and Hearthmoney to pay 50l. to Samuel Turner
for 1690, Michaelmas quarter's salary as Receiver
General of Hearthmoney, he having spent that
quarter in said service by reason that Col. William
Tempest, Receiver General of same for cos. Westmorland,
Cumberland, Durham, Northumberland,
Newcastle and Berwick, for several years up to
1688, Sept. 29, did after the accession of their
present Majesties refuse to continue the service
and left the accounts and affairs thereof in great
disorder, whereupon said Turner was appointed in
May, 1689, to look after the collection up to 1689,
Lady day, and to make up the accounts for several
half years before ; in order to which Turner went
into the said counties, and by reason of the trouble
someness of the times in those parts, where the
Danish Army for some time lay, he had greater
difficulty than formerly in getting in the money
and had to continue there till Midsummer, 1690,
to finish that collection, and hath spent some time
since that date in making up some of the collectors'
accounts that were employed under him ; which he
has fairly made up and adjusted. |

petition of the Royal Africa Company : petitioners
setting forth that in September, 1691, the King
granted leave to import from France in English
vessels employed for the exchange of prisoners
about 80 tons of redwood taken at sea from the
petitioners and since [redeemed or] purchased by
them ; that under the passport same was to be
imported in three months, but the ship could only
bring part, and the balance of 28 tons is now time
expired ; therefore praying a like licence for import
of said balance, the wood being useful for dyeing of

Report to the Queen from the Treasury Lords on the
petition of Elizabeth, Countess of Clancarty, on
behalf of herself, her son and daughters, and on
the report by the Attorney General, Ireland, thereon.
We consider petitioner has a legal right to have
her dower out of the estate of her late husband,
Callaghan, late Earl of Clancarty, which is descended
to her son Donough, now Earl of Clancarty,
and which is seized upon his outlawry ;
and further that she ought to have (out of the
estate) the damages amounting to 6,280l. which
she recovered by a judgment at law for detention
of her dower from the death of her husband.
Her other pretensions out of the estate, for which
she has a great deal of equity, consist of several
debts for which she is liable and which were contracted
for purchasing chief rents now comprehended
in the forfeiture and for the portion of her daughter
Lady Hellen, who was married to Mr. Colville, and
for maintenance of her three younger daughters etc.,
the whole amounting to 5,784l. 7s. 8d., which are
sworn to (to the extent of 5,092l. 10s. 0d.) by John
Murray, who was employed in managing the estate.
Notwithstanding, in point of law she must submit
entirely to your Majesty's clemency in regard to
these latter claims. She has four daughters whom
she has bred up Protestants. Their father intended
to settle portions on them, but died suddenly of
an apoplexy before completing the settlement, and
they are left destitute. The House of Lords was
so sensible thereof that in 1690 in a Bill for vesting
forfeited estates in Ireland they added a proviso
to charge these estates with 6,500l. to petitioner
for her last mentioned pretences and 4,000l. each
to the said three daughters then unmarried, but
the Parliament was prorogued before the Bill
passed.
A custodiam may be granted of the estates at
700l. per an. rent (the rent formerly payable thereout)
until satisfaction of petitioner's demands and of
what your Majesty may appoint for the daughters.
On behalf of the Earl, petitioner's counsel presses
for the reversal of the attainder "for that when
the petitioner had taken great care to have him
strictly bred in the Protestant religion at Oxford
he was without her knowledge brought from thence
and put into the Army in Ireland before he was 15
years of age, where he continued till the late King
James arrived there, who had such apprehensions
of his leaving of him that he confined him three
months a prisoner, and though he was afterwards
in some command yet that he was still under age
and could not get from thence : that when the
Earl of Marlborough arrived at Cork the said Earl
of Clancarty with others in that garrison did capitulate
and surrender themselves and the town on
the 28th Sept., 1690, upon terms, and that it was
by the Articles agreed that there should be no
prejudice done them, and from thence the said
Earl was brought and hath since remained a prisoner
of war and that the said surrender was within less
than twelve month after the outlawry in England
against him, which was in Feb., 1689-90 : that
though he be not within the strict letter yet he is
within the equity and meaning of the statute of
5 and 6 Edw. VI, and should be admitted to traverse
the said indictment and avoid the said outlawry,
having surrendered himself as aforesaid and by
his confinement being disabled literally to pursue
the same, hoping that his said surrendering of
himself without prejudice and being under age
and other circumstances may move your Majesty
not further to prosecute him at your Majesty's suit
for what happened before his said surrender as
aforesaid : that as to the outlawries in Ireland the
same were had against him while he was a prisoner
in the Tower, which (as hath been insisted upon)
is a plain error in fact for which the outlawries in
Ireland ought to be in law set aside and reversed :
but that the Attorney General in Ireland delayeth
to let any writ of error issue till he receive your
Majesty's decision therein."
We offer no opinion on the reasons for reversing
the outlawry, being firstly matters of law, but
submit same to your Majesty. |

which rents were paid him during his lifetime and
were by him 1680-1, Mar. 9, settled in Sir Robert
Southwell and William Whitlock in trust for said
Elizabeth as her jointure, which she received till the
beginning of the late troubles in Ireland ; the
Attorney General [England] being of opinion that
said settlement is legal and that petitioner is entitled :
and further she appearing to deserve favourable
consideration, having suffered in her estate for the
good offices done for the English Protestants in
