Morton v. Hunters & Co:

After hearing Counsel for the Appellant, this Day, upon the Petition and Appeal of James Morton, Writer in Ayr, Trustee on the Sequestrated Estate of William Brown of Lawhill, Merchant in Saltcoats; complaining of an Interlocutor of the Lords of Session in Scotland, of the First Division, of the 10th of December 1828; and praying, "That the same might be reversed, varied or altered, or that the Appellant might have such Relief in the Premises, as to this House, in their Lordships great Wisdom, should seem meet;" as also upon the Answer of Captain Patrick Hunter, William Cowan and Quintin Kennedy Esquires, Individual Partners of the Company of Messieurs Hunters and Company, Bankers in Ayr, put in to the said Appeal; and Counsel appearing for the Respondents in the said Appeal; the Counsel were directed to withdraw:

The Lord Auckland reported from the Lords Committees appointed to consider of the Causes in which Prints of the Appellants and Respondents Cases, now depending in this House in Matters of Appeals and Writs of Error, have not been delivered, pursuant to the Standing Orders of this House; and to report to the House; and to whom were referred certain Petitions in the following Causes; Sir Evan John Murray M'Gregor Baronet against The East India Company and others; Scott against Yuille and others; Wilson and others against Sinclair; Mac Neill against Mac Neill and another; M'Tavish against Scott and another; Baillie against Grant; Robertsons against Alexander and others; Robertsons against Alexander and another; Meggett and another against Douglass, and Blake against Gossen otherwise Blake; "That the Committee had met, and considered the Respondents Petitions in the Causes Sir Evan John Murray M'Gregor Baronet against The East India Company and others, Scott against Yuille and others, Wilson and others against Sinclair, Mac Neill against Mac Neill and another, and M'Tavish against Scott and another, severally praying their Lordships for Leave now to lodge their printed Cases; and had heard the Agents thereon, and the Committee are of Opinion, That the Petitioners may respectively be allowed now to deliver in their printed Cases: That the Committee had also considered the Appellant's Petition in the Cause Baillie against Grant, praying their Lordships to appoint an early Day for the Hearing of the Appeal; and had heard the Agents thereon, and the Committee are of Opinion, That the said Cause should be appointed to be heard on the first Cause Day after the Christmas Recess: That the Committee had also considered the Respondents Petition in the Cause Robertsons against Alexander and others, praying their Lordships to appoint an early Day for Hearing this Cause; and had heard the Agents thereon, and the Committee are of Opinion, That the said Cause should be appointed to be heard on the first Cause Day after the Christmas Recess, immediately after the said Cause of Baillie against Grant: That the Committee had also considered the Respondents Petition in the Cause Robertsons against Alexander and another, praying their Lordships to appoint this Cause to be heard with or immediately after the said Appeal of Robertsons against Alexander and others; and had heard the Agents thereon, and the Committee are of Opinion, That this Cause should be appointed to be heard with or immediately after the said Cause Robertsons against Alexander and others, as desired: That the Committee had also considered the Appellants Petition in the Cause Meggett and another against Douglass, praying their Lordships to allow the Petitioners to amend their Petition of Appeal, by inserting therein, among the Orders appealed from, Two Orders of the Jury Court in Scotland, respectively bearing Date the 26th Day of January 1830 and 25th Day of February 1830; and had heard the Agents thereon, and the Committee are of Opinion, That the Petitioners may be allowed to amend their said Appeal by inserting therein the said Two Orders of the Jury Court, as desired: And that the Committee had also considered the Appellant's Petition in the Cause Blake against Gossen otherwise Blake, praying their Lordships that he may have Leave to withdraw his Appeal, and all Proceedings thereon, without Payment of Costs; and had heard the Appellant's Agent thereon, and it appearing that the said Respondent is dead, the Committee are of Opinion, That the said Appellant may withdraw his Appeal, without Payment of Costs, as desired."

Which Report, being read by the Clerk, was agreed to by the House; and Ordered accordingly.
