Hodie 3a vice lecta est Billa, intituled, "An Act for vesting the settled Estate of Stephen Tress, in the County of Sussex, in Trustees, to convey the same, pursuant to an Agreement for the Sale thereof; and for laying out the Money in the Purchase of other Lands and Hereditaments to be settled to the like Uses."

The Question was put, "Whether this Bill shall pass?"

It was resolved in the Affirmative.

Wadhurst Road Bill.

A Message was brought from the House of Commons, by Mr. Marsham and others:

With a Bill, intituled, "An Act for enlarging the Term and Powers of an Act of the Fifth Year of His present Majesty, for repairing and widening the Road leading from the Town of Wadhurst in the County of Sussex, to the Turnpike Road at Lamberhurst Pound, and Pullen's Hill, in the County of Kent, and from the Top of Pullen's Hill through the Parishes of Horsmonden, Marden, Yalden, and West Farley, to West Farley Street in the said County of Kent;" to which they desire the Concurrence of this House.

Kipping's Cross Roads Bill.

A Message was brought from the House of Commons, by Mr. Marsham and others:

With a Bill, intituled, "An Act for enlarging the Term of an Act of the Fifth Year of His present Majesty, for repairing and widening the Roads leading from the Turnpike Road at Kipping's Cross in the Parish of Brenchley, in the County of Kent, through the Parishes of Brenchley, Horsmonden, and Goudhurst, by the left Hand Side of Iden Green to the Turnpike Road on Wilsley Green, in the Parish of Cranbrooke, and from a Place near Goudhurst Gore, through the Parish of Marden to Stile Bridge in the said Parish, and from Underden Green in Marden aforesaid, to Wansbutt's Green in the County of Kent;" to which they desire the Concurrence of this House.

The said Two Bills were, severally, read the First Time.

Dunstable Road Bill.

Beaumont's Petition referred to Judges.

Upon reading the Petition of Elizabeth Beaumont Widow, for herself and on the Behalf of Elizabeth Maria Beaumont, William Francis Beaumont, Mary Ann Beaumont, Thomas Robert Beaumont, Samuel Wright Battel Beaumont, Susannah Beaumont, Thomasine Beaumont, and Ann Beaumont, her Children, who are all Infants under the Age of Twenty-one Years, praying Leave to bring in a Bill for the Purposes in the said Petition mentioned:

It is Ordered, That the Consideration of the said Petition be and is hereby referred to the Lord Chief Baron of the Court of Exchequer and Mr. Justice Ashhurst, who are forthwith to summon all Parties concerned in the Bill, and after hearing them are to report to the House the State of the Case, with their Opinion thereupon under their Hands, and whether all Parties, who may be concerned in the Consequences of the Bill, have signed the Petition, and also that the Judges, having perused the Bill, do sign the same.

Bruce against Dundas:

Upon reading the Petition and Appeal of James Bruce of Kinnaird Esquire, complaining of Two Interlocutors of the Lord Ordinary in Scotland, of the 23d of February and 10th of March 1785; also of Three Interlocutors of the Lords of Session there, of the 29th of November 1785 and 1st and 18th of February 1786; and also of Two other Interlocutors of the said Lord Ordinary, of the 28th of February and 4th of March 1786; and praying, "That the same may be reversed, varied, or amended, or that the Appellant may have such other Relief in the Premises as to this House in their Lordships' great Wisdom shall seem meet; and that Thomas Dundas Esquire of Fingask, may be required to answer the said Appeal:"

It is Ordered, That the said Thomas Dundas Esquire may have a Copy of the said Appeal, and do put in his Answer thereunto in Writing on or before Tuesday the 18th Day of April next; and Service of this Order upon the said Respondent, or upon any of his known Counsel or Agents in the Court of Session in Scotland, shall be deemed good Service.

Hamilton to enter into Recognizance on said Appeal.

The House being moved, "That William Hamilton of Lincolns Inn, in the County of Middlesex, Esquire, may be permitted to enter into a Recognizance for James Bruce Esquire, on account of his Appeal depending in this House, he residing in Scotland:"

It is Ordered, That the said William Hamilton may enenter into a Recognizance for the said Appellant, as desired.

Fraser against His Majesty's Advocate.

Upon reading the Petition of Archibald Fraser Esquire, Appellant in a Cause depending in this House, and of His Majesty's Advocate, Respondent thereto; setting forth, "That the Matters at Issue by this Appeal still being under Treaty for Settlement, and the same being nownearly concluded," the Petitioners pray their Lordships, "That the Hearing of this Cause may be postponed till after all those already appointed:"

It is Ordered, That the Hearing of the said Cause be put off till after all the Causes already appointed, as desired.

York Buildings Co. against L. Elphinstone.

