care of the King's private roads in several parts of
the kingdom to and from the royal palaces and
places of access "that are locked up with gates
and preserved for our own passage and those that
attend our royal person, which have been made at
our own expence or at the expence of our royal
predecessors and are from time to time maintained
and repaired at our charge," the said office to be
called "the office of Keeper of our private roads,
gates and bridges and Conductor or Guide to our
royal person in our royal progresses to conduct us
the best and safest ways" : and to constitute
Michael Studholme, esq., to the said office : with
the allowance, fee or pension of 2s. a day from
Lady day past ; and with the further allowance or fee
of 3s. 4d. a day for one quarter in every year and
to be allowed for the quarter Lady day to Midsummer
last and so onward for the said quarter yearly ; and
with the further like allowance of 3s. 4d. a day for
so many days as he shall be employed at other
times in the year from Michaelmas last according
to certificates from time to time to be signed by
the Lord Chamberlain : all by reason that the office
of Guide and Surveyor of his Majesty's Ways etc.
was granted by Charles II 1660, Nov. 27, to Andrew
Lawrence, esq., and by a commission dated Mar. 6
last it has been found that said Lawrence has made
several bargains and agreements to elude the laws
of the realm made for the preservation of the said
highways to the great detriment and prejudice of
the public and common highways, whereby his
said office is rendered burdensome to the people,
and the King is therefore resolved not to employ
the said Lawrence or any other person for the future
in the said office of Surveyor of the King's highways,
"our laws of this realm having effectually provided
other officers to oversee the same." |

Treasury reference to the Customs Commissioners of
the petition of Capt. Christopher Billop, shewing
that about 26 June, 1689, he seized at sea as prize
three flyboats and took out the goods between
decks in right of himself, officers and seamen and
offered to enter same at the Custom House at
Plymouth, but Mr. George Dickenson, customer of
said port, would not admit of an entry as [being]
French goods ; whereupon petitioner put said goods
on some of the King's victualling ships and pursued
his orders to join the fleet then cruizing off Ushant,
acquainting the Earl of Torrington with what he
had done, who advised him to order the said goods
to be delivered to the same officer to whom he
delivered the ships ; whereupon petitioner ordered
John Steventon, whom he had left as supervisor of
the said goods, to deliver same to said Dickenson,
taking his receipt to be accomptable for same to
petitioner and his officers and seamen in case the
ship and goods were condemned as prize, but if
cleared, then to be returned to the owners : but
said Dickinson sent for a writ of appraisement and
illegally [ap]praised the said goods by his own
creatures, one Peter Contee, warehousekeeper, and
John Edgcombe, cooper, whereby if it prove a legal
seizure, the Crown suffers some hundreds [of pounds]
loss and petitioner some 3,000l. : whereas the said
goods being prize cannot be [ad]judged as merchandise
imported : it is an adjudged case that all goods
between decks belong to the captain, officers and
seamen that took the prize, so that there is no
colour in law for Dickinson's seizure and condemnation
of said goods which were put into his custody :
further that there were 27 hogsheads more of those
same wines which petitioner carried to the fleet
and after advice as aforesaid sent to Plymouth in
the William and Thomas ketch, Thos. Brapell master,
but Mr. Steventon, whom he was directed to [deliver
to], was commanded to the fleet with the victualling
ships under his charge ; so that Brapell knew not
to whom to apply, and a day or two after William
Buck, a weighing porter, forcibly took the said
wines ashore : therefore petitioner prays that
Dickinson may answer said charge and embezzlements
and may make petitioner full satisfaction. |

Royal warrant to the Paymasters General of the Army
in Ireland for provision to be made, during the
winter quarters, within the Hospital at Dublin
and the Hospital to be appointed at Waterford
for all sick and wounded soldiers within the Army
in Ireland : it being the King's intention to cause
a marching hospital to be regulated and settled for
the ensuing campaign, to be furnished with medicaments
and attended with the requisite officers and
soldiers : and for the better support thereof from
Dec. 31 next said Paymasters are hereby to deduct
from the pay of any persons in any Company of
Foot or Troop of Dragoons (except Commission
officers only) one farthing per day ; and out of the
pay of every person listed in a Troop of Horse and
from the Marshal's men and attendants of said
Hospital two farthings per day (commission officers
excepted) : the same to be employed for the relief of
said sick and wounded, "which with the payment of
one day's pay formerly directed [to be deducted] is
to be in lieu and full satisfaction of all other expences
and deductions whatsoever for the same." The
present warrant is by reason that by the establishment
of June 1 last the King appointed one first [aid]
Hospital and one Marching Hospital for the Army
in Ireland with officers and regulations as therein ;
which Hospitals not having answered the service
which the King expected from them, he has thought
fit to discontinue and set aside the said establishment,
which is hereby so discontinued and replaced
by the above provision, "for as much as it is necessary
that due care be taken of all sick and wounded
soldiers" in said Army in Ireland. |

