Thus be the Poyntys, for the Union, Peax, and Amytie betwix the Kings of England and Fraunce, Comyned and Spokyn betwix the Lord Querds Marshall of Fraunce and the Lord d'Abenay Lieuxtennaunt General of the Town and Marchis of Caleys, and other Ambassadours being with thaim, Referring the same Pointys to the Pleaseour of booth Kings, to the which shall be made Rapport of the same Pointys for to have Answer with all Diligence.
First, t'Aquyte the Obligations which the King of Englond hath of my Lady Anne of Bretaign Quene of Fraunce, by the which she is Bownden to Pay him and Restor him the Mises and Expenses the which he hath doon for th'entertaining of the Men of Werr Socours and Ayde don unto Hir by the said King of Englond, the which Mises and Expenses th'Ambassadours of Englond afferme to mownt to the Som of Six Hundred and Twenti Thowsand Scutz of Gold, which is Cxxiv. M. Li.
And also t'Acquyte th'Obligation that King Edward had of King Loys and off th'Aireriage of Five Termys mownting to Cxxv. M. Scutz, which is xxv. M. Li. The which Obligation toching the said Ladye Anne of Bretaigne and Quene the King of Englond shall Annul and Delyver forthwith and immediatlie, and th' Obligation of King Loys as sone as it may be fownd, The French King shall pay or do to be Payd to the King of Englond the Somme of Cxlix M. Li. And therofe shall yeve such Obligations and Sureties as the sayd King Edward had by the Traictie of Picquequye of King Loys, and the said Somme shall be Paid by Yers (that is to say) every Yer L M. Franes of xx Scutz the Franc, the which shall be Payd in Scuts of Gold at two Termys of the Yer, from half Yer to half Yer after the Date of this present Traitie, and so from Yer to Yer and Terme to Terme to the playn and entiere Payment of the sayd some of Cxlix M. Li.
And for as much as in th'Obligation of the said Quene ther is noo certaign Somme specified ne declaryd, the sayd Ambassadours of Englond have offred that the King, within such reasonable Term as shall be advysed, shall ordaign and depute his Tresorier and other Officers, such as hath had the Charge of the layyng out of the said Mises and Expenses, and in the Presence of th'Officers of Bretaign or other such as the Freinsh King shall ordonne and depute, the said Mises and Expenses shall be vewyd and verefyed by th'Affirmation of the King of Englond and the Othe of his said Officers, or otherwis dewlie, and the Doble of th'Extracts of the said Accomptys of the Mises and Expenses shall be delyverd to the Commissioners of Fraunce, the which for the same Purpose shall go into Englond.
Also the said Kings shall Name in the said Traictie of the Peas thair Allies, the which shall be bownden to declar by thair Lettours under thair Sealys within Four Moneth after the Date of the Treatie, if thei will be comprised, the which Sealys for thaim that will be comprised in th'Alliaunces of the King of Englond shal be sent to the King of France, and for thaim that wil be comprised in th'Alliaunces of the King of Fraunce shall be sent to the King of Englond:
And if the King of Romayns and his Son th'Archduk and thair Cuntres will declar thaim to be comprised, and that therafter the King of Fraunce make or begynne any Werr agenst thaim by Souprins of Town or by Entring of or with any Puissaunce into thair Cuntres, in this Cas the King of Englond shall mow yeve thaim Socours and Assistence:
And if the King of Romayns or th'Archduk his Son or any other for thaim begynne the Werr by Souprins of any Town now being, in the Hands of the Freinsh King or Entring with Power into his Realm or Cuntres being of his Obeysaunce, in this Case the King of Englond shall not mow yeve thaim Ayde or Socours of Men or Money:
And if the said ij Kingys agree them to this present Advyse, thay shall yeve of aither side Pleggys and Ostagies of semblable Estate and lyke Numbre, the which shall abyde (that is to sey, those of Fraunee at Caleis, and those of England at Amyas) unto such time as this present Traitie be hollye Passyd, Accepted, and Sworn by the said ij Kings: The which doon the said Pleggys and Ostagies shall be frelye Delivered and Restoryd to thair good Suretie, every Man in his Partie, without Let or Empechement for any Cause or Occasion whatsoever it be.
Upon which Pointys and Articles sent by the Lord Querds and other Ambassadours for the Freinsh King to the Kings Grace, and by him seen and understanded, the same his Grace assembled the xxvij Day of Octobre, in his Feld beside Bolen, all the Lordys, Statis, Counsellours and Capitaignes of his Armye, whose Namys ben with thair own Handys under this Writyng subscribed; and to thaim his said Grace shewid the same Articles, and required thaim all of thair good feithfull and trew Counsell what wer best for his Honeour and Suretie and also Profitt for his Realme in this behalf to be don, and whether the Peax in Manner and Fourme afore Wreten might with his Honeour and Profitt to his Realme be Acceptid, or ellis it shold be Refusid: And that thei wold Debate and Suade among thaim with Diligence the said Articles and th'Effect of his said Requeste, and thereupon to geve his said Grace such Advertisement and Counsell, as shold accord with thair Trouthis and as thai ought bi their Allegiaunce geve to his Highnes in this behalf.
