Royal warrant to the Attorney or Solicitor General for a privy seal for a grant to John Somers, gent., his executors and assigns of the benefit of a recognisance of 500l. entered into by Nicholas Hunt (Christopher Wheeler and John Palfree) for said Hunt to keep the peace and be of good behaviour, which is forfeited (as we are informed) by reason that said Hunt hath occasioned the barns full of corn, stables and out houses of said Somers to be burnt to his great damage : with a non obstante to all other grants [thereof]. Warrant from Treasurer Danby to the Customs Commissioners. You formerly represented to me that with a view especially for preventing the importation of European goods into the Colonies of New England contrary to law and for taking care that such ships as there lade the enumerated commodities brought from other of his Majesty's Plantations (which are in great quantities carried from thence to other parts of Europe, and not brought to England) do there give bond for that purpose [i.e., to bring them to England] it is necessary that an officer be settled at Boston, the principal seat of trade in those parts, with power to him to appoint such deputies as he shall see necessary in other places. And you have proposed a salary of 100l. per an. for such an officer, besides 30l. to transport him thither. You are hereby to depute Daniel Whitfield to be Collector, Surveyor and Searcher in the said Colonies of New England, his fitness being certified by the officers whom you appointed to examine the same. He is to have power to make deputies as above, and to have the abovesaid salary and transport and such instructions as you shall think necessary. Out Letters (Customs, IV. p. 55.
Warrant from Treasurer Danby to the Customs Commissioners to discharge a seizure of 155 small pictures and 2 ebony bedsteads imported in the Surat Merchant from India and now in the Customs Warehouse, London port : Francis Johnson, captain of said ship, having applied to Treasurer Danby for delivery thereof, alleging that the pictures are valued but at 7l. and the officer who made the seizure having certified under his hand that he is resolved not to prosecute the same. Same from same to the Clerk of the Pipe to prepare a grant under the Exchequer seal for a grant to William Scroggs, Esq., of the office of bailiff of the hundreds of Hinckford and Barstable, co. Essex, with all fees and profits thereof ; to hold for 41 years if he shall so long live, at the yearly rent of 6s. 8d., payable at the Exchequer or to the sheriff of Essex.
Prefixing : (a) Particular made April 20 last by the Clerk of the Pipe of said office of Bailiff as demised by patent of 1625, May 23, to Richard Pulley, junr., "which the Clerk of the Pipe by way of memorandum certifies to be granted amongst other things by patent dated 1629, Oct. 2, to Gilbert North, Esq., his heirs and assigns for ever under the same rent : but the said rent was constantly paid to [sic for by] Richard Pulley, who died about half a year since."
(b) The Surveyor General's ratal dated April 25 last of said particular, said ratal being made under Treasurer Danby's warrant of March 1 last. The lessee to covenant within three years next ensuing to make out and deliver to the Clerk of the Pipe a schedule of the names of the towns, hamlets and villages within the said several Hundreds owing suit or service thereunto and the rents or certainties payable out of the same to the said Hundreds severally and distinctly and to do his best endeavour at his own proper costs and charges to keep and retain all the said suits and services and the said rents or certainties thereunto incident or belonging by course of justice, that the same may not be lost or withholden from the Crown. "It appears that the office of bailiff and the profits of the said Hundreds were granted in fee to Gilbert North, Esq., his heirs and assigns in 5 Car. I. under which grant the same are now claimed by Jasper Kingsman, gent., the validity of which grant is left to the judgment of law."

Report from Treasurer Danby to the King on the report dated March 23 last from the Duke of Ormonde, Lord Lieutenant of Ireland, on the petition of Capt. Richard Coote, son of Charles, Earl of Mountrath, praying a pension in reversion when there shall be a vacancy upon the establishment. Said petition being referred to the Duke of Ormonde, Feb. 25 last, said Duke reports that he believes the allegations thereof to be true, and that a pension in reversion of any pensions or temporary payments now in being may be granted said Coote in view of the eminent services of petitioner's father and grandfather. Said report being April 9 last referred to Treasurer Danby, the latter hereby reports fully agreeing with the same. Warrants not Relating to Money VII. p. 194.