Prefixing : the like Order, dated Whitehall, Oct. 23
ult. By Order of Council of Sept. 30 last, on the
petition of Christopher Billop, late commander of
the King's ship Eagle, the King directed the wine
and brandy taken on board the Golden Nangle or
Hooke not to be delivered to the claimers thereof
till Capt. Greydon's case be determined in the
High Court of Admiralty. By petition this day
read the said Billop sets forth that said cause was
tried before the Admiralty Judge on the 16th inst.
and the goods between decks of prizes [were]
adjudged to belong rightfully to the captains,
officers and seamen who should take same : Billop
further representing that he seized and sent into
Plymouth a small vessel called the Charity of
Dublin, which being condemned and measured to
30 tons pursuant to the King's declaration of 1689,
May 23, he has several times demanded from the
Prizes Commissioners the tonnage due to him
by virtue of said declaration, but has been still put
off by delays, to his great charge. Hereupon it is
hereby ordered that the said Order of Sept. 30 last
be revoked and that the Principal Commissioners for
Prizes deliver to said Billop the said wine and
brandy [out of the Golden Nangle] and the [value
of the] said tonnage of the Charity, to be by him
distributed to the officers and seamen ; and that
said Commissioners reimburse Billop's charges in
this matter unless they can shew cause to the
contrary. And whereas at the unloading of the
Golden Nangle care was not taken for distinguishing
the goods between decks from those in the hold,
thereby designing to give Billop trouble in obtaining
said goods, which may occasion law suits, it is
hereby ordered that a computation be made of
the leakage or damage of the ship's whole cargo
and that the officers and seamen do allow their
share proportionably to the quantity of the said
brandy and wine. |

notice from the collector of Liverpool concerning

for want of passes. Hereon notice is taken that
no such soldiers are disbanded in Ireland and it is
ordered that such private soldiers as are or shall
be stopped at Liverpool, or come that way, are to
be sent to Chester Castle to be kept as deserters
till they be delivered by due course of law. |

Treasury warrant to the Customs Commissioners to discharge
the seizure of the ship Benjamin, John Payne
commander, which arrived with currants from Zante
not manned with three-fourths English, and therefore
seized by Mr. Robertson, a tidesurveyor, London
port : it appearing that in Nov., 1685, she sailed from
Yarmouth with herrings for the Straits, with 16
English, and continued trading in the Straits till
her now late homeward voyage, during which time
two of her crew died and seven ran away, so that
he was obliged to hire four foreigners to bring her
home ; the Venetian on board being come as a
passenger, not as a seaman. |

of Sir Michael Cole, ut supra, p. 879. Your Lordships
are already well satisfied of petitioner's losses,
services and merits. The plantation desired
belonged to Terence MacDermot, an Irish Papist
in rebellion against their Majesties. It lies in the
Island of Montserrat. Its value is, to me, uncertain.
The grant may pass to petitioner on condition he
render to the King, upon conviction of the present
possessor, all value beyond 1,000l. after appraisement
by the Governor, of the plantation, the servants
and appurtenances thereof. |

Appending : (a) letter, undated, from four Lords of
the Admiralty. In August last Gilbert Nelson,
merchant, bought 300 tons of defective provisions
from the Victualling Commissioners with design to
send same to the West Indies in the ships Prince of
Orange and Anne, Jonas Daniell and Jo[h]n Leech
masters, and obtained a [Treasury] order for their
Customs free shipment and an Admiralty protection
"for the said ship and 35 men," but same were
detained by contrary winds till the late general
embargo : whereupon Nelson petitioned the Privy
Council for leave for them to proceed, he promising
on behalf of himself and company that they should
carry 70 tons of provisions, freight free, for the
supply of the Duke of Bolton's Regiment and 50
soldiers, part of those going to recruit the said
Regiment, the King finding provisions for them.
In pursuance of the Order in Council of Oct. 30 last
we have requested the Navy Commissioners to
agree accordingly with said Nelson and company
and they have so done. Please give orders to the
Customs to clear said ships accordingly under the
usual bonds. |