Whereupon, the same Day, Yer, and Place, the said Lordys, Statis, Counsellours, and Capitaignes, in oon hole Counsell assembled, at the King's Requeste, Suadyd and Debatyd among thaim the said Articles of Peas by good, ripe and sad Deliberation, and therupon by oon Assent put thair Reasons and reasonable Motions of thair Reasons in Wrytyng, and the same Wreting (the Tenour wherof her ensewith) put up unto the King's said Grace for thair full and hole feithfull and trew Counsell in that behalf.
First, it is Reasoned, Comyned, Persuadyd, Debatyd, and Considered, by us Lordys and Capitaigns under wreten, that for the fair Advawncement of the Season of the Yer to the point of Winter, which as wel for the Moistnes and Coldnes of that Season, as for the long Nightes of the same, is and every Day mor and mor must nedys be an importunable Annoyaunce, not onely to the King's Person, us his said Lordys and Capitaigns, but also his hole Host in this present Armye assembled, the greate and outrageous Cold of this Winter Season lyklyhede also of lak of Vitaile, forsene that the principall Provision as wel therof as of the King's Ordinaunce and Artillerye must nedys come by Sea from Englond and Caleis, and for the greate Rage and Tempestis of Wyndys and Wethers, cannot come covenablie to the Host in tyme of Necessitie, and other infinite Occasions, by which dailie the People in greate Multitude of the King's said Host fall into divers greate Seknesses and many utterlie Perish alwey considred; it is therfor thought bi us most necessarie, hehofull, and honorable to the King's said Grace t'accepte such honorable Peas as may be had, and in consideration of the Premisses it is thought to us all that his Grace may, without any Denigration of his Honeour Royall, and shold Take and Accepte the said Peas offred by the Lord Querds in the Freinsh King's behalf.
Item, it is thought to us that it shal be to the King's Grace as greate Honeour as ever King of Englond had of his Enmyes to take the said Peas; Considred alwey that the Somme of Money, graunted in Groce as in the said Articles is comprised, farr excedith any Somme, at any time, befor this Season, in any Princes Daies Paid or Graunty'd out of Fraunce; Considred also that of the nown accepting, and refusaile of the said Peas, great Grugge, Murmur, Displeasur, and Obloquye, not onlie in the King's Hoost, but also among the hole Bodye of Comunaltie of Englond, might ryse of so Honorable Peax offred forsakyn.
Item, it is greatlie considred by us to be greatlie to the Kyng's Honeour, when it is Remembryd that, by the comyng of his Grace into thies Parties, the Town and Castell of Scleux, which not onlie stode long in Rebellion to th'Archduk, but also in greate Noyaunce to all Marchaunts Adventurers of Englond both by Land and Water, be now by his Grace reducyd unto good Obeisaunce, and without whom not onlie the Town and Castell of Sclux, but divers and many other greate Fortressis and Piles in Picardye, which wer also in long continued Rebellion, and be now reducyd to the said Archduc's Obeisaunce, to the King's greate Honeour, Assurance of his Town of Caleis Marchis and Palys of the same, had in short time ben utterlie Freinsh, to the greate Jeopardie of the said Town, Marchis and Palis, and extreme Fordoyng of all Entiercours and Feate of Marchaundise of Englond into the Cuntres of Flaunders, Zeland, Brabant, and Holand.
Item, it is also greate Honeour to the King that, wher his Grace, by a Generall Request of the Substance of his Counsellours of Englond, at his Palois of Westminster, to his Grace made, was instantlie required and prayde to Respite this present Journey untill a moor covenable Season, and that such his Allies, as had promised his Grace of mutuall Ayde, wer in a moor Redines; Which notwithstanding his said Grace, peysing above all thing his Promises made to the King of Romayns and also to his Subgietts in his Realme; hath to his greate Honeour observyd and fermlye kept his said Promises to his greate Cost and Charges, and not onlie that but greately Jeopartid his Person Royall, making Werr and redy to geve Batell to his Enmye in Person, upon trust that the King of Romayns and other the King's Confederatys and Allies, according to thair Promises, shold have done the same; Which in dede have not observed thair Promises: Wherethorogh the King's Grace may honorablie take the said Peas with the Freinsh King, and lay reasonablie the Causes of nowncontinuaunce of his Warris, and th'accepting of the said Peas, in the said King of Romayns and other his Allies, which, as is aforsaid, have not observyd in any behalf thair Promises to his said Grace oughten times mad.
