Privy seal directed to the Lord Treasurer. By the failure of the
present contractors and the refusal of Josiah Child and Tho.
Papillon to deliver any more victuals on board our ships
according to the terms of the contract for victualling the Navy
it is necessary to make other provision for the supply of the
ships. For that purpose we have called before us and the
Admiralty Commissioners Sir Denys Gauden, Surveyor General
of Marine Victuals, who, on behalf of himself, Sir Denny
Ashburnham, Anthony Sturt, Abraham Jaggard, and Benjamin
Gawden, has undertaken to furnish victuals for the Navy,
during pleasure, at the rates mentioned in the contract of 1671,
Nov. 4, and to submit to such amendments and regulations of
said contract as may be thought expedient, from time to time,
by the Admiralty Commissioners. Said undertaking is hereby
approved, and you are to proceed upon it and to make such
payments as may be necessary for that service. (Treasurer

Treasurer Latimer to [the Receipt]. The several branches of
expense are charged on the Hearthmoney in the manner
following, viz. : 600l. per week in the first place for the Privy
Purse towards the establishment of 38,000l. In the next
place 250l. per week to the Paymaster of the Works on the
ordinary of 8,000l. for the Works. Thirdly 5,000l. per an. to
the Robes by 100l. per week. Fourthly 11,000l. per an. to the
Duke of Buckingham for the Stables by 200l. a week. Fifthly
24,000l. to the Great Wardrobe by 400l. per week. The
30,000l. for a year's pay to the King's servants, payable by
the Treasurer of the Chamber, is to be paid out of said revenue
by directions to be given by the Lord Treasurer. As the said
revenue comes into the Exchequer payments are to be made as
above expressed, and if one week falls short it is to be made
good out of the succeeding weeks.

to permit Peter Vandeput, merchant, to re-ship, Customs

not proper for the market here : the Customs on said lace by
the Book of Rates amounts to 240l. 18s. 5d., which is almost

certain fee farm rents and other dry rents in co. Bedford,
of the yearly value of 106l., purchased by John Chace, Esq.,
but refused by said Sawyer to be put out of charge for
technical reasons, detailed, viz., "the said rents being of two
parts, first, of rents called pensions in the record, which you
conceive were not vested in the Trustees by the Act of Parliament
[for sale of fee farms], but the said Trustees find the
word pensions in the first Act, and therefore have conceived
them to be rents that pass by the second [Act] as effectually as
any other rents therein mentioned : secondly, rents which in
the record are written redditus sive firma, which you also
conceive do not pass by the second Act in respect of the word
firma. But these having been always so charged and no lease
or improvement appearing to have been of them at any time
heretofore since the dissolution of monasteries, whereby they
came to the Crown, the said Trustees conceive them to be no
other than dry rents saleable by the Act."

Instructions from Treasurer Latimer to same in reply to their
paper of the 8th inst. The former allowance of an eighth
part for collecting the Plantation duty is to cease from Lady
Day next. The one half of the new duty to be collected is to
be allowed in Virginia and Maryland and a third part to be
allowed to the Surveyors who are to be assistant to the Collectors.
The salary of Mr. Diggs shall be revoked and that of
Mr. Calvert, Surveyor of Maryland. You may dismiss Mr.
Upton, Collector of Falmouth, and employ Isaac Alstell in
his place. As to Mr. Godfrey's petition concerning tobacco,
he is to pay the duty as for Virginia tobacco. An allowance
will be made to Nicholas Denham, a Customs officer at Harwich,
for seizing Annott in a collier's vessel. Mr. Huddleston is
to make proof concerning tobacco transported by land carriage
into Scotland.

Royal warrant for a privy seal to the Lord Treasurer. Before
the failure of the late Victuallers of the Navy 22,604l. was
imprested to the Navy Treasurer out of a feigned or fictitious
loan made upon the credit of the present Eighteen Months'
assessment by Edmd. Portman, an Agent for the said late
Victuallers. The accompts of said Victuallers since their
failure are not yet made up, but so much does not appear due
to them as the said sum of 22,604l., "which although a regular
issue be made of it at our Exchequer yet is not the same really
received by them, the loan of the said Edmo. Portman being
only feigned or fictitious and grounded upon a credit betwixt
him and the Teller [of the Exchequer] as is usual in the like
cases for the accommodation of our services." Care is hereby
to be taken that no orders of repayment be given out to said
Portman for said fictitious loan, it not yet appearing to be due
to said Victuallers as aforesaid. If any such orders are drawn
and signed they are to be vacated. Further to the end the
Teller may not be charged with said loan nor the Treasurer of
the Navy with the imprest of said money, the records and
counter tallies of said loan and the records of the issues made
thereof upon the orders to the Navy Treasurer and those
orders themselves are to be also vacated. Further for carrying
on the service of the Victualling you are to pay all sums
necessary not exceeding 100,000l. to Sir Dennis Gauden et al.
(ut supra, p. 431) as imprest and till further order herein.

this matter. The best way of discovering a true state of their
losses sustained by the war will be by a Commission to the
several ports to view their books to see if they have received any
more money for the Customs than they certify and to see if
their books are fairly kept : certificate thereof to be returned
to the Commissioners at Cork House.
