PRAYERS.

Winchelsea Writ.

ORDERED, That Mr. Speaker do issue his Warrant to the Clerk of the Crown, to make out a new Writ for the electing of a Baron to serve in this present Parliament for the Town and Port of Winchelsea, in the room of Henry Brougham, Esquire, who, since his election for the said Town and Port, hath accepted the office of Steward or Bailiff of His Majesty's three Chiltern Hundreds of Stoke, Desborough and Bonenham, in the county of Buckingham.

Sankey Brook Navigation Petition.

A Petition of several Proprietors of shares in the Sankey Brook Navigation, in the county palatine of Lancaster, was presented, and read; reciting two Acts of 28 Geo. 2, and 2 Geo. 3, for making navigable the river or brook called Sankey Brook, and the three several branches thereof from the River Mersey, below Sankey Bridges, up to Boardman's Stone Bridge, on the south branch, to Gerard's Bridge, on the middle branch thereof, and to Penny Bridge, on the north branch thereof, all in the county palatine of Lancaster, and also for adjusting the measure of coal to be brought down the said river or brook, and sold within the town of Liverpool, and setting forth, That it would be of great public utility, and of great advantage to the owners of flats, boats and other vessels using the navigation of the said Sankey Brook, if a navigable cut, canal or branch were to be made and maintained from, out of, and connected with, the said Sankey Brook Navigation, at or near to a place called Fidler's Ferry, in the said county, to join and communicate with the River Mersey, at or near to a place called Widnes Wharf, near West Bank, in the parish of Prescot, in the said county palatine of Lancaster, which said intended cut, canal and branch is intended to pass from, through and into the several townships, hamlets or places of Penketh Cuerdley and Widnes, all in the parish of Prescot, in the said county of Lancaster; and also to extend and improve the navigation of the said Sankey Brook and the several works thereto belonging; and it may be necessary to enlarge, alter and amend the powers and provisions of the said Acts, and to alter the existing tolls, rates and duties thereby granted; and it would be of great advantage if the proprietors of the said Sankey Brook Navigation were made a body corporate, and have powers to sue and be sued in a corporate name; and also to hold the lands and hereditaments, and the tolls, rates and duties, and other property of the said Sankey Brook Navigation in such corporate name; and praying, That leave may be given to bring in a Bill for the same.

Foston Bridge Road Bill, presented.

Mr. Charles Pallmer presented a Bill for repairing the Road from Foston Bridge, through the Town of Grantham, to the Division-stone on Witham Common, all in the county of Lincoln: And the same was read the first time; and ordered to be read a second time.

Order for Kingston Bridge Road Bill, charged.

The House was moved, That the Petition of the Bailiffs and Freemen of the town of Kingston-uponThames, in the county of Surrey; praying for leave to bring in a Bill for making Approaches to Kingston-uponThames Bridge, which was yesterday presented to the House, might be read; and the same was read.

Horsham and Guildford Road Petition.

A Petition of several Trustees for executing an Act for making and maintaining a Road from Horsham, to join the Turnpike Road leading to Guilford, with two branches therefrom, in the counties of Sussex and Surrey; and, of several Owners and Occupiers of estates, lands and grounds, was presented, and read; setting forth, That the money borrowed on the credit of the Tolls granted by the said Act, cannot be paid off, nor the said Roads be effectually amended and kept in repair, unless the term of the said Act be further continued; and it is expedient that the said Act should be repealed, and further and more effectual powers and provisions granted instead thereof; and that it would be convenient to the public, if a branch or new Road was made and maintained from a certain place at or near Slaughterford Bridge, towards Rowhook, in the said county of Sussex, and from thence, by Furzon Gate, to join the Road leading from Rudgwick to Guildford, terminating at or near a place called Ellens Green, in the said county of Surrey; and praying, That leave may be given to bring in a Bill or Bills for the same.

Ordered, That leave be given to bring in a Bill accordingly: And that Mr. Charles Pallmer and Mr. Denison do prepare, and bring it in.

New Sarum Poor Petition.

