Constable's Petition to revive a Bill, referred to Judges.
Upon reading the Petition of John Constable, of Ockley, in the County of Surrey, Gentleman, and Sarah his Wife, and James Ede the surviving Trustee in the Marriage Settlement of the said John Constable; praying, "That the Bill brought into this House the last Session of Parliament, for Sale of several Lands and Hereditaments of the said John Constable, in Ockley, in the County of Surrey, for Payment of his Debts; and for settling other Lands, in the same County, of a better Value, to the same Uses, in Lieu thereof; and which was then Twice read, may be proceeded on:"
It is Ordered, by the Lords Spiritual and Temporal in Parliament assembled, That the Consideration of the said Petition shall be, and is hereby, referred to the Lord Chief Justice of the Court of Queen's Bench and Mr. Justice Tracy; who are forthwith to summon all Parties concerned in the Bill; and, after hearing them, to report to the House the State of the Case, with their Opinion thereupon, under their Hands, and whether all Parties that may be concerned in the Consequences of the Bill have signed the Petition; and also that the Judges, having perused the Bill, do sign the same.
Parry to change his Name to Symes, Bill.
Upon reading the Petition of Symes Parry, of Antegoa, an Infant of about Eight Years of Age, by Nathaniel Carpenter, of London, Merchant, his next Friend; praying, "That Leave may be given to bring in a Bill, to change his Surname from that of Parry to Symes:"
It is Ordered, by the Lords Spiritual and Temporal in Parliament assembled, That the Petitioner hath hereby Leave to bring in a Bill, according to the Prayer of the Petition.
Grey to enter into Recognizance for the Magistrates of Elgin.
Upon reading the Petition of James Gray Clerk; praying, "That he may be allowed to enter into a Recognizance for the Magistrates of Elgin, who have an Appeal depending in this House, they residing in Scotland:"
It is Ordered, by the Lords Spiritual and Temporal in Parliament assembled, That the Petitioner may enter into a Recognizance for the said Appellants, as desired.
Standing Order concerning Bills for Exchange of Lands considered.
The House (according to Order) proceeded to take into Consideration the Standing Order of this House, of the Sixteenth of February One Thousand Seven Hundred and Five, in relation to Private Bills empowering Persons to buy Lands in one Place, and to sell Lands in another.
And the same being read; it was agreed, to be strictly observed for the future.
Lee's Petition referred to Judges.
Upon reading the Petition of Henry Lee Junior, alias Lee Warner, Esquire, Henry Lee Senior, Esquire, for and on the Behalf of himself and of Samuel Lee an Infant his Son, Sir Nicholas L'Estrange Baronet, and James Calthrop Esquire; praying Leave to bring in a Bill, to enable the Petitioner to make a Jointure, not exceeding One Thousand Pounds per Annum, upon any Woman he shall marry; and for other Purposes in the Petition mentioned:
It is Ordered, by the Lords Spiritual and Temporal in Parliament assembled, That the Consideration of the said Petition shall be, and is hereby, referred to Mr. Justice Blencoe and Mr. Justice Tracy; who are forthwith to summon all Parties concerned in the Bill; and, after hearing them, to report to the House the State of the Case, with their Opinion thereupon, under their Hands, and whether all Parties that may be concerned in the Consequences of the Bill have signed the Petition: and also that the Judges, having perused the Bill, do sign the same.
