Instructio pro Ambassiatoribus in Tractatu saepe-memorato, & super Partitione Franciae.
Instruccion yeven unto the moost Reverend Fadre in God Johan Archebishop of York, Johan Duc of Norffolc, Thomas Bishop of Norwich, and Thomas Bishop of Seint Davies; Th'Erles of Stafford and Oxenford; The Lords Bourgchiers and Hungreford, and other sent with theim to the Convencion of Trete of Peas to be holden in the Marches of Caleis.
An
. 17. H. 6. Bibl. Cotton. Tiber. B. 12. Fol. 197. B.
First, the said Ambassadours shal, in suche manere and forme as shal be thought covenable, aske and opene, as for the moost reasonable Mene of Peas, that the Adverse Partie cesse and forbere to yeve, from this time forth, any Let, Trouble, or Empechement unto the Kyng in Occupacion and Rejoisyng of his Coronne and Reme of France: And that he suffre the Kyng peasible to Rejoice hem, with al thaire Appurtenances, as him oweth of Ryght to do; and Require hym and theym in his Name that he so doe:
And this Request they shul Enforce, so as shal be thought reasonable to hem to be do, not in puttyng in Question ner in Disputes on the Kyng's Original Title to his said Coronne and Reme of France, the whiche his Noble Progenitours, namely Kyng Edward his Gret Aiel, and the Kyng his Fadre, both of moost Noble Memoire, by as gret Advise and Counseil as coude be taken there upon, had for Decided and Undoutid or they toke upon hem to clayme the said Coronne and Reme, and namely or they proceded to the Werre therefore:
And this Request the said Ambassatours shall mowe especially Enforce, by the Jugements of God that have be yoven, in many and diverse grete Batailles, had in and for his said Clayme and Right: And also by th'Appointment and Accorde made upon the same bitwix the Kyngs, of moost Noble Memoire, his Fadre and Aiel; and hereupon they shul dwelle as long as it shal be thought to theim to be do:
And, if th'Ambassatours of th'Adverse Parte straunge hem to entende to this Request, the Kyng's said Ambassatours shal after, under Protestacion to be made by hem in forme accustumed, passe forther, and say; That the Kyng, willyng, as he evere hath willed so, to put hym in his devoire to God and to the World, that it shal noght be resonable mowe be said but that he desirith the Peas, wol, for the good of the said Peas, rather thanne lakke it, bye it and departe largely with his saide Adversaire of Cuntrees, Landes, Lordshippes, and Possessions belonging to the Kyng and his said Coronne of France: And, condescending to th'Especialte, shal offre to his said Adversaire Landes, Lordshippes, and Possessions beyonde the Ryvere of Lyre, to have to him and th'Eires of his Body (that is to say) the Contre of Langdocke, and other Landes and Lordshipps beyonde the said Ryvere, belonging to the said Coronne, to the Valeu, in Demayne and Revenue Ordinaire and Extraordinarie, of xxMil. l. Yerly, to be holde of the King, as in the Right of his said Coronne of France.
Item, if that other Partie wol nat Contente hem with the said Offre, ne Condescende to the Peas thereby, the moost Reverent Fader in God my Lord the Cardinal shal mowe, as a Prelat of the Chirche, and as a Mediatour and Sterer to the Peas, Remembre howe thise Werrys, that have be made in and for the Title and Claime of the Coronne of France, betwix the Princes that have strived thereupon, have endured this Hundred Yere and more: And that there haan be moo Men slayne, in the Continuance of hem, of oo Nacion and other, than ben at this day in bothe Landys, and so much Christien Blode shede, that it is to grete a Sorow and an Orrour to Thinke or Here it; Addyng that, in al the Erthe Cristyn and Hethyn, be not so mony Noble Princes, Knightes, and Squires, and Men of Fete, as hav perisshed in the same Werres; by force of whiche Men, and they ne had be so labored and consumed in the said Werres, the Cristen Faith and Beleve, the whiche is now so gretly lassed and decressed as it is weleknowe, and the Remes and Cuntre, that had received it and were grounded in the same, now pervertid, might and shold not oonly have be defendid and kept, but the said Cristen Feith and Beleve had, by lyklyhode of reson, be dilated thorgh the World: So that this rigorous and extreme continuance and abiding upon the said Clayms and Querele on bothe sids hath, by Manne's probable Consideracion, be and is the cause as wele of the said sorowful diminucion and decresse of the said Cristene Beleve, as of the lettyng of th'encresse and dilatacion therof, and so be cause of Perdicion noght oonly of th'innumerable Menne's Bodys that haan perished by th'abuse of the Werre, and of the Wretchednesse and Synne that hath ensued thereof, but also of infinite other Menne's Soules, that shold noght have perished, but be saved by the mene of continuance and dilatacion of the Cristen Beleve, if this Obstinacie had noght be; of the whiche Soules ich was more precious thanne al th'Erth.