A Petition of several of the Churchwardens and Overseers of the Poor in the city of New Sarum, in the county of Wilts; and, of several Inhabitants of the said City, was presented, and read; setting forth, That the said city consists of three parishes; that is to say, the parish of Saint Thomas, the parish of Saint Edmund, and the parish of Saint Martin, and the poor belonging thereto are numerous, and supported at a great expense; and that an Act was passed in the tenth year of the reign of his late Majesty, for consolidating the Rates to be made for the relief of the poor of the respective parishes of Saint Thomas, Saint Edmund and Saint Martin, in the said city, and that many houses, buildings, hereditaments and premises within the said city of New Sarum, are let out at low rents or to occasional occupiers, or in lodgings or in separate apartments, or for short terms, or are let out to tenants, who are, or become insolvent, before the Rates charged on them can be collected, and by reason whereof the payment of the Poor Rates thereon is evaded, and the inhabitants of the other houses, in such parishes, are unjustly compelled to pay much more than their fair and due proportions of the charges of relieving and maintaining the poor; and that the laws now in force for assessing and collecting monies for the relief of the said poor are in various respects defective and insufficient, and it is expedient that more effectual powers and provisions should be made and granted for assessing, collecting and recovering the said Rates, and that the powers of the said Act should be enlarged; and praying, That leave may be given to bring in a Bill for the same.

Market Harborough Road Petition.

A Petition of several Trustees for executing the Acts for repairing the Road from Market Harborough to Loughborough, in the county of Leicester, and for repairing, widening, turning and altering the Road branching out of the aforesaid Road, at a place called Filling Gate, to a Road called the Foss Road, and from thence to the Turnpike Road leading from Melton Mowbray to the Guide Post in Saint Margaret's Field, Leicester, was presented, and read; setting forth, That the Money borrowed on the credit of the Tolls cannot be paid off, nor the said Roads be effectually amended and kept in repair, unless the term of the said Acts be further continued, the said Acts repealed, and other powers and provisions granted instead thereof, and the Tolls increased; and praying, That leave may be given to bring in a Bill for the same.

Ordered, That leave be given to bring in a Bill accordingly: And that Sir Charles Hastings and Mr. Legh Keck do prepare, and bring it in.

Thirsk Roads Petition.

A Petition of several Trustees for executing the Acts for widening and repairing the high Road leading from Northallerton to the south wall of the churchyard of the town of Thirsk, and from the south-east end of the street called Finkell-street, in Thirsk aforesaid, to and through the town of Easingwold, to a place called Burton Stone, near the city of York; and also the Road from Thirsk aforesaid to Topcliffe, in the north riding of the county of York, was presented, and read; setting forth, That the Money borrowed on the credit of the Tolls cannot be paid off, nor the said Roads amended and kept in repair, unless the term and powers of the said Acts are enlarged, and the Tolls increased; and praying, That leave may be given to bring in a Bill for the same.

Ordered, That leave be given to bring in a Bill accordingly: And that Mr. Marshall and Lord Viscount Milton do prepare, and bring it in.

Accounts of Dividends, ordered.

Ordered, That there be laid before this House, an Account of the total number of Persons to whom a half year's Dividend on Three per cent. Consols became due on 5th January last; specifying the number respectively of those whose Dividend for the half year did not exceed £.5, £.10, £.50, £.100, £.200, £.300, £.500, £.1,000, £.2,000, and the number of those whose Divident exceeded £.2,000:-a like Account of Dividends on Three per cent. Reduced payable on 10th October last:-a like Account of the Dividends on Three and a Half per cents, payable on 10th October last:-a like Account of Dividends on Four per cents, payable on 10th October last: -a like Account of the Dividends on Long Annuities, payable on 10th October last:-a like Account of the Dividends on New Four per cents, payable on 5th January last:-and, a like Account of the Dividends on Three per cent. Ordered, That the Return of the number of Posteas filed during the years 1826, 1827 and 1828, in the Court of Common Pleas at Westminster, stating whether for the Plaintiff or Defendant, and specifying the nature and amount of the verdict and costs recorded, which was yesterday presented to the House, be printed.

