Case type: Bond; Real action / rents / damage to real estate

Pleading: John Wellesborn states that on 3 August 1458 Walter Spencer made three bonds with him in London, each in £10, payable at Michaelmas 1459, 1460 and 1461. However, WS has not paid these debts, to his damage of £20. He shows the bonds in court.

Pleading: WS states that before the making of these bonds, there was an agreement between him and JW that WS would oblige himself to JW by means of three bonds, each in £10, under certain conditions to be given in those bonds, namely that if, before 24 June 1459, WS should place a certain Richard Beauchamp in seisin and possession of a messuage in Gloucester, to hold to him and his heirs in perpetuity, then the bonds shall be cancelled. WS states that at the time of the making of the bonds he was a man of little learning, and the bonds were read to him in English as containing this condition, and he, believing that they contained this condition (when they did not actually do so), sealed them. He therefore says that these bonds, not containing these conditions, are not of his making. Parties on country, jury here at quindene of Trinity.

Term: Easter 1463
County: London
Writ type: Trespass (force and arms)
Damages claimed: £20
Case type: Assault; Imprisonment

Pleading: Thomas Hunderpound states that on 1 July 1461 Christopher Wenyngton forcibly assaulted him in London and imprisoned him for two hours, against the law and custom of the realm, against the peace and to his damage of £20.

Pleading: CW denies force and arms and wounding. Parties on country. Concerning the rest, he states that TH ought not have his action, stating that on that day, before the time of the supposed trespass, he was in London, at the Bread Street compter located in the parish of All Hallows Bread Street, before John Lamberd, then one of the sheriffs, where he affirmed a certain quarrel against TH, as Thomas Houndrepound draper, on a plea of trespass (pledges named), where he sought process according to the custom of the city. According to that custom, Roger Furbore, then a sergeant-at-arms in the city, was ordered to attach TH, and have him in court before the sheriff at the Guildhall on the following Friday to answer CW. By virtue of this order, later that same day RF went to the parish of St Edmund, where TH was, in order to arrest him, and CW went with him, in order to identify TH, as RF did not know him. Thus, by virtue of the order, at the time when the alleged trespass occurred, RF went up to TH and calmly laid his hand on him, arrested him and took him into custody for the said two hours, as was right. This is the event which TH claims against CW. He seeks judgment.

Pleading: TH states that on that day, before the quarrel aforementioned, at 1pm, CW assaulted him in London and imprisoned him until 3pm, when he brought the case in the compter before the sheriff, and afterwards arrested him by virtue of the sheriff's order.

Pleading: CW states that he is not responsible for any trespass before the time of the aforementioned case in the Compter. Parties on country, jury here at octave of Trinity.

Term: Easter 1463
County: Middlesex
Writ type: Debt (bond)
Damages claimed: 4m
Case type: Arbitration; Bond

Pleading: Roger Philips, Thomas Luyte and William Hille state that on 6 May 1459 Henry Ayssheton made a bond with them in Westminster in £4, payable on 1 June 1460. However, HA has not paid this debt, to his damage of 4m. He shows the bond in court.

Pleading: HA states that there was formerly lawsuits between himself and RP, by which they agreed peacefully that HA would make a certain bond with the three plaintiffs in £4, under the condition that if HA stand in the arbitration of John Grey and William Lyte concerning all disputes outstanding between them, then the bond shall be cancelled; otherwise it would remain in force. HA states that at the time of the making of the bond he was a lay man of little learning, and the agreement was read to him in English as containing this condition and he, believing that it contained this, sealed and delivered the bond. He therefore states that this bond, not containing this condition, is not of his making. Parties on country, jury here at quindene of Trinity.

Pleading: William Bury states that on 28 September 1462 Thomas Acton, together with John Clerkeson, Thomas Austyn, John Bradwell and Richard Vowel, and other unknown malefactors and breakers of the king's peace, forcibly lay in wait to kill him in Camberwell, assaulted him there and imprisoned him from that day until 7pm on the following Saturday (2 October). He was then taken to Rotherhithe, where was again assaulted, and imprisoned until 3pm on the following Monday (4 October). Pleading: [continued at Michaelmas 1463, rot 359] TA denies force and arms and acting against the peace. Parties on country. Concerning the rest, he states that WB ought not maintain his action, since, protesting that the goods and chattels were not of such great value as WB claims, he states that after the trespass was supposed to have happened, namely at 4pm on the said Monday, there was an agreement between him and WB at Rotherhithe, by the mediation of Thomas Acton senior and William Shirley, that TA junior should give to WB three gallons of beer in satisfaction of this trespass and all other trespasses and offences committed by TA against WB before that time. He duly gave WB these three gallons of beer immediately, which WB accepted.

Pleading: WB states that he did not have any such agreement with TA junior as claimed. Enquiry by country, jury of Rotherhithe here at quindene of Hilary.