With this the said Princes may be meved to considre, that either this Werre must evere endure and nevere have ende, that God ne wol, and they that wolde that they sholde were cursed of God and in evel tyme borne, either if it shal have Ende, it must have Ende by oone of two Weyes; that is to sey;
Eithre by Fine Force, so that oon of theim distroie and subdue hoolly that othre, that were grete pitee, consideryng the Noblesse and Puissance of hem, and that of hem hangith in grete partie th'Estat and Might of Cristiante,
Eithre it must ende by good Appointment and Accorde, the whiche is the goodly Ending thereof, and wold God that it so doo many Yeres a goo; and yet better is that it so do soon, thanne abide longer.
Among other things is, that owe to meve the Princes to desire that it so do, oon grete thing is the consideracion of the Nyghnesse of Blode, that they stande inne ich of hem to other, and ich of hem to al the grete Princes of bothe Lands, for the whiche cause theim owid, by the Lawe of God and Nature, and by the Ordre of Charite, ich of theim to desire and wille the good of other, and to peine hem to th'Appesement of thise Werres that be so detestable and contraire to Nature and to al Reson.
And, over this, the Princes of bothe Parties owe to considre that God made noght his People in the said Two Remes ner in other for the Princes, but He made the Princes for his Service and for the Whele and Behove of his People (that is to say) to Reule theim in Tranquillite (namly) by the mene of deue Ministracion of Justice: So that they, so Reuled, shal mowe restfully and peasible serve hym; the whiche thise Werres suffrith hem noght, ne shal suffre hem, but lette hem to doo, whiles they continue and endure.
And by thise Meannes, and other suche as my seid Lords the Cardinales great Wisdam wol avise, he shal mawe Exhorte and Stire both Princes to lyfft upon Consideracions and her Sight to God, and to shewe the Tendernesse and the Zele that they bere to the Savacion and Eschuyng of Dampnacion of Menny's Soules, and to the Relief and Exaltacion of the Cristen Feith and Beleve: Also to shewe the love that they, as Cristen Princes, have and bere to tho that be hir Subgetz and other that be Christen Men, the whiche by the Lawe of God them owed tenderly and brotherly to love: to shew also, noght in Words oonly and Writing, but in Herts, the Compassion that they have of sheding of Cristen Blode; and the Pite that they haan upon the Pouer and Innocent People that so long haan suffred, and so grevously and importably haan be oppressed with the said Werres; mevyng hem to prefer so grete Goods, and th'Eschuyng of so grete and innumerable Mischiefs and Inconveniences, bifore the Rigour and Hardnesse of her propre Entents and Desires.
Over this, the said Princes may be meved to considre that the principal cause, that should meve any of hem to desire the said Coronne of France, shold be noght Ambition of Worldly Worship, ner Covetise of Erthly Dominacion and Richesse, but the Service that he sholde entende to do to God in Governance of his People in the said Reme:
And, with this, to considre that the Cuntre, comprissed within tho that be now called the Lands and the Limits of the Reme of France, be grete and populus, and have noght at al tymes be hooly under the Governance of oo sool Kyng, ne it is noght of the necessite of the Lawe of God or of Nature, ne also of the necessite for the behoveful Governance thereof, that it so be; but, as wele bifore Carlemeyn as after, the said Cuntre and the Governance there of hath be departed, so that tother while Thre, otherwile Foure Kyngs, haan ben therein at oones, ich of hem havyng Governance of his Party, and noon of hem subgit to other:
And, for as muche as eithre of the said Parties may be stirid to departe from notable parte of his Clayme, and to condescende to a Moderacion and a Mene therein, rather then of durete and lakke of Pite to suffre the said Mischiefs and Inconveniences to growe or longer to continue; letyng hem wite that if they, that may with thaire towarnesse so acquite hem to God and to his People, to be cause of so grete goods as shal ensue of cessint of these Werres, and Eschewe so manifold Harmes and Inconveniences as thay knowe and se wele shal elles ensue, strange hem and wol not so do it, thay shal have to mech to answere to God, and al tho that counseile theim thereto.
