Report from same to the King on the petition of Thomas
Sands (Sandys), of London, merchant, as by the
order of reference of Nov, 23 last : said petition
praying leave to ship out of Virginia, free of the
impost of that country, 580 hogsheads of tobacco
for England in lieu of the like quantity which after
payment of the duties he exported from Virginia in
1665 on the William and Sarah, John Ruds
commander, for London, which ship was taken by
the Dutch and utterly lost to petitioner. I find the
facts as alleged, and that he paid 58l. for the 2s. per
hogshead duty on said tobacco, which was taken
and utterly lost. In England it is law and practice
to permit goods to be shipped out Customs free in
lieu of other goods exported hence and taken or
lost after duty paid. But by perusal of the printed
laws of Virginia it does not appear that there is
any law there for making such an allowance in
that country. Nevertheless it is attested by an
affidavit of John Thornebush, merchant, that when
the said duty of 2s. per hogshead was first laid in
Virginia it was customary for the collector to take
bills of exchange for the same, payable at certain
days after the arrival of the ship in England, so that
if she were taken or lost the bills never became due
and in this case there seems to [have] be[en] no occasion
of a law for re-shipping. But now those bills
are drawn at a certain number of days after sight.
And it appears by several other affidavits that the
present practice is (and for several late years has been)
to make an allowance for goods so lost. Petitioner
was not so allowed because, as is alleged, his ship
was the first that was lost after the abovesaid laws
were made, and being the first instance he had not
any allowance. Further it is certified by Col.
Francis Morrison that this matter was debated
by several members of the Council of Virginia in
March, 1676-7, and the major part thought it
reasonable that he should have reparation. I concur
herein.

privy seal of 1676, Nov. 30, the King's share of
Conventicle fines levied since 1670-1, March 15,
and remaining in the hands of any sheriff, etc.,
or to be thereafter levied and received, are to be
disposed of by warrant under the royal sign manual.
By a sign manual of the 10th inst. the King has
directed such King's share accruing from 1670-1,
March 15, until the 10th inst. with[in] Suffolk, Norfolk
and Norwich, to be paid and disposed to William
Battie, clerk, in reward of his activity in informations
and prosecutions upon the Conventicle Act. You
are hereby to obey same and to see such receipts
so paid to Battie without account, taking his special
receipt for the same.

Customs Cashier is to pay your Secretary's bill
of disbursements of 39l. 15s. 0d. for clerkship in
his office. (5) I approve your sending a correspondent
into Scotland to give you an account of ships
coming directly from his Majesty's Plantations
in America to Scotland and discharging their
ladings there without first unlading in England,
Wales or Berwick. You are to pay him 30l. for
one year hereon as you have agreed. (6) I approve
your dismissal of Rawleigh Radford, Francis Leuing
and John Garway, landwaiters at Bristol, upon the
proof against them, and in regard there are many
supernumarary landwaiters in London port (the
prohibition of French trade making the service
of the port much less) three of them are to be sent
to Bristol in place of those dismissed. The King
will hereby be saved 135l. per an. You are to
examine Richard Ham, John Harper and James
Seaward, three of the patent waiters Bristol port, they
being likewise suspected to be criminal in their duties.

I have been informed of the care you have taken
in his Majesty's affairs by the orders you have
lately sent to the several wards for the more exact
putting the Poll Act in execution. Nevertheless
I am told that the assessors are very remiss
in several places in performing their duty therein
so that all the reliance must be upon your care in
rectifying as Commissioners, upon your own
knowledge or information, what the assessors do
amiss. I cannot doubt of the continuance of your
care herein.

Warrant from Treasurer Danby to the King's Remembrancer
to supersede process of extent against Arthur
Spry who by obligation dated 1666, June 1 (in
which he stands bound with John Rowe of London,
merchant) is indebted 184l. (conditioned to pay
92l.) to Nicholas Warren, late of London, merchant ;
the said Warren being indebted to the King by
several obligations on which extent has issued
against said Warren, and thereupon the said Spry's
obligation has been found by inquisition, and has
been seized into the King's hands in satisfaction
of so much of said Warren's debt, and after due
course of law extent has issued thereon against
Spry. The present supersedeas is in pursuance of
his Majesty's direction to Treasurer Danby.

