dated Aug. 10 last made to the King by the Earl of
Essex, Lord Lieutenant of Ireland [on the petition
of the London Society of Governor and Assistants,
London, of the New Plantation in Ulster] : said
Earl of Essex's report being as follows : in accordance
with the royal letter of July 9 last I have called
before me such of Visct. Ranelagh's partners as are
now in Ireland and have heard their pretences to
defalcations in case of a discharge being given
by your Majesty to the Society of Governor and
Assistants London of the New Plantation in Ulster
for the arrears of the high rent payable by them
to your Majesty until 1665, Lady day. In your
contract with Visct, Ranelagh your Majesty
covenants that if at any time from the date of said
contract to 1675, Dec. 26 next, any debts or revenues,
etc., be discharged or lessened by release or pardon,
etc. thereof, then said Viscount and his partners
shall have a proportionable defalcation. Although
your Majesty had by orders of Council of 1668,
July 28, and 1669, Nov. 12, before the commencement
of Visct. Ranelagh's contract expressed the
intention of remitting the said high rent and had
ordered the Barons of the Exchequer, Ireland,
to stop proceedings against said Society thereon,
yet no actual discharge or release was granted
thereof, and it was none of the sums excepted in
said Viscount Ranelagh's contract. Therefore said
Visct. will be entitled to defalcation if same be
dicharged. Said report being Aug. 28 referred to
Treasurer Danby, the latter hereon reports that the
remission or discharge to the said Society may be
granted according to former directions in Council,
notwithstanding that Visct Ranelagh and partners
will thereby be entitled to a defalcation.
