Prefixing : (a) Order of the Privy Council, dated Aug. 23 last, granting leave to the America, Gilbert Bant master, 160 tons, 16 guns, 20 men, to sail for New England with the West Indies convoy on the like bond as given last year by ships going to New England : on the petition of James Ball, William Crouch and others, freighters and owners of said ship.

Prefixing : (a) like Order, dated Sept. 12 inst., granting leave to the Concord of Boston, John Beale master, 150 tons, 14 guns, 20 men, to sail with the West Indies convoy in ballast to the Isle of May, there to load salt for New England : said ship being New England built and the master, owner and most of the mariners being inhabitants of Boston.

The like order on the like Order in Council for the ships Samuell and James, Richard Forster master, 130 tons, 14 men, and the Providence, Thomas Wharfe master, 140 tons, 18 men, to sail to the Isle of May to load salt for New England : said ships being both New England built : on the petition of James Eaton, William Crouch, Jeremiah Johnson, William Ball and others, owners thereof. In this and the above cases the protection for the ships' crews is with the proviso that the Customs Commissioners be satisfied that said crews belong to and are inhabitants of New England. Treasury reference to the Customs Commissioners of the petition of Mary Jones, widow, shewing that her father-in-law, Robert Jones, was customer of Lyme port when the Duke of Monmouth landed, who took 200l. from him ; that her husband, Johannis Jones, was afterwards collector of said port and died indebted to the Crown between 300l. and 400l. ; therefore praying that said 200l. may be taken as part of said debt. Sept. 27. Royal warrant to the Attorney or Solicitor General for a great seal for a grant or release, as the case may be, to Thomas Neale of the moiety as follows, which was not released or discharged to Francis Smartfoot, citizen of London, of the fifth part reserved to the Crown in the first recited grant as hereinafter and also the tenth part in the second recited grant to him the said Smartfoot ; and likewise the tenth part and a moiety of the fifth parts respectively reserved to the Crown in the several grants Nos. 3, 5 and 6 as follows and the whole fifth part reserved in grant No. 7 as below, excepting the 2,000l. granted to Phillip Howard, viz. : (1) a grant of 1689, Nov. 8, to said Smartfoot for the use and benefit [for 14 years] of several new inventions found out by him, to wit, a sea crab for working in the sea to fish and take up ships' guns and goods lost or forsaken and a pair of lungs to be fixed to a man's back for his breathing under water as he swims ; to be used in all the seas within our dominions except from the North Foreland to the westward of the Lizard and the Isle of Scilly, with a reservation to the Crown of the fifth part of the values recovered thereunder by him in all depths of water from one fathom to ten fathoms : (2) and a subsequent patent dated 1690, Nov. 5, to same for the use and benefit of the said inventions for fishing up treasure whatsoever in any of the seas, rivers or shores from the North Foreland to westward of the Lizard and the Island of Scilly from March, 1695, for the residue of the said 14 years ; in which grant a moiety of said fifth part was released to said Smartfoot of treasure recovered in water from one to ten fathoms, and a full tenth was to be paid on all like recoveries in any depth of water exceeding ten fathoms : (3) and a patent dated 1690, Nov. 25, granting to Thomas Neale all wrecks for five years within 20 leagues of Bermudas, with a tenth part to the Crown : (4) and another patent of Mar. 18 last, granting to Phillip Howard the Crown's tenth part reserved in the last named grant to Neale up to a total of 2,000l. : (5) and an indenture dated July 5 last, extending to said Neale the abovesaid Bermudas wreck grant from 1694, June 26, to 1701, June 26, with a reservation of a fifth to the Crown : (6) and a further indenture of July 16 last, granting to said Neale wrecks near the islands and islets belonging to Bermudas for like term and with like reservation of a fifth : (7) and a further indenture of Aug. 19 last, granting to said Neale wrecks between Carthagena and Jamaica and Havanna for seven years with the like reservation of a fifth.
The consideration for the present grant is a payment first to be made by said Neale of 500l. into the Exchequer, and also his many good and faithful services.

