Palmes versus Barstow.

Upon reading the Petition and Appeal of William Palmes Esquire, from a Decree made in the Court of Chancery, the Seven and Twentieth Day of November One Thousand Seven Hundred and Four, on the Behalf of Thomas Barstow; and praying the Reversal of the said Decree:

It is Ordered, by the Lords Spiritual and Temporal in Parliament assembled, That the said Thomas Barstow may have a Copy of the said Appeal; and shall and he is hereby required to put in his Answer thereunto, in Writing, on Monday the Third Day of December next, at Eleven a Clock in the Forenoon.

Lambe versus Jackson, in Error:

Upon reading the humble Petition of James Jackson; shewing, "That the Petitioner, in Easter Term last, recovered a Judgement in Chancery against William Lambe Esquire, for the Payment of Six Hundred Pounds Debt, besides Costs of Suit; who, to delay the Petitioner, hath since obtained a Writ of Error, returnable in Parliament; which was brought into this House on Wednesday the One and Thirtieth Day of October last;" and praying, "That (pursuant to the Standing Orders of this House) the said Writ of Error be discontinued, and Judgement affirmed for the Petitioner, and the Record be remitted:"

Writ discontinued.

It is Ordered and Adjudged, by the Lords Spiritual and Temporal in Parliament assembled, That the said William Lambe shall lose his Writ of Error, and the same is hereby discontinued; and that the Record shall be remitted to the Court of Chancery, to the End Execution may be had thereupon as if no such Writ of Error had been brought into this House.

The Tenor of which Judgement, to be affixed to the Record to be remitted, follows; (videlicet,)

"Et postea, scilicet, Duodecimo Die Novembris, Anno Regni dictæ Dominæ Reginæ nunc Angl. &c. Quarto, usque quem Diem prædict. Union between England and Scotland, Address for Proceedings about it since last Session.

The House taking Notice of that Part of Her Majesty's Speech relating to an Union between the Two Kingdoms of England and Scotland:

It is Ordered, by the Lords Spiritual and Temporal in Parliament assembled, That an humble Address be presented to Her Majesty, "That Her Majesty will be graciously pleased to lay before this House, what hath passed since the last Session of Parliament in England, in relation to the Succession of the Crown of Scotland, and to the intended Treaty of Union in the Parliament of that Kingdom."
