James Patteson and Thomas Walmesley merchants viz. to bring
the same to Bucks Bank in Poulton port Co. Lancs. but upon his
arrival at the Pile of Fowdray on Oct. 2 last part thereof was
seized as forfeited by a late Act of Parliament of 10 & 11 Wm. III
c. 21 prohibiting the importation thereof [after Sept. 29 last except

and ready to sail from Maryland on June 8 or 9 last but he was
warned by the Governor not to sail at that time as those seas were

General of the Plantations on the letter of Col. Nicholson dated
14 August 1700 (see Treasury Calendar, Vol. XV, pp. 431–3 under
date 24 Aug. 1700). |

This report is prefaced by the following Memorandum "Mr.
Blathwayt attending the Lords of the Treasury by their direction
upon this letter he is ordered to report to their Lordships upon the
matter contained in it and in the other papers transmitted with it.
Whereupon Mr. Blathwayt presents the following report to their
Lordships." |
|
As to the place of Receiver and Accomptant [of Virginia] being
in the [hands of the] same person with that of Auditor I humbly
represent that Nathaniel Bacon Esq., being Auditor of the Public
Accounts in Virginia, in the year 1677 by warrant from the Treasury
with the fee of 5 per cent. and Col. Norwood having been for some
time Treasurer or Cashier of the revenue with considerable advantages to himself, the Government and Council of Virginia being
desirous to bring the charge of managing the said revenues into a
narrow compass and believing the office of Treasurer [to be] un
necessary, they thought fit to desire Mr. Auditor Bacon after auditing
the accompts of the particular Collectors and Receivers before the
Council, as is usual, to charge himself with the bills brought in by
the said Collectors and Receivers, without appointing at that time
any fee or other allowance to the said Auditor for performing that
part of the office of Treasurer or Cashier of the Public Revenues. |
|
The Duties of 2s. per hogshead being paid to the Collectors and
Receivers of the said Duties by masters of ships and others in their
own bills of exchange, [the said bills] were delivered over to the said
Auditor as Cashier by the said particular Collectors upon making
up their accompts. |
|
The Governor and Council in 1680 came to an agreement that the
Auditor, besides the ancient fee of 5 per cent. for auditing the public
accompts, should be allowed 2½ per cent. upon the said bills received
from the Collectors and Receivers, he making payment of the whole
by his own bills of exchange: and accordingly the Auditor has
continued to make good the said bills of collection by his own bills
for the payment of salaries and other necessary charges of the Government pursuant to such warrant as are signed by the Government
with the advice of the Council. |
|
Upon the surrender of the office by Auditor Bacon, Mr. Bird was
appointed Auditor of the Public accompts in Virginia likewise by
warrant from the Treasury Lords dated 24 Dec. 1687, to hold the
said office in the same manner as Mr. Auditor Bacon, a grant having
been made about the same time under the great seal of England to
Mr. Ayleway, who did by letter of attorney irrevocable assign the
benefit of the said grant to Mr. Bird; who having entered into
5000l. bonds with 3 sureties before the Governor and Council for
the faithful discharge of his trust he has continued in the same
manner as Auditor Bacon to charge himself with the bills of collection
delivered over by the particular Collectors and Receivers of the
Virginia Duties upon the auditing their respective accompts: of
the disposal of which bills he also gives an accompt twice in the year
to the Governor and Council; by whose order the said accompts
are transmitted for your [the Treasury Lords'] approbation. In
like manner as was practised in the time of Mr. Auditor Bacon the
said Mr. Bird, besides 5 per cent. as Auditor, receives 2½ per cent.
for the loss that may happen by the protesting or other miscarriage
of the said bills, for which he is answerable. |
|
If your Lordships think it unfit to combine in the same person
the audit of the accompts and the receipt of the said bills of Collectors
in the nature of Treasurer or Cashier, your Lordships may give
directions for erecting a new office for taking charge of these bills
and disposing thereof; which [however] cannot be without an
additional charge upon the said revenues. |
|
And whereas Col. Nicholson has represented that it may be inconvenient for his Majesty's service that the Auditor and Receiver
General has been obliged to give security only in Virginia I conceive
that Mr. Auditor Bird will (if your Lordships think fit) be ready to
give a further security here in England besides the said 5000l. with
sureties entered into before the Governor and Council of Virginia. |
|
Col. Nicholson has also represented that it may be of advantage
for his Majesty's service that the said Auditor may have a room
in the public buildings, where [in which room] all the accompts
and papers may be lodged and that he may be obliged to live near
the seat of Government and he or his deputies to attend at certain
times in the year. |
|
I humbly represent that the State House or public building for
the meeting of the Council, Assembly &c. in Virginia and for the
public office[s] having been destroyed by fire in 1698 the said offices
have been kept in private houses since that time. But I cannot but
agree in opinion with Col. Nicholson that it will be for his Majesty's
service that all public offices be kept in some public building and
that attendance by duly given there as soon as the said public building
shall be furnished and fitting accommodation provided for the
respective offices: which [proposal] the Governor may have [your
Lordships'] orders to take care of. |
|
As to 10 per cent. mentioned by Col. Nicholson to be allowed to
the Masters of ships out of the Duties paid by them I humbly represent
that in 1680 a bill being prepared by the Committee of Trade
and Plantations was transmitted to Virginia and passed into an Act
in the Assembly there granting the revenue of 2s. per hogshead to
his Majesty for the support of the Government of that Colony,
with power to the Governor with the advice of the Council to give
such allowance and encouragement as should be thought fit, not
exceeding 10 per cent., to such masters of ships and others as should
give a true accompt and advance and pay down the said Duties either
in money or sufficient bills of exchange to the satisfaction of the
respective collectors; which allowance of 10 per cent. upon the
Duty of 2s. per hogshead of tobacco exported from that Colony
being very inconsiderable in comparison to the Duties on tobacco
paid in England, the said allowance was thought a proper inducement
for masters of ships the more readily to make the entries in Virginia
and consequently in England where the payments are so considerable.
But in case your Lordships should nevertheless think fit that the
said allowance of 10 per cent. to the masters of ships upon the 2s.
per hogshead be lessened (which will be of small advantage to the
revenue in Virginia and very dangerous to the revenue here) orders
may be given accordingly to Col. Nicholson. |

As to the directions given by Col. Nicholson to Mr. Auditor Bird
and to Bartholomew Fowler Esq., her Majesty's Attorney General
[of Virginia], to draw up a scheme concerning his Majesty's revenues
of all kinds, to be communicated to a Committee for revising the
Laws in Virginia; and as to his proposal to have a more exact rent
roll taken of all lands held by his Majesty there and the preventing
of frauds and the undue taking up of lands and other particulars
mentioned by Col. Nicholson. I humbly conceive such orders tend
very much to his Majesty's service and to the improvement of the
revenues in that Colony and that Col. Nicholson may very well
deserve your Lordships' approbation of his care and conduct in the