Royal warrant, under the Queen's sign manual, to the Lord Lieutenant of Ireland for a commission to constitute the Chief Justices of the King' Bench, the Chief Justice of Common Pleas, the Chief Baron of the Exchequer, the Master of the Rolls, the Secretary of State, the Chancellor of the Exchequer, the Auditor General, the Muster Master General and the Surveyor General, Ireland, to be Commissioners for Inspecting and Passing the Accounts of the Vice Treasurer and the Receiver General of the Revenue, Ireland, the Paymaster[s] of the Forces, the Master of the Ordnance, the Ministers of the Victuals, the Clerk of the Works and Buildings and of every accomptant which under any former commission were required or empowered to be examined. Royal warrant, under the Queen's sign manual, to the Lord Lieutenant of Ireland to cause the Parliament House to be fitted up and repaired to a charge not exceeding 620l. 12s. 5d., in accordance with the estimate lately transmitted. Out Letters (Ireland) VI, p. 209.
Same to same to discharge and cancel the bond in 1,700l. given by Lieut. Gen. Sarsfeild's agent for answering (on condemnation) the value of the ship Henry of London, some time since seized in Ireland by one of the Agents for Prizes, and delivered to said Sarsfeild's agent at Dublin on said bond : the said ship having since been condemned in the Admiralty, whereby said security becomes liable, but the Queen is pleased to discharge said bond "for divers just and honourable causes." Sept. 28. Henry Guy to Mr. Roberts [Receiver of the Honor of Windsor] to pay the rent due for the mill at Windsor, notwithstanding any former order to the contrary [see supra, pp. 1640-1]. Disposition Book XI, p. 1.
Same to the Customs Commissioners, enclosing the petition [missing] of Josias Caillon, a French Protestant, concerning the ship detained at Dartmouth ; with Secretary the Earl of Nottingham's letter [missing] thereon. You are to order the discharge of the ship. Out Letters (General) XIII, p. 370.
Same to Mr. Clarke to procure a royal warrant, to be signed by the Queen, to authorise the Paymasters of the Forces in Ireland to pay 87l. 0s. 7¾d. to Margret Hopson, widow, in full of her husband Richard Hopson's arrears of pay as Quartermaster to Capt. Treasury warrant to the Customs Commissioners to permit the ship St. John Bautista of Genoa, Capt. Berenzone part owner and commander, to complete her cargo with commodities of this kingdom and to depart, she having taken in part of her lading of cacao in Holland and come to the Thames in hopes to meet with goods to go full laden home, but is seized by Mr. Canby under the Navigation Act, "it having been constantly understood, according to the rules and laws of the Customs, that such voluntary coming into port with any declaration or mark of intention to make this a port of lading or discharge has been such an importation as renders the customable goods subject to payment of duty and the prohibited [goods] to forfeiture" : but in this case the master pleads ignorance of the laws and hath not unladen any part of his cargo. Prefixing : (a) Order of the Queen in Council, dated Whitehall, Sept. 22, extending for a further time the Order of Aug. 18 last, supra, p. 1794, which took off the embargo from several ships whose masters and owners had contracted with the Victualling Commissioners to carry provisions, stores and soldiers to the West Indies : provided they be ready to sail with the other ships and convoy intended for the West Indies.

Prefixing : (a) a like Order, taking off the present embargo from all ships bound to Portugal from any port in England between Berwick and St. Ives until Oct. 10 next, at which time all ships going out of London or other port northwards are to be ready in the Downs to sail with the convoy, and all ships from [ports from] the Downs to St. Ives in the English Channel are to be ready to sail with the convoy as they pass along the Channel : on giving bonds as by the Orders in Council of 1691, Aug. 27, and 1691, Oct. 27 : and further to take off the embargo from all ships bound to Portugal from any ports between St. Ives and Carlisle until Oct. 10 next on bonds as under the 1691, Aug. 27, Order, and on bonds further to return from Portugal with such convoy as shall be appointed for the general Portugal fleet, provided also that these last named ships from St. Ives to Carlisle be not permitted to go out of port till the 20th of Oct. next, being 10 days after the time appointed for the Portugal ships to be in the Downs : all on the report of the Admiralty Lords that the convoys for the merchant ships going to Portugal will be ready to sail on Oct. 10 next and that they have agreed that time with the merchants trading thither.

[? Sept. 30.] Report to the Queen from the Treasury Lords on the Order [of reference] in Council of the 29th inst. We have considered the draft of a Proclamation and the estimates annexed. As to the last clause of it relating to the paying of all the seamen to Michaelmas, 1692 (which by the said estimate amounts to above 900,000l.), we are of opinion that so great a sum cannot be furnished within the time proposed neither out of the remainder due to the head of wages [under the 1,000,000l. appropriation clause of the Act for the second Twelve Months' Aid] (which amounts to about 170,000l. for this last year's service) nor out of any credit to be had upon the revenue as it stands at present engaged. "But in case the Parliament shall think fit to make a further provision for the expenses of the Navy next year as will be sufficient to clear the arrears of the seamen's wages to Michaelmas, 1692, and carry on the current service at the same time, we think it will be of great use and advantage to your Majesty's service."
