Sutton versus Slaughter.
Upon hearing Counsel this Day, at the Bar, upon the Petition of William Sutton Gentleman, being an Appeal from a Decree or Order made the Two and Twentieth Day of July, in the Second Year of Their now Majesties Reign, by the Lords Commissioners of the Great Seal of England, upon a Report made by Sir Robert Legard, on the Behalf of Paris Slaughter and Edward Highmore; as also upon the Answer of Paris Slaughter and Edward Highmore put in to the said Petition:
After due Consideration had of what was offered, by Counsel on either Side, upon the said Petition and Answer, it is ORDERED and Adjudged, by the Lords Spiritual and Temporal in Parliament assembled, That the said Petition of William Sutton shall be, and is hereby, dismissed this House; and that the Decree from which he appealed, made on the Behalf of Paris Slaughter and Edward Highmore, shall be, and is hereby, affirmed.
E. Rochester versus L. Grey.
The Lord Cornwallis reported from the Lords Committees for Privileges, "That they have met upon the Matter referred to them, upon the Petition of the Earl of Rochester and the Answer of the Lord Grey of Werke; that the Committee desires to know what Time the House will appoint for the Report to be made."
It is ORDERED, by the Lords Spiritual and Temporal in Parliament assembled, That the Report of this Business shall be made To-morrow, at Twelve of the Clock.
Against adhering to Their Majesties Enemies, Bill.
Hodie 3a vice lecta est Billa, intituled, "An Act against corresponding with Their Majesties Enemies."
The Question was put, "Whether this Bill shall pass?"
It was Resolved in the Affirmative.
Message to H. C. with it.
A Message was sent to the House of Commons, by Mr. Justice Nevill and Mr. Baron Powell:
To carry down the said Bill, and desire their Concurrence thereunto.
Duke of Norf. versus the Dutch. of Norf.
It is ORDERED, That Sam'll Keck Esquire, George Whetcroft, Susan his Wife, Mary Sheriffe, and Todd, do, and are hereby, required to attend this House, this Day at Eleven of the Clock, to be sworn, as Witnesses on the Part and Behalf of her Grace the Dutches of Norfolke.
Before the calling in this Day the Counsel for her Grace the Dutchess of Norfolke, and also for his Grace the Duke of Norfolke; it was agreed, that the Duke's Counsel may proceed to support his Evidence after the Dutchess hath proceeded in hers; and the Counsel, being called in, were told so by the Speaker.
The Dutchess's Counsel calling in their Witnesses, they gave in their Evidence as in the usual Method.
Then the Counsel for the Duke of Norfolke said, "They had Witnesses to support their former Evidence."
Who, being called in, gave their Evidence as before.
Then the Duke's Counsel declared, "They had done with their Evidence in this Cause."
Then the Dutchess's Counsel said, "This is new Evidence, as to other Times and Places than were mentioned in the former Evidence, on Behalf of the Duke; and prayed, that they might have convenient Time to answer the Evidence."
Then they withdrew, and the following Order was made:
"After having this Day heard several Witnesses on Behalf of her Grace the Dutchess of Norfolke, as also for his Grace the Duke of Norfolke: It is ORDERED, by the Lords Spiritual and Temporal in Parliament assembled, That the Dutchess of Norfolke's Counsel shall proceed in her Grace's Defence on Saturday next, at Twelve of the Clock."
Adjourn.