Same from same on the report dated 1677, June 21, made by Sir John Temple, Solicitor General in Ireland, to the Lord Lieutenant (in obedience to the Earl of Essex, Lord Lieutenant's order of reference of 1677, May 14) on the petition of Edmond Malone. In said report Sir John Temple states that he finds that most of the lands in the schedule annexed to the petition were by patents of 1619, Dec. 9, granted to Edmond Malone, petitioner's grandfather, and his heirs without reservation of any rent to the King ; whereby [by which letters patent] the said lands were created into a manor to be called the manor of Kilgarvan and there was also granted to him a fair to be held on the lands of Ories on the 15th of August yearly. Petitioner exhibited a claim for said lands before the late Commissioners for executing the Acts of Settlement and Explanation, and was by their decree dated 1663, July 28, adjudged an Innocent Protestant and his father and grandfather were adjudged Innocent Papists and they being dead, he was by said decree restored to all the lands in the schedule annexed to his petition. All the lands contained in the said schedule are returned by the civil survey to have been in 1641 the property of Edmond Malone, the petitioner's father. A suit depended for several years in the Exchequer between the King and petitioner, whether he being restored to his estate as an Innocent Protestant was liable to pay quit rent thereout, and it was decided after several arguments on both sides that it was liable to quit rent, which amounts to 43l. per an. Petitioner desires a confirmation of said lands by new letters patent and for same to be created into a manor to be called by the name of Buollynehowen and for said fair to be kept hereafter at Buollynehowen, which is now the place of petitioner's residence ; in consideration thereof petitioner offers to surrender the letters patent of James I., and to continue liable to the said quit rent of 43l. per an. or thereabout now charged upon the said lands, and to waive all advantages that he might have by bringing a writ of error for reversal of the said judgment in the Exchequer making him liable to said quit rent. Hereupon Sir John Temple is of opinion it would be advantageous to pass such new grant in regard the case concerning the liability to pay quit rent depended very long in the Exchequer and seemed to be a very doubtful case. Said Temple's report being referred March 18 last to Treasurer Danby, the latter hereby reports fully agreeing with the same. Memorandum ; "all that came with this report of the Solicitor General is Mr. Malone's petition without any reference upon it or list annexed to it." Ibid, pp. 194-5.
Warrant from Treasurer Danby to the King's Remembrancer for a commission to pass the seal of the Exchequer Court in a form prefixed in extenso in Latin, viz., to Charles Pertie, Sir Charles Harbord, Surveyor General, Sir Edward Deering, bart., Sir Robert Viner, Kt. and bart., Sir Nathan. Herne, Sir William Smith, bart., Charles Osborne, Charles Cheney, Thomas Neale, Edward Backwell, John Buckeworth, Brooke Bridges, and Thomas Done, Esqrs., to enquire of the numerous complaints made daily of abuses and irregularities committed in the Mint, exchange and coinage of moneys whereby less gold is brought to the Mint, etc., ut supra, p. 751. Warrant from Treasurer Danby to the Customs Commissioners to deliver, Customs free, two pair of silver andirons weighing about 490 oz. lately brought from Rotterdam in a vessel whereof Capt. Ralph Wimpell is master, and two greater andirons weighing about 640 oz. imported in a vessel whereof Capt. Willems is master, and two small deal cases containing each five small pictures one p. [? pair] of tables and three old frames for pictures brought from Middleburg in the Mary dogger, John Whiteing master, the whole being for his Excellency the Marquis of Burgamane D'Este, the Spanish ambassador residing here. May 8. Privy seal for 2,000l. to Secretary Williamson for secret service without accompt. (Royal warrant dated May 3 for said privy seal. Treasurer Danby's signature dated May 8 of docquet hereof. Same for 863l. 3s. 9d. to Sir Thomas Allen, Kt. and bart., as 6 per cent, interest for several principal sums amounting to 4,900l. due to him from the King (as by an interest account stated by Auditor Richard Aldworth and allowed by Treasurer Danby 1676-7, Jan. 11) of which principal sum 3,900l. was repaid before 1676-7, Jan. 1, leaving unpaid 1,000l. principal and said 863l. 3s. 9d. interest, or 1,863l. 3s. 9d. due from 1676-7, Jan. 1, "of which sum from that time we think fit to allow" 6 per cent. interest till repayment. Therefore the present privy seal is for payment of said 863l. 3s. 9d. and also for 6 per cent, on said 1,863l2. 3s. 9d. from said 1676-7, Jan. 1 : "taking care nevertheless that a certain order for 300l. No. 99 and registered on the Wine Act which (as appears by certificate of one James Littleton) was left in the hands of said Sir Thomas Allen in part of the said interest due to him be delivered up and vacated or otherwise disposed as you [Treasurer Danby] shall think fit." Warrant from Treasurer Danby to the Customs Commissioners to examine the allegations as in the petition following and if true, and if the prohibitions in the late Poll Act will permit, then to forthwith suffer the vessel as follows and her lading to proceed on her intended voyage, notwithstanding the present embargo.
