Duff v. Fraser, Respondent's Petition that Appellant be ordered to withdraw his Appendix, referred to Appeal Com ee.

Upon reading the Petition of Thomas Alexander Fraser Esquire, Respondent in a Cause depending in this House, to which Hugh Robert Duff Esquire is Appellant; setting forth, "That since the Appellant lodged the Print of his Case he has prepared and lodged in the Parliament Office a relative Paper by way of an Appendix: That such Paper contains Matter which was never laid before the Court of Session, particularly an ex-parte Certificate favorable to the Appellant, obtained by himself after the Cause was carried to this House by Appeal from William Cumming, Civil Engineer in Inverness: That such Appendix appears to the Respondent to be altogether incompetent;" and therefore praying, "That their Lordships will order it to be withdrawn:"