Item, it is Comyned and known for Trouth that the King's Grace may not with so litle Payn continew his Warris in thies Cuntres, as King Edward dyd in his time; For he, in the time of his Warre moved in thies Parties, never entred any Town, Castell, Pile, Fortresse, or other Place that at that time was possessyd by the Freinsh King: And he then in the most covenable Season of Somer had the Dukys of Burgoign and Bretaign to his speciall Ayde, beside other greate Lordys of the Realme of Fraunce: He had also the said Duc of Burgoyn in the Feld with him, redy preparyd with his greate Power and Puyssaunce to his Assistence and Aide in all that to him was possible: And had therbye, to his greate Comfort, Discharge of all Jeopardies, and Ease of his Armye, all the Castellis and Townes greate and smale of all Picardie to his Use and Will evyn to the Ryvier of Somme, by which he and his Armye wer oute of all noyaunce, in greate Pleaseour, without peyn of Cold or other Lak, and out of Jeopardie of any Bataile or Warr to him made or offred; in which case the King's Grace now is not; For his Grace, as sone as he was out of his Pale of Caleis, entred the Grownd possessyd by his Enmye, withoute any Frynd to him ther fand but onlie such as he brought with him of his Subgettis; Wherfor the President of King Edward's avawnsing in thies Parties may be oon Example to the King's Grace; Considring that his Grace hath not onlie entred, as is aforsaid, this Cuntre possessyd by the Freinsh King, repleanyshed with his Subgettis, makyng dailie effectuall Warr agenst his Grace, but also Rasid and Diffasyd divers of his Townes, as Ardye and Mountorye, with other, and also advawnsyd himself xx Myle and moor into his Land as fair as Boleign and beyond, abyding ther by the space of xxiv Daies Bataile of the hole Realme of Fraunce.
Item, it is thought also that all the Lordys Statis and Comunialtie of Englond shall of Reason have greate Cause to be content with the said Peas, and geve speciall Thankis and Praisings to the Kingis Grace and his hole Armye for his greate Peyn in this behalf sustayned, and for th'accepting of the said Peas, bi which such Trobles, as of long have grown and dailie encreasyd by the Warre to the greate Hurt and Noyaunce of all the hole Realme, shal be now Advoydid and utterlie Extincted by th'accepting of the said Peas: And also all maner of Exactions of Money, other then before this, to this Voyage, have ben graunted to the Kingis Grace (which of necessitie if Warr shold continew and the said Peas be refusyd, must have ensewyd in Englond) shall also now be forborn to the greate Pleasur of all his Comyns thorogh his Realme.
Item, in that the Kingis Grace shall also, in the said Peas, compris the King of Romayns and th'Archduk, it shal be to the Kingis great Honeour, for not onlie therbie the said Archduc shal be in quietful Possession of his Cuntres from hensforth during the said Peas, but also the kingis Subgettis, which shall resort to the Archdukis Landis t'exercise feate of Marchaundies, shal be out of such Jeopardies, Vexations and Trobles as thai have ben in long time past by the Warr now extincted.
Item, we have also in our Considerations greatelie that, wheras the Kingis Grace and all We, befor our approching unto the Town of Boleyn, supposid, uppon the Reaportis of many Folkis, that the said Town had ben but a Feble Fortified Town easy t'aproch and obtaign, and bi Estimation might have be getin within three or four Daies at farthest; so it is incertaign that, upon the Fame of the Kingis personal Descent into thies Parties, by the space of a Yer hollie and moor, the said Town of Boleyn hath ben so Stronglie Fortified in his doble Minaylys, Cownterminis, Castellis, Touris, Bulwerkis, dry Deches and watred, and also so plenteuouslie with greate multitude of Gunnes Gunpowdre with Shot for the same, with all maner of Artillarie, Capitaingns, and Men of Warre the best of Fraunce, furnysshed and preparid, that at this Day it is oon of the strongest Townes of Picardye; so that it is not Prennable without long Continuance and Jeopardie of Losse of greate Number of Men:
And, sith it is so that, for thies Considerations and other in the forsaid Articles contaigned, when the verey profoundnes of Winter and his Stormy of Cold Wynd and Wether shal approch, the Kingis Grace in th'advoying of his awn Jeopardie and utter Confusion of the Substance of his Armye, of necessitie shal be constrayned to Levye his Siege now to the said Town layde, and to Retreate his Hooste which shold not be honorable to his Grace; Wherfor in especiall We think it most expedient to his Grace t'accepte the said Peas, and so to Levye by Composition of Peas the said Siege, which shall utterlie advoyde all Reproch, and conserve greatelie his Honeour.
