To Master Peter Ferrera, a papal chaplain and auditor. Mandate, as below. The recent petition of Alice Nunny, a nun of St. John Baptist's, Geddescoue [sic], O.S.B., in the diocese of Lincoln, contained that although, on the voidance of the said monastery by the death extra R.c. of Alice, abbess thereof, the greater and sounder part of the convent elected as abbess the said Alice Nunny, professed of the said order and of lawful age, and although she consented to the said election and asked for its confirmation by the bishop of Lincoln, nevertheless the said bishop unjustly refused to confirm it, and his commissaries confirmed the election by the lesser part of the said convent of Margaret Moore, a nun of the said monastery, wherefore the said Alice appealed from the said refusal, and afterwards from the said confirmation, to the apostolic see; that she obtained from Paul II letters in the matter of the said appeals and of the principal matter to the prior of the priory of Buschollezam [sic] in the diocese of Salisbury, the dean of Wells and the archdeacon of York, and in virtue thereof caused the said Margaret to be summoned before William Witham, dean of Wells, who, after proceeding in the said cause, short of a conclusion, alleged that he could not finish it, (fn. 2) and commissioned Thomas Ruston, prior of the priory of Horley in the said diocese [of Salisbury] and certain others to act in his stead; that the said Thomas, lawfully proceeding, promulgated a definitive sentence by which he annulled the said election of Margaret, and its consequences, and decreed and declared that the election of Alice Nunny had been and was just and valid and canonically made, confirmed her election, and imposed perpetual silence on the said Margaret, (fn. 3) from which sentence the latter appealed to the said see; and that the present pope has, at the latter's instance, committed the said last appeal to the above-named auditor, who has proceeded, short of a conclusion. At the said petition, which added that it is alleged by some that neither of the said Alice Nunny and Margaret has a right in or to the rule and administration, the pope hereby orders the said auditor, if by the result of the said suit he find this to be so, to make provision of the said monastery, value not exceeding 1400l. of petits tournois (fn. 4), to the said Alice Nunny. He further grants her indult to be blessed by any catholic bishop of her choice in communion with the said see, who, after blessing her, shall receive from her the usual oath of fealty, according to the form enclosed, and send it to the pope by his own messenger without delay, by her letters patent sealed with her seal (fn. 5); without prejudice to the bishop of Lincoln, to whom the said monastery by ordinary right is subject. To the precentor (cantori) and the chancellor of Brechin. Mandate, as below. The perpetual vicarage of Dunde in the diocese of Brechin has become void because after John Spalding, clerk, had been dispensed by papal authority to retain two incompatible benefices for life, and after Paul II had ordered provision to be made to him, when holding the deanery of Brechin, which is a major dignity, of the said vicarage and of the parish church of Kinel in the diocese of St. Andrews, and had dispensed him to receive and retain, for three years only, together with the said two incompatible benefices for which he had been dispensed, a third benefice, he, when holding the said deanery and vicarage, obtained in virtue of the said letters [the said parish church] of Kinel, (fn. 6) and held it with the said deanery and vicarage after the said three years, without having obtained any other dispensation for the purpose. The said vicarage being therefore ipso facto reserved to the pope, he hereby orders the above two to collate and assign to John Baret, clerk, of the said diocese of Brechin, M.A. (who alleges that the said John Spalding has detained possession of the said vicarage for between one and two years after the lapse of the said three years and the said voidance, without any title and without any right, and still detains it), the said vicarage, value not exceeding 40l. sterling, and induct him, the said John Baret being summoned and removed. To the dean of Cloyne (Clonen.). Mandate, as below. The recent petition of William, bishop of Cork and Cloyne, and Ludovicus Macray, O.P., contained that, with the consent of the said bishop, John de Geraldinis, the knight of Kerry, of the diocese of Ardfert, (fn. 7) gave to the friars of the said order a certain abandoned stone wall with certain lands adjacent thereto in the town of Gleannuyr, (fn. 8) in the diocese of Cloyne, in order that there should be built there a house for the perpetual use and habitation of the said friars; that in the place in which the said wall is situate the said bishop consecrated a cemetery and oratory, lest the said place should revert to lay hands; and that after the said consecration the said Ludovicus buried there many bodies of Christians. At the said petition, therefore, the pope hereby orders the above dean to summon the said knight and others concerned, approve and confirm the said gift, absolve Ludovicus from any sentence of excommunication which he may have incurred by making such burials, enjoining a salutary penance, etc., and to grant licence to him and other friars of the said order to build on the said land or place a house with church, bell-tower, etc. for their use and habitation, etc. Solet apostolice sedis gratiosa benignitas. To the abbot of the monastery of SS. Choanus and Broganus, Mothel (de Mothalia), in the diocese of Lismore. Mandate, as below. The pope lately ordered William Wynchiddon, (fn. 9) a canon of Lismore, to be received as a canon of the monastery of St. Catherine, O.S.A., in the diocese of Waterford, the regular habit to be given to him, and his profession to be received, the pope's will being that he should thereafter resign his canonry and prebend, called the prebend of Kylbatnicdyn, in the said church of Lismore. The said canonry and prebend being therefore about to become void by the said profession etc., the pope hereby orders the above abbot to reserve them, value 10 marks sterling, to the abbot's gift, for collation to Robert Broyn, (fn. 10) priest, of the said diocese of Waterford, and moreover, when they become void, to collate and assign them to him.
