De Beneficiis Vacantibus



1430. 3 Id. Dec. SS. Apostoli, Rome. (f. 14.)	To the abbot of St. Mary's, Easdara, in the diocese of Achonry, and Donald Macdonnchaid and Dermit Macgacdagan, canons of Achonry. Mandate as below. Lately the pope (upon learning that the rectoria parrochialis in terris de Minbrisg alias Castri de Sligrach sive inter duos pontes, in the diocese of Elphin, was void because Bernard Macdonnchaid, formerly rector in the said lands, had entered and made his profession in the Friars Preachers’ house of Sligrach in the said diocese; and upon its being set forth to him by the Premonstratensian abbot and convent of Holy Trinity, Lachque (sic), in the said diocese, that a number of lay persons were usurping the fruits etc. of the said rectory, and that the means of the said monastery were insufficient for the maintenance of the abbot and convent) ordered, at the petition of the said abbot and convent, who asserted that the fruits etc. of the said rectory and monastery did not exceed 20 and 40 marks respectively, the said rectory to be appropriated to the said monastery [above, p. 52]. At the petition of Bernard Occoneil, clerk, of the said diocese (containing that the said letters and the consequent appropriation, under pretext of which the said abbot and convent have detained possession of the said rectory for about three years, are surreptitious and null because the fruits etc. of the said monastery exceed 50 marks; whilst also at the time of the impetration of the said mandate the said rectory was commonly said to be of the Hospitallers’ house of Killmaighnean in the diocese of Dublin; and that a number of lay persons are detaining its fruits) the pope orders the above to summon the said abbot and convent, whom the said Bernard cannot safely meet within the city and diocese of Elphin, and if they find the facts to be as stated, to decree the said mandate and appropriation surreptitious and null, and in that event to collate and assign the said rectory, value not exceeeding 20 marks, as above, to Bernard. 1430. 2 Kal. Dec. SS. Apostoli. Rome. (f. 28.)	To the dean and the archdeacon and Gilbert Olegan, canon, of Limerick. Mandate to collate and assign to Bernard Oconchuyr, clerk, of the diocese of Ardfert, who is by both parents of noble race, the rectory of Croom (Croma) in the diocese of Limerick, value not exceeding 20 marks, void because William Erstekin, priest, of the diocese of Kildare, who is to be summoned and removed, obtained, collated to him by authority of the ordinary, the archdeaconry of Kildare, a non-major dignity with cure, and held it with the said rectory for more than two years. 6 Id. Dec. SS. Apostoli, Rome. (f. 32d.)	To John Stewart, canon of Dunkeld, dwelling in the diocese of St. Andrews. Mandate (the pope having been informed by Thomas de Ramsay, priest, perpetual vicar of Conveth in the diocese of St. Andrews, that formerly Hugh de Brechin, perpetual vicar of Fordon in the said diocese, neglected to pay sums of money due to bishop Henry, and although publicly excommunicated, celebrated mass etc. publicly and still does so, in contempt of the keys, incurring irregularity), if Thomas will accuse Hugh before him, to summon Hugh and others concerned, and if he find the facts to be as stated, to deprive Hugh, and in that event to collate and assign the said vicarage, value not exceeding 10l. sterling, to Thomas; whether it be thus void, or because the said Hugh, when holding it, obtained the subdeanery of Brechin, an office with cure, and has unduly detained it for more than a month, as he still does, or be void in any other way; notwithstanding that Thomas holds the above vicarage of Conveth, value not exceeding 8l. sterling, which he is to resign upon obtaining that of Fordon. 1431. 15 Kal. Feb. SS. Apostoli, Rome. (f. 60d.)	To John Boumacar, I.U.B. Collation etc. as below. His recent petition contained that Donald Post, priest, of the diocese of St. Andrews, in his long cause in the apostolic palace between him and the above John, Thomas Ihong, John Lawson and Thomas Mirton, priests, about the perpetual vicarage of Hadington in the said diocese (provision of which was made to the said Donald, and ordered to be made to Boumacar, in each case by papal authority, on its voidance by the death of Simon Breg; each of the above Thomas Ihong, John Lawson and Thomas Mirton falsely asserting that it lawfully belonged to himself, and the said Thomas Mirton unduly detaining possession), obtained a definitive sentence, hitherto unexecuted, by which the vicarage was adjudged to him, and perpetual silence imposed on Boumacar and the above Thomas Ihong, John Lawson and Thomas Mirton, and the last named removed. Seeing that the said vicarage has become void at the apostolic see, and therefore reserved, by the resignation of the above Donald, without having had possession, made to the pope this day by John Nicolai, proctor of the said causes and Donald's proctor specially appointed