Item, for the forsaid and many other greate and urgent Causes which wer her to prolix to compris, it is thought to all us Lordys and Capitaignis, that the Kingis Grace may not by any possibilitie continew his Warris this Winter Season, withoute extreme Jeopardie of his Person Royall, all us his Lordys and Capitaignes, and also hiis hole Hoost and Armye, which wer and shold be the greatest Sorow and Hevinesse that ever come to the Realme of Englond, and utter Desolation and Subversion of the same, which God forbede.
In Consideration wherof and the Premisses, by good Deliberation ripelie Comyned, Reasonned, and Debatyd among us, We All and every of us humblie besechen and requir the Kingis Grace tendrelie to take to his gracioux Consideration the greate and inevitable Perplexites and Jeopardies in this behalf lyklie t'enseu, and for th'Exchewing of the same and Conservation of his Person Royall, Us his Subgettis and trew Liege Men, and also of his Realme of Englond, t'Accepte the said Peas; which undowbtedlie, every thing in this behalf peysid as it ought to be, shal be as honorable Appointment as ever was takyn by any King of Englond: And if herafter it shall happin that any Person within the Realme of Englond, of whatsoever Estate, Degree, or Condition he shal be of, have of the said Peas any maner of Obloquye, Displeasur, or Grugge, We the said Lordys, Statis, Counsellours, and Capitaigns, and every of us Promise that we shall, to th'utterest of our Powers, at all times, Mayntaign, Uphold, and Afferme the same Peas to be takyn at our instant Request, divers and many times to the Kingis Grace made; For th'Assurance and Witness wherof all we the said Lordys, Statis, Counsellours, and Capitaigns upon our Faith promise that we shall that perfourme and doo, and the said Acceptation of Peas, at our Request takyn, as far as to us shal be possible Ratifie, and over that as is aforsaid We have subscribed this Wreting, by Us put to the Kingis Grace, with our awn Handys and Namys, on the Fest of All Halous, the eighth Yer of the Reign of our said Soveraign Lord.

Item, Conventum & Conclusum est quòd Naves, Nautae, Mercatores, & alii Subditi utriusque Principum praedictorum per Terram, Mare, & Aquas dulces Euntes, Conversantes, Navigantes, Naufragium passuri & Permanentes Tractentur & Recipientur, prout melius Tractari & Recipi consueverint in temporibus aliarum Treugarum prius inter Scotiae & Angliae Reges & eorum Regna initarum & conclusarum.
Item, Conventum & Conclusum est quòd omnes & singuli Depraedatores, Malefactores, & Praesentium Treugarum Violatores punientur asperius eisdem formâ & modo quibus antiquitùs puniri consueverunt, & si aliquis ex Subditis alterius Partium praedictarum quicquid depraedatus fuerit seu attemptaverit infra Marchiam aut Terram alterius Partis, & post Depraedationem hujusmodi seu Attemptatum Fugiendo revertatur ad Marchiam aut Terram illius Partis cujus est Subditus, licebit illi contra quem sic attemptaverit in recenti vel infra Sex Dies computandos a tempore Delicti sic attemptati vel commissi, auctoritate praesentis Ordinationis, absque aliis Literis vel salvo Conductu, prosequi illum Malefactorem, ipsum sic protequendo intrare salvò & securè Marchias & Terram in quam idem Malefactor se contulerit; dummodò, quamcitò hujusmodi Marchiam sive Terram hac de Causa intraverit, adeat aliquem Virum bonae Famae & Opinionis illaesae, habitantem infra Marchiam quam sic intrat, & eidem declaret Causam Introitûs sui (videlicet) ad Prosequendum Depraedationem suam, describat & specificet idem quibus Bonis, Catallis, vel Rebus Depraedatus fuerit, ac insuper requirat eundem quòd quamdiu hujusmodi Prosecutionem suam fecerit, secum eat, ut super Factis suis tempore dictae Prosecutionis possit, cùm requisitus fuerit, super hoc Testimonium perhibere Veritati.
Item, Conventum & Conclusum est quòd neuter Principum praedictorum auxiliabit aut Opem feret quovis modo notoriis Rebellibus Hostibus, vel Inimicis alterius, ad Nocendum alteri eorumdem, vel ipsorum Regnis, Dominiis, Terris, aut Subditis, & si de facto aliquis Rebellis vel Inimicus unius vel alterius Principis existens vel futurus in Regno, Terris, vel Dominiis alterius eorumdem tempore quo ibidem extiterit, aliquid fecerit per Terram, Mare, vel Aquas dulces, ad Dampnum alicujus eorundem, vel Regnorum, Terrarum, Dominiorum, vel alicujus Subditorum suorum, tunc ille Princeps in cujus Regno, Terris, vel Dominiis talis Rebellis, Hostis, vel Inimicus sic commisit, & ibidem postea receptus fuerit, Dampnum illum Reparari faciat & Resarciri, ac si proprius Ligeus & Subditus ejusdem hujusmodi Dampnum commisisset aut perpetrâsset.