Prefixing : Order of the King in Council dated Whitehall April 26 last. The petition of John Mayne and divers other woollen merchants in and about Exeter was this day read, setting forth that fearing a sudden breach with France they did in Feb. last dispatch a small vessel called the Merchants' Adventure, burden 26 tons, John Fourse master, manned with five men and a boy, to bring off from thence in linen the effects [proceeds] of their woollen manufactures to the value of 6,000l. then lying there. But by contrary winds said vessel returned not to Exeter till March 23 last, after which, and not before, they were informed of a law [the Poll Act] prohibiting the importation of French commodities [from and after] the 20th of the said month. Whereupon being put to great straits they at length concluded to send the said vessel with her lading entire without declaring or entering the said goods or breaking bulk to some foreign market, but were prevented by the embargo, and therefore begged the Privy Council to commiserate their sad condition and the many hundred of poor workmen in the said manufacture that depend upon them and to permit said vessel to sail to some foreign market. On reading said petition it is referred to Treasurer Danby to examine the allegation of not breaking bulk, and if true, to permit the vessel to depart, notwithstanding the embargo.

Same from same to pay 29l. 10s. 10d. to John Sanson, gent., and to discharge him of 50l. more lately imprested to him by delivering up his note for the same ; the total of 79l. 10s. 10d. being hereby to be allowed him for his charges and attendance in executing a commission of inquiry at Poole. Treasurer Danby's allowance of Richard Mounteney's bill of disbursements as late Receiver General of the Customs in order to his quietus est for [his accounts for] 1¾ years ended 1677, Midsummer : (total 696l. 10s. 2d. including items for the portage of money and for pains in receiving bills of exchange about 24,500l. and paying the same since Midsummer last). Money warrant for 5,000l. to Baptist May, Keeper of the Privy Purse : to be paid out of such money as shall from time to time be brought into the Exchequer upon seizures, finos and forfeitures as by the privy seal of 1665, Sept. 5, directing the seizures, fines and forfeitures of uncustomed and prohibited goods to be appropriated to the Privy Purse. Charles Bertie to the Customs Cashier. Mr. Segar will herewith bring you a tally struck on the Customs April 29 last for 3,724l. 13s. 5d. in part of an order drawn in my [Bertie's] name for secret service whereof there is present occasion for 2,000l. which sum Treasurer Danby desires you to advance forthwith and you shall be allowed interest as formerly. May 9. Royal warrant to the Attorney or Solicitor General for a great seal for a grant to Richard Anguish and Edmund Anguish, junr., of the office of Customer of the port of Great Yarmouth in reversion after Edmund Anguish their father ; to hold for life or the life of the long liver of them, and with power to execute the same by deputy. Royal sign manual for 640l. 17s. 2d. to Edward, Viscount Latimer as royal bounty without account : to be by tallies on the Receiver of the moneys "arising by a Poll [Act] and otherwise [on our servants and officers] in our Household" as by the Act of 18 Car. Treasurer Danby is well pleased that you make such advance, and has the King's leave and direction to assure you your punctual repayment at the times abovesaid [even] though my Lord Frescheville should not live till the year were completed. Flint and other places in Wales to sail to Ireland, all to the great prejudice of masters of coalworks and owners of ships there. Treasurer Danby is hereby to direct the Customs Commissioners to consider this business of carrying coals into Ireland, and to report whether any difficulty occurs to them why the same rule lately granted to the coal ships of Cumberland (viz., of giving bond to return back in a limited time with their full number of the seamen they carry forth) may not also be extended to the complainants in this case.