for the resignation, the pope hereby makes collation and provision thereof, value not exceeding 54l. sterling, to the above Boumacar, whether void as stated, or in any other way; notwithstanding that he holds the parish church of Munyabro in the diocese of Glasgow, of the patronage of laymen, value not exceeding 20l. sterling, and that the pope lately dispensed him to hold for five years with Munyabro the perpetual vicarage of Falkirk (Varie capelle) in the said diocese [of St. Andrews], about which he was litigating in the Roman court, if he won it, or one other benefice with cure or otherwise incompatible with Munyabro. Mandate to collate and assign to Maurice Otirassaid, priest, of the diocese of Clonfert, the perpetual vicarage, value not exceeding 4 marks, of Killeagam[or]bolga in the said diocese, so long void by the death of John Omacleachlaind, that its collation has lapsed to the apostolic see, summoning and removing James Obrogaid, clerk, of the said diocese, who has detained possession for between four and five years, having obtained it, after the said lapse, by collation made to him by authority of the ordinary. Mandate to collate and assign to Henry O[c]assinn, clerk, of the diocese of Derry, the perpetual vicarage, value not exceeding 5 marks, of Hachaddubaig in the said diocese, void because Felimicus Okahan held it for more than a year without being ordained priest, summoning and removing the same Felimicus, who has unduly detained possession for more than two years; whether it be void as stated, or by the death of Cristin Olonan or of Eugenius Okartean, or in any other way. 4 Id. Dec. SS. Apostoli, Rome. (f. 101.)	To the prior of St. Mary's, Durmach, in the diocese of Meath, Dermit Macgaedagan, canon of Achonry, and the official of Clo[n]fert. Mandate to collate and assign to David Oduyud, clerk, of the diocese of Kildare, who lately received papal dispensation, as the son of an unmarried man and an unmarried woman related in the fourth degree of kindred, to be promoted to all, even holy orders, and hold a benefice even with cure, the rectory, value not exceeding 30 marks, whose cure is wont to be exercised by a perpetual vicar, of Rosfyndglaisse alias Oregain in the said diocese, so long void, in a way not certain, that its collation has lapsed to the apostolic see, summoning and removing John Muur, commander of the Hospitallers’ house of Tuyle in the said diocese, who has detained possession without canonical title for two years, and whom David fears to meet in the city and diocese of Kildare; even if it became void by the death at the apostolic see of Maurice Oduyud, to whom provision was granted, or in any other way. Mandate to collate and assign to Cornelius Odonchuga, priest, of the diocese of Kilmacduagh, who has studied canon law for more than eight years, and who lately received papal dispensation, as the son of an unmarried man and an unmarried woman, related in the third and fourth degrees of kindred, to be promoted etc. as above, f. 101, the rectory of Beithac de Kynaledgahierorach in the said diocese, of the patronage of laymen, value not exceeding 8 marks, so long void by the death of Donald Oseaccnassyg that its collation has lapsed to the apostolic see, summoning and removing John Ofaithi, priest, of the said diocese, who under pretext of a presentation and institution, made to him after the said lapse, has detained possession for some time, and on account of whose power Cornelius has no hope of obtaining justice in the city and diocese of Kilmacduagh; notwithstanding that the pope lately granted provision to him of the treasurership of Kilmacduagh, a non-major dignity with cure, value not exceeding 3 marks. He is hereby dispensed to hold the said dignity (if he obtain it in virtue of the said grant and of the letters thereof, which are to be drawn up) and rectory together for seven years. 2 Kal. Dec. SS. Apostoli, Rome. (f. 106.)	To the archdeacon, Donald Macdonncaidh, canon, and the official of Achonry. Mandate to collate and assign to Matthew Ocallanan, clerk, of the diocese of Achonry, the perpetual vicarage, value not exceeding 4 marks, of Killmurchan in the said diocese, void by the death of Murianus Maclochlaind, summoning and removing Donatus Omynachan, who has detained possession without any right for more than three years; whether it be void in the way stated, or by the death or resignation of Thady Yfinachta, clerk, or in any other way. Matthew, who is the son of an unmarried man and an unmarried woman related in the third and third degrees of affinity, and who has the tonsure, is hereby dispensed to be promoted to all, even holy orders and hold the said vicarage. Mandate to collate and assign to Thady Okellaig, clerk, of the diocese of Elphin, who is the son of an unmarried man and an unmarried woman and has been tonsured, the perpetual vicarage, value not exceeding 8 marks, of Killosaileain in the said diocese, so long void, because Malachy Odubugain held it for