To Raymund (Raymundo) Bremicham, priest, of Tuam. Rehabilitation as below. Martin V dispensed him, as the son of an unmarried man and an abbess professed of the order of St. Augustine, to be promoted to all, even holy orders. Subsequently he set forth to the present pope that, having been meanwhile tonsured, on the voidance of the rectory of Dummor in the diocese of Tuam by the death without the Roman court of Raymund Bremicham he was, without having obtained other dispensation on account of the said defect, presented by the patron, Thomas Bremicham, to the late John, archbishop of Tuam, and by him instituted, and under pretext thereof obtained it. Afterwards the present pope ordered provision to be made to him of the provostship of Tuam, a non-major dignity, void and reserved by Execrabilis because Thomas Obraen, priest, of the said diocese, had obtained it when holding the perpetual vicarage of Athnaryg(h) in the same diocese, and had held them together for more than a month, at the same time dispensing him to hold it and the said rectory together for life [Cal. Lett. VIII, pp. 651, 652], the pope's letters stating that he had been previously dispensed to hold a benefice even with cure. At his recent petition (containing that at the time of the said first letters he had been dispensed by authority of the ordinary on account of the said defect to be promoted to all minor orders, and that after that dispensation he was tonsured, and before the collation of the said provostship was promoted to all the said holy orders, and that the said unmarried man and abbess were related in the second degree of affinity and the fourth of kindred, of which no mention was made in the said letters, and that he, without any other dispensation, obtained possession, under pretext of the pope's said letters, of the said provostship, collated to him in pursuance thereof, and has detained together for four years it and the said rectory, which latter he had already detained for about three years) the pope grants to him (who is of a race of kings and dukes, who at the date of the said letters was ignorant of the said degrees of relationship, and also for the prosecution of his postulation to the church of Tuam came to the apostolic see at great danger and expense, and who has for many years studied canon law) rehabilitation on account of the aforesaid, but requires him to resign both provostship and rectory. Rehabilitation, at his recent petition containing that on the voidance by the resignation of rector John Estby to the late William (fn. 4) [Grey] (fn. 5) bishop of Lincoln, of the church of Turresmera in the diocese of Lincoln, which is only habitually parochial (fn. 6), and which within the memory of man has had no parishioners, John Langestone, the patron, presented him, then a scholar and not yet tonsured (fn. 7), in about his twelfth year and without any canonical dispensation, to the said bishop or his vicar-general in spirituals, as being a priest and of sufficient age; that the said bishop or vicar instituted him as such, being described in the presentation as a priest; and that under pretext of the said presentation and institution he obtained the said church and has detained it for about six years. Besides rehabilitating him the pope grants that the said presentation and institution shall hold good from the date of these presents, and decrees that the said church, value not exceeding 3 marks sterling shall, as long as no parishioners enjoying parochial rights reside within its bounds, be compatible with any other benefice, and be a free chapel. (fn. 11) The recent petition of Rory Ymochan, clerk, of the diocese of Achonry, contained that the late Charles Macdonnany, clerk, canon of Elphin, held and possessed at the time of his death a number of tithes, rents and goods, wont from of old to belong to the community of the church of Elphin and situate within the bounds of places in the cantred of Tyribrinyn, in the diocese of Elphin, possession of which is at present being unduly detained by certain useless clerical persons; and added that in the said church, of which Rory is also a canon, there do not exist sufficient distinct prebends for its canons, and that he has no benefice from which he can take any fruits. Rory further alleges that he is of noble race and has for some time studied canon law, and that the present pope recently ordered provision to be made to him (who was lately dispensed by authority of the ordinary, as the son of unmarried parents related in the third and fourth degrees of affinity, to be promoted to minor orders only and hold a benefice without cure, and then—provision having been made to him of a canonry of Elphin and another of Achonry with reservation of as many prebends, and provision having been ordered to be made to him of the provostship of Elphin and of the rectory of the rural lands of Ciulofind and Ranna in the diocese of Achonry—was dispensed by papal authority to receive and hold the said canonries and prebends, provostship and rectory) of the said provostship, which is a non-major dignity with cure, and of the said rectory, value not exceeding 12 and 10 marks sterling respectively, and dispensed him to hold them both for life, and by other letters made provision to him of a canonry of Elphin and another of Achonry with reservation of as many prebends. June (sic) anno 9 [1439] dispensed him, who had meanwhile resigned Walsokne, and was holding Stokenham, to hold therewith for life any other benefice with cure or otherwise incompatible, or if he resigned them, any other two benefices with cure or otherwise incompatible, even if two parish churches or perpetual vicarages, or dignities etc., and to resign them, simply or for exchange, as often as he pleased, and hold instead two other incompatible benefices, as is contained in the present pope's letters drawn up in the matter of the said dispensation of his predecessor, and in his said last named letters. Peter's recent petition containing that at the said date 13 Kal. [July] he was holding the said church of Stokenham and the archdeaconry of Exeter, a non-major dignity, in force of the first named dispensation, and that he mentioned them in the last named dispensation, but did not mention that he was holding them by dispensation, the pope, seeing that the second