Royal warrant to the Attorney or Solicitor General for a great seal for a revocation of the privy seal of 1676, June 14, which disposed and settled the revenue of Greenwax to be to and for the rebuilding the cathedral church of St. Pauls and the repair of Windsor Castle and the carrying on of the works at Windsor ; and [in lieu thereof] for a grant to Henry, Earl of Peterborough, Robert, Viscount Yarmouth, Henry, Lord O'Brien, Sir Francis Compton, Kt., Bernard Greenvile and Henry Fanshaw, Esqrs., and Percivall Brunskell, gent., their executors, etc., of all fines, penalties, etc., upon judgments quod capiatur and capias pro fine, and also of one full moiety of the revenue that shall arise by or upon the Greenwax of the Exchequer at Westminster or commonly called or known as part or parcel of the Greenwax, together with all arrears of the same ; excepting all fines, penalties and forfeitures that shall arise upon any penal statute or conviction of popish Recusants, Conventiclers and other Recusants as well Greenwax as others ; and also excepting all penalties and forfeitures upon any other penal statutes whatsoever, which shall or may be recovered upon informations or actions popular, qui tam, etc., and except all Post Fines of Alienation : to hold the above (with the above exceptions) for 31 years from date of this grant as herein at the yearly rental of 250l. A clause to be inserted in the grant that if at any time during the said term it should happen that any of the sheriffs should not have in their hands at the time of making their accompts any revenue, over and besides what is hereby intended to be granted, sufficient to defray the ordinary charges allowable to sheriffs, in such case the sheriffs may deduct out of the profits hereby intended to be granted such sum as shall be due upon their accompts. Further, care is to be taken that the duties and forfeitures hereby intended to be granted be collected and accompted for by such officers and in such manner and form as the law and Custom of the Exchequer do appoint and allow, and after such collecting and accompting, the sheriffs or other officers that shall have the said moneys in their hands shall pay over the same to the above grantees. Further, a clause is to be inserted reserving a power to the judges of the respective courts to spare issues and to mitigate fines and recognizances, and to allow to prosecutors and for charges incident for their service in the same manner as they now use, whether by privy seal or by course of law ; and that the King, his heirs and successors may by great seal or privy seal give the like power to any of the King's Justices in such manner as he or they shall think fit : and likewise reserving to the said Judges power to order the payment of 40l. per an. out of the capias pro fine for the reparations of the Court of Common Pleas, together with such other sums of money to be allowed out of the premises for the purpose last mentioned as by the Lord Treasurer for the time being shall be appointed. Further, a clause is to be inserted that if at any time during the said term of 31 years it shall be made appear to the King, his heirs or successors and the Privy Council that this intended grant is prejudicial or inconvenient to the King's service, that then it shall be lawful for the King by advice of the Privy Council, upon full proof thereof, to determine the same by great seal or privy seal.
