Towne versus Thompson:
After hearing Counsel this Day, at the Bar, upon the Petition and Appeal of John Towne Gentleman, from Two several Orders or Decrees of the High Court of Chancery, of the Four and Twentieth Day of December One Thousand Six Hundred Ninety-three, and the Ninth Day of July One Thousand Six Hundred Ninety-four, in a certain Cause there then depending, wherein the Petitioner was Defendant, at the Suit of Anthony Thompson Complainant; as also upon the Answer of the said Anthony Thompson put in thereunto:
Judgement affirmed.
After due Consideration had of what was offered by Counsel thereupon, it is ORDERED and Adjudged, by the Lords Spiritual and Temporal in Parliament assembled, That the said Petition and Appeal of John Towne shall be, and is hereby, dismissed this House; and that the Orders and Decrees of the Court of Chancery, therein complained of, shall be, and they are hereby, affirmed.
Message from H. C. to return Pitt's Bill.
A Message was brought from the House of Commons, by Sir Thomas Mompesson and others:
To acquaint this House, that they have agreed to the Bill, intituled, "An Act for supplying certain Defects in the Directions made in and by a Deed of Trust, and the last Will of George Pitt Esquire deceased, for settling his Estate," without any Amendment.
Russell to be attached, for an Ejectment on the E. of Radnor's Estate.
Upon Oath made, at the Bar, "That Dennis Russell, Attorney at Law, did, in the Time of Privilege of Parliament, direct the filing of Declarations in Ejectment, delivered on the Estate of the Earl of Radnor, a Peer of this Realm, contrary to the Privilege of Parliament:"
It is ORDERED, by the Lords Spiritual and Temporal in Parliament assembled, That the Serjeant at Arms attending this House, his Deputy or Deputies, shall forthwith attach the Body of the said Dennis Russell, and bring him in safe Custody to the Bar of this House, to answer for his Offence; and this shall be a sufficient Warrant on that Behalf.
To Roger Charnock Esquire, Serjeant at Arms attending this House, his Deputy and Deputies, and every of them, and to all Mayors, Sheriffs, Bailiffs, Constables, and other His Majesty's Officers, to be aiding and assisting in the Execution hereof.
Counterfeiting and clipping the Coin, to prevent, Bill.
The House was adjourned during Pleasure, and put into a Committee upon the Bill, intituled, "An Act to prevent the counterfeiting and clipping the Coin of this Kingdom."
After some Time spent therein, the House was resumed.
And the Earl of Bridgewater reported, "That the Committee had made some Progress in the Bill; and desire another Day may be appointed, to proceed."
ORDERED, That this House shall be put into a Committee on Thursday next, at Ten of the Clock in the Forenoon, to proceed on the said Bill; and that some of the Judges do then attend.
Adjourn.