Same from same to the Clerk of the Pipe for a lease
to William Scawen, Esq., for 31 years from 1676,
Michaelmas, of the office of bailiff and collector
of all fines, amerciaments, etc., within the Duchy
of Cornwall as granted by patent 1665, July 7,
to John Ward, gent., during pleasure and upon
payment of a quarter part of the said receipt : the
present lease to be in consideration of a fine of
100l. to be paid, and to be upon surrender by said
John Ward of his said grant.
Prefixing : (a) particular of the premises made
out (by virtue of Treasurer Danby's warrant dated
1676, June 23) by James Symes, Deputy Auditor
of the Duchy of Cornwall ; and (b) ratal thereof
by the Surveyor General of Crown Lands. The
grant to contain a reservation of the one moiety
of the rents amuonting to 10l. 10s. 0d. per an.
and one full moiety of the reliefs, heriots, fines,
deodands, felons' goods and other casual profits
arising from the said rents and the services thereto
belonging : the said rents and services to be
answered upon account to be made upon oath before
the Auditor of the Duchy of Cornwall at Michaelmas
yearly. Proviso that if the said rent of 10l. 10 s. 0d.
be unpaid for 40 days or if said reliefs, etc., as above
be not so accompted for in Michaelmas term yearly
and the one moiety thereof duly answered to the
Receiver General of the said Duchy within 40 days
next after such account shall be made, then this
grant to be void. All the arrears of the said rents
and other profits of the premises incurred since
1660, June 24, and not levied, are to be included
and granted in this lease. "I have considered the
Auditor's memorandum upon this particular, and
though I do commend him for his care therein,
yet no person appearing to make any such offer
as he mentions or any better offer than the provision
hereby made for his Majesty's service, and upon
consideration of the affidavit of John Ward, gent.,
touching his receipts and charges occasioned by the
grant of the premises now in being whereby it appears
he hath not made 100l. of all the said rent and
profits since the date of the said grant, I think
it rather advisable to grant this lease now intended
than to rest upon the grant in being."

Reference from same to the Customs Commissioners
of the petition of Peter Renew, of London, merchant,
shewing that the Merchant Adventurer, of London,
was cast away in March near Poole, where
360 hogsheads of wine, 51 tearce of honey and
about 58 pieces of brandy were saved, and praying
leave to enter the brandy on paying duty which
will amount to 300l., and to be excused from entering
the rest of the cargo, the goods being imported
from Bordeaux before the Act of Prohibition [of
French goods].

desires that Sir Thomas Clutterbuck's five bills
for in all 11,400l. 0s. 8d. which are assigned for
payment out of the moneys in your hands for the
use and service of a war against the French King

received on the Poll Bill ; or in case there remains
not enough in your hands to pay all the said bills
that then you please to pay the remainder out of the
next moneys that shall come to your hands on the

the Electoral Prince Palatine, which [goods] are lately

Appending : schedule of said goods : an ordinary
coach which he hath used at Nimuegen with two
coach horses, trunks of clothes, etc., for himself

Mayor of London, to be by him communicated
to the Court of Aldermen. By his Majesty's
command I formerly acquainted you that it was
his wish the city of London would advance 50,000l.
more upon the credit of the Poll Bill, which I understand
you have communicated to the Common
Council, and that thereupon they readily passed a
vote to use their utmost endeavour to comply
with his Majesty therein. But finding there is
no fruit of that vote, and considering how speedily
the first 100,000l. was advanced upon the same
security (which I assure you his Majesty received
with great kindness) and being informed of the
proper course your lordship and the Court of
Aldermen did take for the speedy raising of that
100,000l. by the good example of your own subscriptions,
I think fit to recommend the same
course to you now, and doubt not but you will
continue to have the same zeal for his Majesty's
service herein, being well assured the security
cannot be mistrusted by any. His Majesty's
present occasions require a speedy compliance
and I assure you his Majesty will esteem your
care in this matter at a more than ordinary rate
and you may be confident that whenever the city shall
have occasion to desire his Majesty's favour, this
your ready compliance will be remembered to your
advantage. And his Majesty hath commanded me
that what concerns my office in order to the just
and punctual repayment, I should take especial
care of ; which commands I shall punctually observe.

