May 16. Same to Lord Coningsby to report on the enclosed petition [missing] of Capt. John Brasselaye et al officers in Major General La Meloniere's Regiment praying their arrears in Ireland, they being under necessity of being in England on some extraordinary occasions. Ibid.
April [sic probably for May] 16. Treasury reference to the Agents for Taxes of the petition of Thomas Richards, late Receiver General of the Duties on Marriages and on Houses for Co. Herts. shewing that parts of the moneys of the said taxes were received by John Gape and Richard Woolaston; that several places are overcharged in the duplicates returned into the Exchequer and several collectors are in arrear; that he is willing to close his accounts and pay the balance into the Exchequer but cannot without Gape and Woolaston joining therein: therefore praying stay of process against him. Treasury reference to the Excise Commissioners of the petition of John Bushell, late a collector of Excise shewing that in 1689 he paid 311l. of his receipts to Toby Mayo a person of good repute and took from him three bills of exchange on William Lygon; that Mayo afterwards became insolvent and Lygon failed to pay the bills; that 100l. was since paid into the Excise Office on his account but the present Commissioners demand the said 311l., whereas he was stopped by the late Commissioners from proceeding against the said Mayo and Lygon and was allowed the said 311l. in his account: therefore praying a stay of all proceedings. Treasury warrant to the Excise Commissioners to make a deduction of 3d. per £ of the salaries of the collectors, supervisors and officers of the Salt Duties and thereout to raise a public Bank of Charity for support of disabled officers of the said Duties: all on the lines of the similar warrant of 1686–7 Feb. 1 which established such a procedure for the officers and clerks of the Grand Excise. Same to the Farmers of the Royal Oak Lottery concerning their cravings on account of the Act which takes away all lotteries except the Royal Oak Lottery. Report to the King from the Treasury Lords on the petition of the Old East India Company upon the order of reference of May 9 from the Privy Council, ut supra p. 349; the said petition referring to a seizure of some jewels brought from the East Indies in their ship Neptune as forfeited for the officers who seized and for the New East India Company.
We heard all the parties concerned on the 15th inst. The seizure was made under the Act of 9 Wm. III, c. 44 as goods belonging to private persons and not to the old Company. The seizure seems to us quite regular and the Customs officers do not appear to have intermeddled between the two Companies. On the petition of the Old Company for a restraint of the right of seizure the point of the legality thereof was discussed exhaustively before us on the 17th (the various arguments and precedents being here detailed.) We see no reason for imposing such a restraint in the Customs officers' power of seizure. Ibid, pp. 74–78.
Treasury reference to the Excise Commissioners of the petition of Richard Tooth a collector of Excise shewing that he sent up to the Excise Office a bill of exchange drawn by Toby Mayo on William Ligon for 226l. which was dishonoured: therefore praying that same may be allowed in his accounts. Same to the Victualling Commissioners of the petition of Phillip Papillon, late Cashier of the Victualling, praying directions to the said Commissioners to make him out warrants for 10469l. 12s. 5½d. being the balance of his account for victualling the Straits Fleet under the Earl of Orford's command at Cadiz so that same may be allowed him on his account; as the said Earl's privy seal discharges only 80,007l. 3s. 10d. May 24. Same to Henry Baker of the petition of John Hill, a prisoner in Chelmsford gaol, shewing that he was fined 40s. for assault and battery; that his wife and four small children are in a miserable and starving condition by his lying eight months in the said gaol: therefore praying remission of his fine that so he may have his enlargement. Same to the Postmasters General of the petition of Francis Jackson, postmaster of Chester shewing that he has served faithfully since the Revolution and been at great charges: therefore praying to be remitted 100l. which he is indebted to the King, and to be allowed 121l. 6s. 2d. which he is in disburse. Same to the Customs Commissioners of the petition of Peter Vertange and Company merchants shewing that they bought a parcel of China roots which being decayed, half Custom was allowed for damage on importation; and same was afterwards shipped out in the ship Lady Cornelia for Holland but was seized because the certificate by mistake did not contain the words "damaged halfpart" therefore praying restoration of the goods. Same to the Surveyor General of Crown Lands of the petition of Simon Biddulph shewing that by the dissolution of the monastery of the Virgin Mary in the city of Coventry the Crown was seized in fee of a certain portion of the tithes in the manor and parish of Frankton Co. Warwick and that Queen Elizabeth demised same 1599–1600 Feb. 13 to Thomas Spenser, Roger Tibbotts and Dorothy Tibbotts who are all dead; and that same is now concealed from the Crown: therefore praying a lease of same and he will assert the Crown's title. Treasury warrant to Isaac Newton to pay (out of moneys in his hands for the service of the Mint) to Thomas Clarke, collector of Yarmouth port, so much as was produced from the 1724 ounces 10 pennyweight of silver (hammered money) which he paid into the Mint at Norwich on the 23rd June 1697 (which he had received for Customs in the said port) at the rate of 5s. 8d. per ounce in pursuance of the Act for remedying the ill State of the Coin; as certified by the receipt of Anthony Redhead then Deputy Master and Worker of the said Mint: which money is not yet repaid to the said Clarke though he hath often demanded the same. Same to the Postmasters General to establish vessels of about 90 or 100 tons with 10 or 12 men each to go from Falmouth to the Groyne; to be paid as formerly out of the Post Office revenue: all in order to the safe and regular conveyance of his Majesty's letters between England and Spain by vessels of sufficient force to make defence against the ordinary privateers, which conveyance would be a great convenience to the merchants and the King by avoiding the necessity of carrying the state letters through France "though you have reduced the number of men to less than half to what they were." Same to the Clerk of the Signet for a privy seal for a grant to John Worth, Thomas Herle and Robert Corker, merchants, of the arrears of profits of the office of Havenor of the Duchy of Cornwall between the determination of the former lease thereof to Sir William Morrice and the 18 August 1698 being the date of the 99 years' lease thereof to the said Worth, Herle and Corker made to them for a fine of 1500l. and rent of 30l. per an. as from the determination of a former lease which expired in May 1696, the word 'arrears' having been accidentally omitted from their said lease: the said former lease to the said Morrice being certified to have expired by the death in the East Indies in May 1696 of William Morrice son of John Morrice of London merchant. Royal warrant to the Lord Justices of Ireland to pay to the Countess of Dorchester all moneys received since 1696–7 Jan. 5 (the date of the royal warrant supra Cal. Tr. Books vol. XI, p. 369) by any of the revenue collectors in Ireland out of the quit rents granted to the said Countess by James II and further to similarly pay all such moneys as shall be similarly received by them for the next three years from date hereof: all by reason that the said royal warrant of 1696–7 Jan. 5 did not contain sufficient directions for the payment as above of such moneys as should be received by the said collectors. Charles Ross shewing that his Regiment was subsisted to April 1691 according to the English Establishment but upon stating the accounts of the Regiment they are only allowed credit upon the said Establishment till Jan. 1691–2 though the Regiment was not on the Irish Establishment till four months later: therefore praying allowance of the difference which amounts to 890l. 17s. 4d.: further praying that the 500l. which he received in 1692 on account of arrears of "the said year" and which is now charged upon the account of clearings for the year 1692 may be transferred to the account of arrears in the years 1690 and 1691 "there not being 100l. due for clearings at that time." Col. of Foot as ordered for him by the King by royal warrant of 1699 April 8 upon the occasion of the sending of Major General Thomas Erle's Regiment into Ireland, into which Regiment the said Col.
