(fn. 3) Mandate, recapitulating the preceding, after the above William Offlannagan has been received as a canon of the above priory, conventual, void by the death of Maurice Oconchobair, and reserved under the pope's late reservation of all conventual priories, and after he has made his profession, to summon John Maceadgan, canon of the said order, who has unduly detained possession for about two years under pretext of an election which was perhaps confirmed by authority of the ordinary, and on account of whose power William has no hope of obtaining justice in the city or diocese of Elphin, and if he find that the said priory, independent and value not exceeding 50 marks, is void as above, or by the death of Thomas Maceadgan, or in any other way, to collate and assign it to William (who has been dispensed by papal authority, as the son of unmarried parents, to be promoted to all, even holy orders and hold the said provostship), removing the said John and any other. To the archdeacon of Ross. Mandate as below. The recent petition of Thomas de Kylqhus, canon of Ross, contained that after he had been dispensed by papal authority, as the son of a priest and an unmarried woman, to be promoted to all, even holy orders and hold a benefice even with cure, Lupus de Galdo, S.T.M., penitentiary of Peter de Luna, called Benedict XIII, to whose obedience belonged the city and diocese of Ross, by viva voce order thereof dispensed Thomas, then a priest, of the said diocese, to hold four other benefices compatible with the above, even if one of them likewise had cure, or were a canonry and prebend, and to resign all, for exchange or otherwise, once only, after which he obtained the perpetual vicarages of Euraferayne and Bamff in the dioceses of Ross and Aberdeen, and, resigning them, a canonry of Ross and the prebend of Lymnalayr therein, value not exceeding 12l. sterling, which he holds at present. At the said petition the pope orders the above archdeacon, if he find that the foregoing was lawful, to decree that the said letters, which are in those parts, are legal proof as regards the effect of the said dispensation. In that event the pope dispenses Thomas to hold any mutually compatible benefices, with or without cure, of any number and kind, even if canonries and prebends, dignities etc., and to resign them, simply or for exchange, as often as he pleases. Lately the present pope prolonged by other ten years [above, p. 340] the ten years, then about to end, during which John XXIII dispensed him to hold with his parish church of Malberthorp (sic) in the diocese of Lincoln any other benefice with cure or otherwise incompatible, and to resign them, simply or for exchange, as often as he pleased, after which dispensation and in virtue thereof, resigning Malberthorp, he obtained the parish church of Wartun in the diocese of York and the said archdeaconry, which is a non-major dignity. To the abbot of Holyrood (Sancte Crucis), Edynburgh, in the diocese of St. Andrews. Mandate as below. The recent petition of John Forestarii, knight, of the diocese of St. Andrews, contained that he formerly founded in the cemetery of the parish church of Corstorsyne (sic) in the said diocese a college for five priests, one called provost, and two boys, and endowed it with yearly rents of 120 ducats of gold; it being provided that the provosts and priests shall be presented by the said knight and his successors and heirs, that the provost shall be instituted by the bishop, and the said other priests by the provost, and that the said other priests shall obey the provost in all matters concerning divine offices and the capitular statutes, and in other matters concerning excesses and corrections shall obey the bishop and the archdeacon of the place. At the said petition, which added that if the rectory, which is in the gift of the bishop, of the parish church of Rathow in the said diocese (the cure of whose parishioners is exercised by a perpetual vicar), were united to the said college, other four or five priests could from its fruits etc., value not exceeding 40l. (fn. 5) sterling, be instituted in the said college, the pope orders the above abbot, if he find the aforesaid to be true, to approve and confirm the said institution, endowment etc., and moreover to make the appropriation of the said rectory, to take effect on the resignation or death of the present rector. The pope wills that after such incorporation five other priests shall be instituted, and ordains that the presentation of them shall belong alternatively to the said John and his successors and to the bishop, and their institution to the bishop.