more than a year without being ordained priest, that its collation lapsed to the apostolic see, summoning and removing Donatus Ogeruayn, priest, of the said diocese, who has detained possession for between four and five years, under a collation, made by authority of the ordinary, after the said lapse. Mandate to collate and assign to Edmund Oduyud, scholar, of the diocese of Kildare, the son of an unmarried man and an unmarried woman related in the fourth degree of kindred, after he has been tonsured, the rectory of Cuilbeancair alias Ardia in the said diocese, value not exceeding 15 marks, void by the death of Richard Dunra, summoning and removing James Thani, prior of the church of the house of St. John Baptist, Kyllmaynean (sic), of the order of Crouched friars (ordinis [fratrum] cruciferorum), in the diocese of Dublin, B.C.L., who has detained possession without any canonical title for three years. Lett. VII, pp. 100 and 202), summoning and removing Robert Olienachan, priest, of the latter diocese (in which reside no judges competent to be written to), who has detained possession without any canonical title for more than two years; whether void as above, or by the resignation of the above John, or in any other way. 1431. 7 Id. Jan. SS. Apostoli, Rome. (f. 127d.)	To the abbot of Balmorinach in the diocese of St. Andrews, and the archdeacons of Caithness (Cathanen.) and Majorca in Toledo. Mandate as below. The petition of Nicholas de Murhous, priest, perpetual vicar of Luntrethin in the diocese of St. Andrews, contained that formerly he was presented to the said vicarage (on its voidance by its then perpetual vicar, John de Benyng, obtaining the perpetual vicarage of Kilpatric in the diocese of Glasgow by authority of the ordinary) by prior Patrick and the convent of the Augustinian priory of Inchmahome (Insule Sancti Colmaci) in the diocese of Dunblane, to whom the presentation to the vicarage belongs by ancient custom, to bishop Henry, and by that bishop instituted as rector (sic) of the said church; that Gilbert de Dernle, priest, of the diocese of Glasgow, claiming the said vicarage of Luntrethin, prevented the said presentation and institution from taking effect, himself detaining possession, as he still does; and that the pope committed Nicholas's appeal to the apostolic see and the principal matter to Master John de Palena, papal chaplain and auditor, who by a definitive sentence pronounced the said presentation etc. to have been and to be canonical, adjudged the said vicarage to Nicholas, and removed Gilbert, condemning him in fruits and costs, which costs he afterwards assessed at 28 gold florins of the camera. The said petition adding that Nicholas fears that whilst the cause has been pending others have intruded themselves, or may do so, etc., the pope orders the above to execute the above, induct Nicholas or his proctor, removing Gilbert, cause satisfaction to be made to Nicholas in respect of the said fruits and costs, and make execution against other intruders, etc. Exhibita nobis. 15 Kal. March. SS. Apostoli, Rome. (f. 156.)	To the bishops of Adria and St. Andrews and the provost of St. Donatien, Bruges, in the diocese of Tournai. Mandate as below. The petition of Donald Post, perpetual vicar of Hadington in the diocese of St. Andrews, contained that a cause arose lately between John Boumaker and John Lawson and Thomas Mirton and Thomas Hang (sic), priests, of the said diocese, about the perpetual vicarage of Hadington, which, on its voidance by the death of Simon Beeg (cf. f. 60d), each of them claimed; that the pope at Boumaker's instance committed the cause, although not lawfully devolved to the Roman court, to the above Master John de Palena, who adjudged the vicarage to Donald etc., condemned Mirton in fruits received, and him and Thomas Ihong, Boumaker and Lawson in costs, which latter he afterwards assessed at 28 gold florins of the camera. 1430. 3 Id. Dec. SS. Apostoli, Rome. (f. 200d.)	To the bishop of Alet, the prior of St. Andrews and the abbot of Balmurynoch in the diocese of St. Andrews. Mandate as below. The petition of Adam de Gordon, canon of Dunkeld, contained that although he formerly obtained, collated to him by papal authority, the canonry and prebend of Fergundeueney in Dunkeld, on voidance by the death of John de Dauglas, after he had held them for some time Thomas de Mirton, clerk, of the diocese of St. Andrews, claiming them, despoiled him thereof and is still in possession; that at Adam's instance the pope committed his appeal to the apostolic see and the principal matter to Master John de Mella, papal chaplain and auditor, who gave a definitive sentence in his favour, removing Thomas and restoring Adam, and condemning Thomas in fruits and costs, which latter he afterwards assessed at 30 gold florins of the camera. The said petition adding that Adam fears etc., as above f. 127d, the pope orders as ibid, mutatis mutandis. Exhibita nobis. (Pe. xxiii. de Casatiis.)