Royal warrant to the Clerk of the Signet for a privy
seal for payment of the three sums of money as
follow to Sir Robert Vyner. Sir George Carteret
when Treasurer of the Navy did, by himself or by
John Fenn his agent, assign to Benjamin Barron
a creditor of the Navy 1,202l. 17s. 0d. to be paid
by Sir Thomas Player, Kt., then Chamberlain
of the city of London and since deceased, out of
money arising by the Royal Aid within said city
and adjacent counties. Said Barron assigned
said sum to Sir Robert Vyner, Kt. and Bart.,
but by reason of the late dreadful fire in London
many of the said assignments [the assignments on
said fund of the Royal Aid in Player's hands] could
not be paid out of the said Royal aid [by reason of the
deficit in the receipts therefrom as a consequence
of the said fire] ; which [unpaid assignments] were
certified to the late Treasury Lords by Sir Thomas
Player, Kt., present Chamberlain of London, who
had thereupon Exchequer orders drawn in his name
and charged on the late Act for an imposition on
wines and vinegar, such orders to be applied to the
payment of such unpaid assignments. By another
certificate of said present Sir Thomas Player it
appears that said 1,202l. 17s. 0d. was omitted in the
[abovesaid] former certificate in regard the note
for the same was not brought to him till after
his delivery of said certificate. Further by the patent
of 1674, July 23, the payment of two years' interest
is directed to the goldsmiths : to be paid by eight
quarterly payments. But said Vyner did not receive
his share of the said interest till long after several
of those quarter days, to his detriment in that
behalf. It appears by an account made up by
Auditor Aldworth to 1676-7, Jan. 1, and allowed
Dec. 17 last by Treasurer Danby that there is due
to said Vyner 439l. 11s. 0d. for 6 per cent. interest
and 4 per cent. reward for said sum of 1,202l. 17s. 0d.
from 1671, Oct. 28 (to which day the interest and
reward for same have been allowed him in a former
account) to Jan. 1 following and thereafter for
6 per cent. interest only to 1674, July 1, making
the same to be principal every six months, and from
thence till 1676-7, Jan. 1, at 6 per cent. interest
making the same to be principal money every twelve
months ; and that further there is due to him
1,565l. 18s. 6d. for the interest of his two years'
interest moneys before mentioned computed at
6 per cent, per an. from the several quarterly days
upon which the same should have been paid to the
several days when the same were paid. The said
three sums of 1,202l. 17s. 0d., 439l. 11s. 0d. and
1,565l. 18s. 6d. are hereby ordered to be paid to said

Report to the King from Treasurer Danby on the
report dated the 17th inst. from the Duke of
Ormonde, Lord Lieutenant of Ireland, upon the
petition of Richard, Earl of Cork and Burlington.
Said petition prays a confirmation and grant to
himself of certain lands in Ireland which he has
purchased for valuable considerations, said lands
being quoted as follows in a letter [said letter being
the draft royal warrant for a privy seal for such
grant] : ("memorandum this letter seems to be
that which his Excellency returned, and not that
[of the petitioner himself] sent over with the
petition") : viz., the lands of Kilteroe containing
380 acres plantation measure ; 77 acres of like
measure in Ballycurra alias Ballycurragh ; Currynemought
containing 84 acres of like measure ; and
Cassana containing 65½ acres of like measure : to
be held as of the Castle of Dublin in free and common
socage under the quit rents due by the Acts of
Settlement and Explanation out of lands situate
in Munster and no more. Said petition being
referred to the Lord Lieutenant March 15 last
the Duke of Ormonde thereon reported the 17th inst.
that such grant will not be prejudicial to the King
and therefore transmitted a royal letter as drafted
by Sir John Temple, Solicitor General for Ireland
for a patent [the abovesaid description of the
lands being taken from said draft]. Said report
being referred to Treasurer Danby the 26th inst.,
the latter hereby reports agreeing fully with same.

Privy seal for Treasurer Danby to give warrant to the
Woodward of Whittlewood and Salcey forests for the
felling of a further quantity of 300 tons of timber,
to be taken out of the said forests by the hands of the
King's woodward there, which timber the King
hereby (on the petition of the mayor, aldermen
and poor distressed inhabitants of Northampton
town) grants to Sir Edm. Bray, Kt., William Tate
and John Willoughby, Esqrs. ; same to be by them
applied to the building of public places in the said
town or other public uses there (towards the building
of churches and other public buildings there) by the
direction of James, Earl of Northampton : said
timber to be taken in such convenient places in said
forests where same may best be spared with regard to
the vert and venison and the coppices now growing.
To the end that the coppices now in jointure to the
Queen Consort within said forests may receive as
little prejudice as may be by such felling John Hall
the Woodward to the Queen Consort is to have notice
to be present, if he please, at the setting out and
