligent in the said cause (in which a conclusion before him had been arrived at), and refused to pronounce sentence, the said Donald, wishing the said suit to be terminated by a sentence, (fn. 8) promised the said judge (after Paul II's renewal of all sentences etc. against simoniacs) a certain sum of money in order that he should pronounce sentence in his favour, after which he promulgated sentence in favour of the said Donald, (fn. 9) and against the said priests and clerks, which sentence became a res judicata, reduced the said rectory to its pristine state, and made collation and provision of it to the said Donald; and that the latter paid the said money, and under pretext of such collation and provision obtained possession of the said rectory, and has detained it for about eleven years. The said collation and provision being without force, and the said rectory still void as above, the pope orders the above three to absolve Donald (who was lately, after having been made a clerk by authority of the ordinary, dispensed by papal authority on account of illegitimacy, as the son of a clerk and an unmarried woman, to be promoted to all, even holy orders and receive the said rectory, and retain it for life) from the said crime of simony and sentence of excommunication, enjoining a salutary penance, etc., and rehabilitate him, and thereupon to collate and assign to him the said rectory, which has cure of souls, wont to be exercised by certain perpetual vicars, and the annual value of which does not exceed 24 marks sterling, whether it be void as above, or by the death of Cornelius Yfergail or Malachy Macmulroy, successively rector thereof, or in any other way, etc. The pope further specially dispenses him to receive and retain it, notwithstanding the said defect, etc. Before they proceed to execute these presents, he is to resign. To the priors of Insdehoc [sic] and Kenantig (?) in the diocese of Ossory, and the dean of Ossory. Mandate, as below. The pope has learned that Donald Omeduri, prior of the monastery of St. Keranus de Sayr, O.S.A., in the diocese of Ossory, has resigned the said priory, to which is canonically annexed the chapel of Finchora in the said diocese. And the recent petition of Nicholas Ominnachan, a canon of the said monastery, contained that the said union was made by the ordinary, with consent of the chapter, on account of the slenderness of the fruits of the said priory, and that the said Donald and his predecessor as prior have had peaceful possession of the said chapel for about twenty years, but that some hesitate as to the force of the said union. At the said petition, therefore, of Nicholas (who alleges that the value of the vicarage and priory does not exceed 2 and 14 marks sterling, respectively, and that if the vicarage were taken from the prior and convent they could not conveniently maintain themselves, and who is illegitimate, being the son of a former prior of the said monastery and an unmarried woman), the pope orders the above three to admit the said resignation, and if they find the foregoing to be true, to approve and confirm the said union, and in that event to collate and assign the said priory, which is conventual and elective, and which (as also the said annex) has cure and does not depend on any other monastery or regular place, to the said Nicholas. To the prior of St. Peter's, Dearg, in the diocese of Ardagh (Ardakaden.). Mandate, as below. The recent petition of Fantutius Yfergail, clerk, of the diocese of Ardagh, contained that after Paul II had reserved to his gift all major dignities, the said pope, on the voidance of the deanery of Ardagh, a major dignity, by the death of Gerard Offergail extra R.c., made collation and provision thereof to Thomas Macmurhyrtay, priest, of the said diocese. The said petition added that in the said pope's letters, under pretext of which the said Thomas obtained possession of the deanery, and has detained it for about seven years, no mention was made of the parish church of Tencsynche [sic] in the diocese of Ardagh, which he was then holding. The said letters being in that case surreptitious and null, the pope orders the above prior to summon the said Thomas and others concerned, and if he find that the said letters were surreptitious, to declare them null and invalid and without force, and in that event to collate and assign the said deanery, a major dignity (fn. 11) with cure, value not exceeding 40l. sterling, to the said Fantutius, who is in his twentyfifth year, and is by both parents of a race of dukes.