10 Kal. Jan. SS. Apostoli, Rome. (f. 206d.)	To the bishop of Alet, the dean of Clonfert, (fn. 2) and John Odubgilla, canon of Kilmacduagh. Mandate as below. The recent petition of Cornelius Odubgilla, priest, of the diocese of Kilmacduagh, contained that formerly, on the voidance of the rectory of Ardrachain in the said diocese by the death of Donald Ocheachnassida, the patron, William de Burgo, layman, presented him to bishop John, who instituted him, in virtue of which presentation and institution he obtained possession, but now doubts their validity. The pope therefore orders the above to collate and assign to him the said rectory, value not exceeding 30 marks. Vite etc. (An. xx. Idus Januarii Anno Quartodecimo. de Adria.)
17 Kal. Jan. SS. Apostoli, Rome. (f. 222d.)	To the bishop of Alet, the prior of St. Andrews and the abbot of Balmurinoch in the diocese of St. Andrews. Mandate as below. The petition of Adam de Gordan, canon of Moray, contained that although he formerly obtained, in virtue of papal letters, the canonry and prebend of Kynnor in Moray, on their voidance by the death of John de Inchemartin, Ingram Lyndesa and Duncan Kenzheson, clerks, of the diocese of St. Andrews, both claimed them, prevented the said letters from taking effect, and successively intruded themselves, Ingram being still in possession; that at Adam's instance the pope committed his cause against them, although not lawfully devolved to the Roman court, to Master John Schallerman, papal chaplain and auditor, who gave a definitive sentence in his favour, removing Ingram and restoring Adam, and condemning Ingram and Duncan in fruits and costs, which latter he, afterwards assessed at 28 gold florins of the camera. Faculty for him, to whom the pope has made provision of the said see, to be consecrated by any catholic bishop, assisted by two or three like bishops. Dispensation to him, who holds besides Hemyngford Abbatis the canonry and prebends of Oxgate in St. Paul's, London, and Gaya Major in Lichfield, value altogether not exceeding 60l. sterling, to hold for ten years any other benefice incompatible with the said church, and to resign both, simply or for exchange, as often as he pleases. Mandate to dispense Richard de Geraldinis and Eleys M'Yconchur, who lately, knowing that they were related in the third and third and the fourth and fourth degrees of affinity, committed fornication with one another several times, to marry, a penance for the said incest being imposed. 1431. 13 Kal. Feb. SS. Apostoli, Rome. (f. 270d.)	To William Sponne, licentiate of canon law, archdeacon of Northfolk in the church of Norwich. Indult for life to visit his said archdeaconry by deputy, and to receive procurations in ready money. Meretur devocionis tue.

3 Id. Jan. SS. Apostoli, Rome. (f. 303.)	To the abbot of Abbirbrothoh [in the diocese of] St. Andrews. Mandate, at the recent petition of Patrick Hog, priest, of the diocese of St. Andrews, M.A. (containing that when returning home lately from the town of Hadynton, whither he had gone on business, he suddenly came across his father John Hog and the late John Peblis, laymen, of the said diocese, armed and fighting; that Patrick drew the sword which he was wearing after the manner of the country, waited for the said John Peblis to come out of the door of a house in the town of Truaernent, and when he did so struck him a blow from which he afterwards died), after Patrick has made satisfaction to the heirs etc., to absolve him from the crime of homicide, enjoining a penance, and rehabilitate him, etc. Et si antiquus hostis. 1430. 18 Kal. Jan. SS. Apostoli. Rome. (f. 305d.)	To Florence Macnoglaidh, perpetual vicar of Killoridh in the diocese of Ardagh. Grant that the letters by which the pope lately ordered provision to be made to him of the above vicarage, value not exceeding 6 marks, on its voidance by the death of Eneas Macnoglayd, shall hold good from the present date even if, as it is asserted, the said vicarage (of which provision was made to him in virtue of the said letters, and of which he is in possession in virtue of the said provision) became void, not as above, but by the death of Charles (Caroli) alias Clarus Macnaglaidh, and in whatsoever way it became void.