And, of this Exhortacion shal the Kyng's Ambassatours take occasion to procede further in Offres, and to say that, att Reverence of God and of Holy Chirche, and for th'Exaltacion, and Vancement, and Assurans of the State of the Cristen Feith and Beleve, the whiche, havyng Consideracion and Regarde to the litel Nombre of Cristen Folks, and to th'Infirmite and Weyknes thereof causid of Intestine Division and Werres, standith at this Day in grete Gepardie and Perille, and as destitute of Protection and Defense ayenist th'Enemys and th'Impugnatours thereof: And, for the Causes and Consideracions nobly and openly aleggid and declared in the holy Exhortacion made by the Moost Reverent Fader in God &c. We, th'Ambaslatours of the Kyng our Soverain Lord her &c. make to Charles his Adversarie in France the Offre that folewith; that is to say,
That the Kyng, our said Soveraine Lord, wol and shal suffre, agre hym, ant consente that, without any Contradiccion, Empechement, or Lette of him or of his Heirs, his said Adversarie shal have, holde, and rejoice to hym and to his Heirs al the Parte of France, belonging to the Coronne of France, that is beyonde the Rivere of Leyrs; noght comprehending thereinne, but expresly reservyng to the Kyng and to his Heirs, the Duchie of Guyenne, the Counte of Peytowe, and generally al that the Kyng's Noble Progenitours, Kyngs of England, for the tyme beyng, have, bifore thenne the Coronne of France descended or belonged unto hem, be Enherited inne and Possessed of.
And, after this Offre thus made, the Kyng's said Ambassatours shal mowe by Processe enlarge the said Offre, refervyng no more to the Kyng, be yonde the forsaid Ryvere of Leyre, but that the Kyng now standing, or shal stande Possessid of at the Day of th'Agrement of th'Adversaire to the said Offre:
And in this Offre the Kyng's said Ambassatours shal Dwel, and Extolle it, and magnifie it by Declaracion of the Multitude of th'Archebisshopriches, Bishopriches, Citees, Townes, and Countrees comprised in the said Offre.
And, if th'Ambassatours of that other Partie contente hem noght with th'Offres next afore reherced, the said &c. shal thanne procede further, and make th'Offre that folewith, and say,
That, at the Reverence of God, and for the Causes and Consideracions comprised in the next Article bifore (the whiche they shal repete) and to th'Entent that they may evidently appiere that the Kyng is noght ledde ner meved by Ambicion, ner by Covetise, to dwelle upon his said CLAYME and TITLE, the Kyng wol content hym to have to hym and his Heirs al the Cuntreys, Lordshippes, Lands, Possessions, Rentes, and Revenues with al thair Rights and Appurtenantz, that his Noble Progenitours, the Kyngs of England haan had, rejoised, and be Possessed of, noght as Kyngs of France, but in thaire own propre and Prive Right, belongyng to hym in other wise and by other lawful Title forthwith the Townes and Marches of Caleis comprehendid thereinne, the Counte, Castel, and Lordship of Guysnes and other in the same Marches, accordyng to the Limites and Bounds specified in the Trete of Bretayne, To have and to hold al the Cuntreys, Lordshipes, Lands, and Thyngs abovesaid immediately of God, and as Lord Soveraine of the same and of the Subgets thereof, as frely, withouten Subjeccion, Resort, or Recognicion, to be made therefore by hym or by his said Heirs to any Erthly Man, as kan be descrived or advised.
And, if it so be that, in the Demenyng of the said matiere, it be desired that the Kyng make al tho, that, bifore the Kyngs Conquest in Normandie and in France, have holde the Partie of th'Adversarie, to be restored to the Lands, Lordships, and Possessions that thei had in the said Normandie and other places of the Conquest, the said &c. shal straunge hem and make difficulte herein:
But finally, rather than breke therefore, the Kyng wol wele agre hym that they be so Restored to the Lands &c. that other Personnes be noght Intitlid in by force of any Yests or Grants made by the Kyng or by the Kyng's Fader:
And, if th'Adverse Partie content him noght with that, the Kyng wol, over that, agre hym that, if the Lands &c. so Yoven or Graunted by the Kyng or his Fader, falle ayeine to the Kyng's hands, or if tho, to whom the said Landys belangid bifore the said Conquest, may accorde with tho that now have hem, the Kyng wol wele that thei shal have hem and rejoise hem, holding hem of hym, or other Mene Lordys underneth hym.