A Petition of the Governor and Company of Undertakers for raising Thames Water in York Buildings, Appellants in a Cause depending in this House, to which John Lord Elphinstone is Respondent, was presented and read; setting forth, "That when their Lordships were pleased on Tuesday last to reject the Petition of the Appellants to delay the Hearing of this Cause for a Fortnight, the Petitioners' Agent by the Post of that Evening wrote to Mr. Mackintosh, the Governor of the Company at Edinburgh, informing him thereof, and requesting he would immediately come here with all the Papers and Materials for the Hearing of the Cause, if he had not dispatched these before that Time; that the said Letter would arrive in Edinburgh on Saturday Forenoon, and the Petitioners' Agent apprehends that all these Papers would be dispatched by the Post of that Evening, and that they will arrive here on Wednesday the 22d Instant; and he also apprehends, that Mr. Mackintosh, who he believes intends to argue this Cause before their Lordships, will be here on that Day, but till these arrive, the Petitioners are without Counsel and without Materials to lay their Case before their Lordships, and they flatter themselves that under these Circumstances their Lordships will not deny them the Delay of one Week to prepare for the Hearing, and that they will postpone the Cause till Thursday the 30th Day of March, which is a Bye-Day: That if their Lordships continue to deny them this Indulgence, they cannot appear at the Bar on Wednesday next, and the Cause must proceed Ex-parte, in which Case they will be laid under the Necessity of applying to their Lordships for a Re-hearing of this Cause, which, under all the Circumstances, they flatter themselves would not be denied them: But to prevent such disagreeable Consequences to them, and future Trouble to their Lordships," the Petitioners humbly pray, That the Hearing of this Cause may be postponed till Thursday the 30th Day of this instant March."

And thereupon the Agents on both Sides were called in and heard at the Bar:

And being withdrawn;

Ordered, That the said Petition do lie on the Table.

The Order of the Day being read for the House to be put into a Committee upon the Bill, intituled, "An Act for punishing Mutiny and Desertion, and for the better Payment of the Army and their Quarters;" and for the Lords to be summoned:

And the Lord Scarsdale reported from the Committee, That they had gone through the Bill, and directed him to report the same to the House, without any Amendment."

Shop Duty Bill.

The Order of the Day being read for the House to be put into a Committee upon the Bill, intituled, "An Act to explain and amend an Act of the last Session of Parliament, intituled, "An Act for granting to His Majesty certain Duties on Shops within Great Britain;" for repealing several of the Duties granted by the said Act; and for granting other Duties in Lieu thereof."

Ordered, That the House be put into a Committee upon the said Bill To-morrow.

Voorberg (Dutch Indiaman) Bill:

A Message was brought from the House of Commons, by Mr. Eliot and others:

With a Bill, intituled, "An Act to enable the Persons therein named to provide proper Places on Shore for the Reception of the Crew of the Voorberg Dutch East Indiaman, forced by Stress of Weather into the Port of Dartmouth;" to which they desire the Concurrence of this House.

Read three Times and passed:

York Buildings Company against Ld. Elphinstone.

Counsel (according to Order) were called in to be heard in the Cause, wherein the Governor and Company of Undertakers for raising Thames Water in York Buildings are Appellants, and John Lord Elphinstone is Respondent, being an Appeal from an Interlocutor of the Lords of Session in Scotland of the 28th of June 1785.

And the Lord Advocate for Scotland appearing as Counsel for the Appellants, and having prayed a short Delay of the Hearing of the said Cause, alledging, That he had received the Papers for the Appellants' Case but the Evening before, and therefore was not sufficiently prepared to argue it, though he had read enough of them to be of Opinion that the Appellants had Merits, and that the Appeal was not brought merely for Delay:"

The Counsel were directed to withdraw.

Ordered, That the Hearing of this Cause be adjourned to Tuesday the 4th Day of April next: And it is further Ordered, That the Appellants do pay or cause to be paid to the said Respondent the Sum of Fifty Pounds for his Costs of the Day.

Hodie 2a vice lecta est Billa, intituled, "An Act to continue and render more effectual, so much of an Act, passed in the Twenty-seventh Year of the Reign of His late Majesty King George the Second, as imposes a Duty on Ships and Vessels anchoring in the Harbour of Alloa, in the County of Clackmannan, for repairing the Pier of the said Harbour."

Ordered, That the said Bill be committed to the Consideration of the Lords Committees aforenamed.

Fraser et al. against Hall, Appellants Petition to put off Hearing, rejected.

A Petition of Alexander Fraser of Strichen Esquire, and others, Trustees of the Estates of General Fraser of Lovat deceased, Appellants in a Cause depending in this House, to which William Hall of Whitehall Esquire, is Respondent, was presented and read; setting forth, That this Cause being set down for Hearing by the Respondent, now stands very early on their Lordships' Paper: That the Appellants being desirous to forward their Appeal, prepared their Case, which is settled by Counsel, but the Honourable Mr. Fraser being advised, that though the Respondent has always declined to accommodate Matters with the Appellants in an amicable Manner, there is a Probability of his personal Applications being more regarded, lately wrote to the Respondent on the Subject, and requested the Appellants' Agent to apply to their Lordships to put off the Hearing for a short Time, in order to give him an Opportunity of seeing or hearing from the Respondent: That the Appellants being unwilling to preclude Mr. Fraser from endeavouring to effectuate what they have frequently attempted without Success, do upon that Ground make the present Application;" and therefore praying their Lordships, "To put off the Hearing of this Cause, until the first open Day after the Easter Recess, or such other Day as their Lordships shall appoint."

And thereupon the Agents on both Sides were called in, and heard at the Bar, and being withdrawn:

Ordered, That the said Petition be rejected.

Bills passed by Commission.

The Lord Chancellor acquainted the House, "That His Majesty had been pleased to issue a Commission to several Lords therein named, for declaring His Royal Assent to several Acts agreed upon by both Houses of Parliament."

Then Three of the Lords Commissioners being in their Robes, and seated on a Form placed between the Throne and the Woolsack, the Lord Chancellor in the Middle, with the Archbishop of Canterbury on his Right Hand, and the Lord Sydney on his Left, commanded the Gentleman Usher of the Black Rod to signify to the Commons, "The Lords Commissioners desire their immediate Attendance in this House to hear the Commission read."
