Same to Mr. Blathwayt. The Treasury Lords have discoursed
with the Lords Justices [of England] concerning the transportation
of the eight Battalions to Flanders. They desire you to represent
to the King (1) that by reason of the distance of some of their quarters
the said Battalions cannot be ready for embarcation by the 10th
May as prefixt in your letter: (2) that to clear the quarters and
subsist them till their going aboard will require 33380l. 6s. 6d. as per
the enclosed estimate [missing]. (3) that the charge of transportation doth amount to about 5,000l. more, besides what is requisite
to be paid to the said Battalions' officers for tents, equipage etc.; for
all which sums no provision is made in the designed Distribution
of the Exchequer Bills; and if so many of them should be applied
to this use it must disappoint the General Officers and several other
services which the King thought absolutely necessary. There is
likewise enclosed herein the Earl of Ranelagh's Distribution [scheme,
missing] of the 736531l. 9s. 8d. which is the whole that remains to
be disposed for land services out of the 1500000l. Exchequer Bills
"wherein his Lordship has not had any regard to the proportion
which the Office of Ordnance claim and seems absolutely necessary

The Treasury Lords to the Governor and Directors of the
Bank of England. There is a very pressing occasion for money at
this time to be applied for payment of wages to seamen: and having
always had instances of your readiness to serve the Government
we cannot but acquaint you that the advancing 50000l. in money
for Exchequer Bills will be a very acceptable service and we doubt
not will tend as well to the interest of the Bank as to the good of the
public. We therefore earnestly recommend this matter to your
consideration and desire you will let us have an answer as speedily

Treasury warrant to Sir Thomas Trevor, Attorney General to
enter a noli prosequi on the information against the ship Bonadventure
55 tons, Rodriguez Crano commander, manned by Portuguese and
laden with wines and fruit from Portugal and which arrived in the
Thames in Feb. 1694–5 and was no way troubled by the Customs
officers during his stay there; and John Mendes de Costa of London
merchant entered said lading and paid aliens duties for same but a
year after her departure an information was exhibited by John Smith
&c. ut supra p. 119: on which matter the Customs Commissioners
have reported that the information is based on the said ship being an
English ship and that the fault assigned is that an English built
ship did that which was lawful for a ship of the built of Portugal
to have done and if this shall be understood a fault then are
English built shipping (supposing the property to be foreign which
is apprehended to be the present case) in a worse condition than
foreign shipping, which construction of law however it may seem
to be warranted by the letter of the Navigation Act, appears to be
directly against one main purpose thereof viz, the encouragement
and increasing of English shipping: wherefore the Commissioners
have no objection to the granting a noli prosequi. Out Letters

Treasury reference to the Customs Commissioners of the petition
of Thomas Ward, master of the ship Yarmouth, petitioner setting
forth that being employed in carrying stores for the Navy when it
was in the Straits [of Gibraltar] he bought of the King's Agent for
Prizes at Cadiz a parcel of prunelloes brought in there as prize for
which he paid the true value but on importing same to England they
are seized as French and informations entred in the Exchequer
although soon after the same was adjudged as lawful prize; that the
Treasury thereupon directed that he should receive the King's part
of the forfeiture and that his bonds should be cancelled, (see supra
Tr. Cal. Vol. XI pp. 422-3), but the officers not being content
threaten to molest him upon the said informations as well for
personal penalties as for the forfeiture of his ship: therefore praying

Treasury warrant to Sir Thomas Trevor, Attorney-General, to
enter a noli prosequi to the information in the Exchequer against
the sloop Samuell seized at Bristol under the Act of Trade of 15 Car.
II c. 7 for taking in 40 pieces of drapery (kerzies) at Cork in Ireland
and carrying them directly to Antigua contrary to the said Act;
the ship having been appraised at 112l. 8s. 0d. and afterwards
restored [to Abraham Elton of Bristol merchant] by writ of delivery
on security to answer the value if she should be adjudged forfeited
the said Elton having affirmed to the Customs Commissioners that
there was no sort of drapery or any other sort of prohibited goods
whatsoever laden upon or exported in her from Cork or any other
port in Ireland for account of the owners or with their privity or
consent, it being (as is testified by Mr. Holt) much against Elton's
interest to export such commodities from any place but England;
and it being likewise certified by the Transport Office that he came
and entered into that [the Transport] service among the first for
transporting the Forces and provisions for the reduction of Ireland
and that he has otherwise promoted the said service, for which there
is at least 4,000l. due to him: further the ship's master is in a crazy
condition in the country and incapable of answering for himself or
his company: wherefore the Customs Commissioners think it
would be hard to insist on the forfeiture of the sloop. Warrants not

Joseph Stepney shewing that his estate called Abington alias
Abbyoney within 5 miles of Limerick was so wasted in the late war
that it has produced nothing ever since nor can he or any responsible
tenants live upon the same for want of defensible places against
robbers and rapperees who have lately murthered several and robbed
most of the English thereabouts; and that the lands of Ballyart
and other lands mentioned in his petition amounting to 1,150 acres
lying near his estate are forfeited by the rebellion of the late Lord
Brittas but encumbered by mortgages to the extent of 50l. per an.
more than they produce but that in regard there was an old castle
thereon of some defence he took a lease thereof from the incumbrancers; therefore praying a grant of the inheritance and power
of redemption thereof lest the improvements he designs might give
occasion hereafter to the redemption of the mortgages by some one
deriving under the Crown. |

From the report of the Revenue Commissioners Ireland hereon
it appears that the Lord Brittas's said estate is set (with other lands
of the same forfeiture) for one year ending at Lady day 1698 for
200l.; that the desired inheritance is valued at 200l. per an., and the
quit rent 17l. 9s. 8d. per an. and the yearly interest of the incumbrances
20l. and 212l. 12s. 0d. make 250l. 1s. 8d. which is more than the
annual value; that it lies in a wild part of the country and that
petitioner has been industrious in planting the same with English
and in suppressing the Rapperees and that the encouraging of
Protestants to settle there would be of public advantage to that
part of the country. |

My Lords laid this petition and report before the King at
Kensington and he did not think fit to grant the request. "But being
sensible that by reason of the many cases then represented to his
Majesty the circumstances of this were not fully and plainly opened"
my Lords command me to desire you at your first opportunity to
lay this whole matter before his Majesty for his pleasure therein.

East India ships were taken; that he received instructions from

in France having contrary to the petitioner's directions sent over
hither a parcel of muslin neckcloths the same were seized by an
officer of the Custom House": therefore praying a noli prosequi to

Same to John Povey Esq. of the petition of Col. Thomas Dungan
petitioner shewing that being Governor of New York in 1687 when
the French made a descent upon that Province he was forced for the
necessary defence thereof to lay out great sums of money and in
particular he became bound in 400l. to James Lorkan and 100l. to
John Dubrune for ammunitions and provisions of war and they
have lately caused him to be arrested for same: and threaten to
proceed to judgment and execution which he cannot avoid and is
not able to satisfy: that though several thousand £ remain due to him
for his disbursements in that expedition against the French and
upon account of his government of New York he is willing to waive
his solicitation for that money during this expensive war but hopes
my Lords will not suffer him to be cast into prison for this small
debt as he must be if not relieved: therefore praying for 500l. or

Dennis and Adrian Perrian of London merchants praying the
remission of the King's share (being 126l. 4s. 5d.) of a forfeiture of a
bond entered into upon claiming a parcel of kid skins, prunes, rozin
and cork consigned to them from one Miguell de Castella, a Spanish
merchant in San Sebastian, in the ship St. Francis, which goods
were condemned on suspicion of being French goods though upon