And, if God dispose so that it were procedid so ferre, by Offres, that the Difficulte of Accorde and concludyng Rested oonly in the leving of the Name and Coronne of France, desired by that other Partie, it shal mowe be said,
That this were strange a thyng to the Kyng to doo, and shold to gretly touche and hurte his Worship, considering that he hath so solemply received his Unction and Coronne there inne, and in the Capital Cite thereof, grete partie of the Piers of France beyng present, and by theim or by thaire Procuratours assenting thereto:
And that it were no Noveltee ner Inconvenient, that iche of hem callid him Kyng of France, for so hath be seen afore this that such have be Kyngs in France, of diverse Parties there of, that have called hemself ich of hem Kyng of France:
But, finally, rather thanne the thyng falle to Rupture, the said Ambassadours shal reporte hem in this matiere to my Lord the Cardinal, to whom the King hath opened and declared al his Entent in this Matiere.
Item, if the Matiere of Mariage, to be had bitwix the Kyng and th'Adversarie Doughter, be meved as for a Mene to the Peas, and to th'Entent of Communication and Tretee to be had thereupon, the said &c. shal sey,
That it ne is noght thoght to the Kyng covenable to take to Wif the Doughter of any Prince withoute that he stonde in parfit Friendship with hym: And therefore of reson the Trete of the principal Matiere, that is to sey of the Peas, moost go bifore any such Matere of Mariage; consideryng that, withoute Accorde in the Principal, the Trete of Mariage shal be but voide.
And, if so be that, that other Partie stande not content with that Answere, but desire abydingly that Matiere to be entended to (takyng peraventure occasion of th'Offre that was made thereof at Arras) the said &c. shal mowe say, for it was so lightly laide by at Arras and noon Inclinacion shewed therto, the Kyng hath noght therefore yoven him there inne Instruccion, as they trowe he wold elles have do; Addyng thereto that the Kyng is noght so ferre but that he may soon be sent unto, and advertised of the Mocion upon cause reasonable that might be ministred thereto: And that, for as muche how be it that the said &c. ne have noght Instruccion in that Matiere, nevertheles, if it like that other Partie amiably to Comune thereof, thay wol noghte strange theim in that behalf:
In the which Comunicacion they shal first Here the Menes to the said Matrimonie that that other Partie wol opene, and havyng regard to here Overtures, so to Comune with hem as of hemself, noght binding the Kyng thereby,
And, in Comunyng of the Matiere, the said &c. shal aske for the Mariage Two Miliones, and from that descende, and finally abide upon a Milion of Scutes, Two of the Value of a Noble.
And, if th'Ambassatours of the Partie Adverse wol noght agre hem ne condescende to any of the said Meenes of Pees, but make other Offres such as shal like hem, The said &c. shal, withoute pleine refusyng of hem, passe over, and say that they have no such Instruccion by the whiche they may agre theim to the said Offres: they may wel Reporte the said Offres to the Kyng; but what shal folewe there of they can noght sey.
And, in this cas, to th'intent that the People of the Reme of France stand noght alwey in this Afficcion and thus oppressed with the Werre, the Kyng wol that it be laborèd to that, that Overture be made by the Mene of the Duc of Orleans, or by the Duchesse of Bourgoigne, of Trete of a Trewe general by See and by Land, to endure (if that other Partie wol condescend thereto) for Fifty, Forty, Thirty, or Twenty Yere, with Communicacion; And rather than faile, to condescende to a Trewes of Three, Four, Five, Six, Seven, or Eight Yere, without Communicacion, and it may be so gotyn.
And, for the better and seurer kepyng of this Trewes, they shal labore to that, that th'Entirchange may be made of Places enclavid of bothe Sids, and condescende, rather than faile, to Eschange Meux, Criel, and Seint Germayne en lay with Hareflete, Depe, and Mounte Seint Michel:
And, if this Enterchange can thus be had, they shal, in Communicacion of the Duc of Orleans Deliverance, assay how his Deliverance may be Mene thereto, and take the said three Places in partie of paiement of his Deliverance; In Tretie of which his Deliverance, they shal demaunde an C Mil. Marke, taking the said three Townes, and over that L. Mil. Marcz, and finally so to conclude.
In Witnesse of which thing we have doo put to this present Instruccion Oure Grete and Prive Seale.