named dispensation was not necessary as far as regarded the holding of such two benefices together, but was only opportune as regarded the holding of a third incompatible benefice along with the other two, hereby decrees and declares, at Peter's said petition and that of king Henry on his behalf, that the letters of the said second dispensation have held good from their date as far as regards the holding of a third incompatible benefice along with the other two incompatible benefices comprised in the first named dispensation, and that he could and can by vigour thereof receive and retain it for life together with the said two incompatible benefices, and resign it, simply or for exchange; with special dispensation hereby to hold the said archdeaconry and two parish churches or perpetual vicarages for life, or, if he resign them, other three incompatible benefices. The present pope recently (upon John's setting forth that the parish church of Dwngarwan in the diocese of Lismore has, besides a perpetual vicar who exercises the cure of souls of the parishioners, also a rectory or plebania, that in it and in each of the other churches annexed to it the cure of souls had been exercised, and could be conveniently exercised, by perpetual vicars, without the help of the rector, that the cathedral church of Lismore had few canonries and prebends, that if the said rectory or plebania, which is of the patronage of laymen, had its cure and burdens suppressed and extinguished, and became a prebend in the said church of Lismore in perpetuity or for John's life, and its fruits etc. applied to the endowment of a new canonry and prebend, in perpetuity or for. John's life, divine worship etc. would be increased in the said church of Lismore) ordered the abbot of Moelanvhy in the said diocese, if he found the foregoing to be true, and if the consent of the greater and sounder part of the chapter of Lismore and the assent of the patron of the said rectory or plebania were given, to suppress and extinguish the said cure and burdens in perpetuity or for John's life, and transfer them into a perpetual vicarage or the said cathedral church, and thereupon to create and erect a new canonry and to appropriate, apply and assign to it, in perpetuity or for John's life, for its prebendal endowment or prebend, all the fruits etc. of the said rectory or plebania, reserving, however, therefrom a fit portion for the said perpetual vicar or for him who should exercise the said cure, and to collate and assign the canonry and prebend, thus created, to John, as is more fully contained in the pope's letters. Mandate, at the recent petition of Milerus de Exonis, clerk, of the diocese of Mayo alias Tuam (containing that, when below the lawful age for holding benefices with cure, and when he had not been tonsured, he obtained, under pretext of a collation and provision made to him by authority of the ordinary, the perpetual vicarages of Callakamog and Corran in the said diocese on their voidance by the death without the Roman court of William Iuban alias de Exonis, paying, in return for the making of such collation and provision, a sum of money to him who made them, thereby incurring the sentences etc. promulgated against simoniacs; and that, after detaining the said vicarage, value not exceeding 3 marks sterling, for about three years, he, receiving a sum of money, simoniacally gave them up for five years to a certain priest; and adding that after the lapse of the said five years he gave up the said vicarages altogether) to absolve him from the said sentences etc., enjoining penance, and to rehabilitate him. Martin V, on learning that the said vicarage, which [Charles] Oficillaid had held, had become and was void by the death without the Roman court of the said Charles, ordered the late Thady (Thaheo) Omeaig, clerk, as being a canon of Kildare (Daren.), to collate and assign it to the above Dermit. At Dermit's recent petition, containing that the said Thady duly made collation and provision to him, and that in virtue thereof he obtained and has held it for some time; and adding that some assert that the said Thady was not a canon of Kildare or of any other cathedral or metropolitan church, nor held a dignity or personatus, and that he therefore doubts whether the said collation and provision hold good, the pope hereby grants that they and their consequences shall hold good from the date of these presents as if the said Thady had been at the date of the said mandate etc. a canon of Kildare or otherwise a competent judge or executor. To Odo Ochennayn, Milerus Brun and Elias Omurchun, canons of Killala. Mandate, at the recent petition of Milerus de Exonis, clerk, of the diocese of Mayo alias Tuam (containing that the rural rectory (fn. 17) of Tyramalayd in the diocese of Killala, formerly wont to be held by one of the canons of the Augustinian monastery of St. Mary, Mulynger, in the diocese of Meath, is at present in the possession of a number of laymen, almost of hereditary right, and has been so long in their possession that there is no memory of the contrary and no hope of a canon of the said monastery, which is about 80 miles away, being able to recover it; and adding that the said Milerus, who is by both parents of noble race, hopes, if the said rectory were granted to him in commendam for life, by the power and with the aid of his kinsmen and friends to deliver it from the said hands and restore it to clerical rule) to summon the said laymen and others concerned, and grant the said rectory to Milerus in commendam, to be held by him for life, together with the rural rectory* of Magennulld(h) in the said diocese of Mayo alias Tuam, value not exceeding 7 marks sterling, of which, then about to become void, the pope recently granted him provision [above, p. 149] notwithstanding that the pope recently made him provision of a canonry with reservation of a prebend of Achonry, and of a benefice with or without cure, even if a canonry and prebend or dignity etc., in the gift of the bishop and the dean, archdeacon and chapter etc. of Killala, and dispensed him to hold a benefice, having cure or being a dignity, and the said rectory of Magennulld(h) for life, and to resign them, simply or for exchange, as often as he pleased, and hold instead two other incompatible benefices for life.
