Report to the Queen from the Treasury Lords on the
petition of William Baker, master of the brigantine
Dolphin of New York, 35 tons, six mariners ; petitioner
shewing that she and they belong wholly to
New York, whence she was freighted to Holland
and back, and in her way to touch at England
both going and coming to pay Customs and give
Plantation bonds according to the Navigation Act ;
but that touching at the Isle of Wight she is there
stopped on account of the embargo, and praying
leave to return to New York with the Newfoundland
convoy. We have referred said petition to the
Customs Commissioners, who find that the ship
belongs to New York merchants and all her company
save two Dutchmen are inhabitants of New England
and other parts of America. It has been customary
upon former embargoes to permit ships belonging
to the Plantations and manned with mariners of
the Plantations to return home. |

Money XIV, p. 90. |
Royal warrant, under the Queen's sign manual, to
tho Lord Lieutenant of Ireland to discharge William
Shaw from a debt of 100l. 8s. 5d. as follows. In
1686 Patrick McGill and others farmed from the
then Revenue Commissioners in Ireland the Hearthmoney
of the counties of Down and Antrim at the
rent of 3,215l., and said Shaw became security for
same. The said farmers failing to pay said sum,
Shaw was sued for the arrear of about 400l. He
paid 300l. and gave security for the balance. But
the Hearthmoney for said counties was not set for
near 3,215l. any year before or since, and Shaw
has been a great sufferer by the rebellion and is
reduced to great poverty. From the report of the
Revenue Commissioners on said Shaw's petition it
appears that 101l. 16s. 5d. is charged upon Shaw
in the accounts to 1688, Christmas, of Geo.
McCartney, late collector of Carrickfergus, to
whom the said Hearthmoney was given in charge ;
against which Shaw claims an allowance of 28s.
for the Castle of Carrickfergus, which allowance
has been formerly made. The Commissioners
believe that by the troublesomeness of the times
great part of the arrears of the said Hearthmoney
became insolvent to the farmers. Shaw is therefore
to be discharged as above. |

Report to the Queen from the Treasury Lords on the
petition of Richard Cox, transmitted by the Lord
Lieutenant of Ireland, and referred to us the 15th
inst. Petitioner shews that he was made second
Justice of Common Pleas there 1690, Sept. 4, and
being the only judge then there was obliged to
constant attendance on the State and was daily
employed by the Lords Justices in drawing Proclamations
and other services of the Government ; that
in Oct., 1690, he was sent to Drogheda and co.
Louth as Judge of Assize and Gaol Delivery without
any allowance for same, and that he likewise kept
Michaelmas term alone in the Court of Common
Pleas ; that nevertheless the salary due to him
for the half year ended 1690, Christmas, being 200l.,
is not yet paid, nor can be without special orders,
because the establishment sent over only begins
from that date. We find that petitioner is a person
very zealous for the Government and hath done
good service on several occasions. We have nothing
to object to the payment of said half year's salary
to him. |
Warrants not Relating to
Money XIV, p. 91. |
Same to the Treasury Lords from Mr. Povey, on
the petition of the Assembly of Maryland, concerning
the impost of 25 ships that came thence in
1690 without paying the duties there. By an
Act of said Assembly, dated 1679, April 30, an
impost of 2s. per hogshead of tobacco exported
thence is granted to the Lord Proprietor of Maryland,
one moiety thereof being appropriated to the
Government there. Upon taking that Province
under the immediate care and protection of the
Crown, the Queen in Council order 1690-1, Feb. 26,
that the said moiety should be so applied to the
Government there and that the other moiety should
be received by Lord Baltimore to his own use as
Proprietary of that Province : and Col. Copley
was directed by the Queen's Instructions of 1691,
Aug. 26, to take [care] that one fourth part of the
said moiety be applied towards maintaining a
constant magazine with arms and ammunition for
the defence of the country and to receive the remaining
three fourths to his own use as Governor in
Chief thereof for his support in the Government.
It appears that 940l. of the moiety for 1692 was
disposed by the Convention of Maryland for the
public uses of the Government before the arrival
of Col. Copley. Therefore the Assembly prays that
in lieu thereof Copley may receive to his own use
the whole moiety of the impost on the abovesaid
25 ships. But by Treasury order of 1691, Oct. 2,
supra, p. 1326, the Receiver General of Customs
[England] was ordered to demand from the 26 ships
that came from Maryland in 1690 the sum of
1,730l. 19s. 0d., whereof the moiety of the 2s. per
hogshead came to 735l. 15s. 0d. The said Receiver
General was further ordered Jan. 28 last, supra,
p. 1466, to pay 465l. 19s. 0d. to Lord Baltimore out
of same. As yet the said Receiver General has
given no security of his proceedings herein, so I
cannot say whether all or any part of said
1,730l. 19s. 0d. has been received from the masters
of said ships "or whether according to what has
been proposed to your Lordships the names of the
masters refusing to pay the same, and of the said
ships, have been certified by the Receiver General,
that upon the return of those ships or masters to
Maryland the Government there may oblige them
to make good the said duties before they be permitted
to come away." |