Petitions for repeal of Parish Vestries Act (Ireland.)

A Petition of Roman Catholic Inhabitants of the parish of Cloynepriest was presented, and read; reciting the Act 7 Geo. 4, c. 72, for the regulation of Parish Vestries in Ireland; and praying, That the same may be repealed.

A Petition of Roman Catholic Inhabitants of the union of Midleton, in the diocese of Cloyne, in the county of Cork, was also presented, and read; setting forth, That the Petitioners feel it a most distressing grievance to be compelled by law to pay Church Rates for the building, repairing, and for several other expenses besides, of the Church of said Union, to which they do not belong; that the said Union comprises an extent of land amounting to 20,000 acres; that the Roman Catholics of said Union are the occupiers of 15,000 acres of said Union; that they are compelled to pay Church Rates in the same proportion, that is, as three is to one, although the said Union contains a most respectable and wealthy Protestant population; that the Roman Catholics of said Union, who are not Petitioners by reason of their want of education, are as sensibly alive to the injustice of this law as the Petitioners can possibly be; that a new church has been lately built in said Union, in a very expensive manner, all of cut stone, with pews and galleries made of oak, which cost about 3,000£; that the Petitioners, in a most respectful manner, solicited the late Lord Bishop of said diocese, and the present Rector of the said Union, to cause the pews and galleries of said church to be sold for the benefit of the said Union at large, thereby to diminish the Church Rates thereof, as had been done in other parishes of the said diocese, and in other dioceses likewise, but that such application has been very unceremoniously refused; that the Petitioners humbly pray the House will take this Petition into their consideration, with a view to the relief and satisfaction of the Petitioners and their poor Roman Catholic brethren of said Union, from any demand on them in future for any Church Rates whatsoever.

And the said Petitions were ordered to lie upon the Table; and to be printed.

Petition for repeal of Subletting Act (Ireland.)

A Petition of Roman Catholic Inhabitants of the parish of Cloynepriest was presented, and read; reciting the Act 7 Geo. 4, c. 29, to amend the Law in Ireland respecting the assignment and subletting of Lands in Ireland; and praying the House to repeal the same.

Ordered, That the said Petition do lie upon the Table; and be printed.

Abstract of Affidavits of Debt, ordered. No. 14.

Ordered, That an Abstract of the "Return of the Names and Designations of all Persons who have filed Affidavits of Debt in the Courts of King's Bench, Common Pleas and Marshalsea, within the years 1825 and 1826, and up to the 22d June 1827, stating the amount of debt sworn to, and for, or upon what the said debt was due;" which was presented to the House upon the 19th of February 1828; specifying the number of persons who have filed Affidavits of Debt for sums of £.10 and not exceeding £.20, above £.20 and not exceeding £.50, above £.50 and not exceeding £.100, above £.100 and not exceeding £150, above £.150 and not exceeding £.200, above £.200 and not exceeding £.500, above £.500 and not exceeding £.1,000, above £.1,000 and not exceeding £.2,000, and for sums above £.2,000; and stating the number filed for debts upon Bonds, Bills of Exchange, or Promissory Notes, Goods, &c. sold, Work and Labour, Money had, paid or lent, and upon other considerations, be prepared, and laid before the House.

Ordered, That an Abstract of the "Return of the number of Courts of Law in England, Wales and Ireland, whether under the name of Courts of Request, or any other name, which have the power of committing to prison for Debts of £.5 and under £.5; stating the constitution of the Court, the extent of imprisonment authorized to be awarded for the several amounts of Debt in classes; also, by what Act of Parliament, or other authority, the Court acts, and the Expenses or Rate of Fees charged in each Court; stating whether any, and what allowance is made to the Debtor during his confinement in prison, and by whom such allowance is paid; and the total amount paid for such allowance in each of the two years 1826 and 1827;" which was presented to the House upon the 18th day of February 1829-so far as relates to England and Wales, -be prepared, and laid before the House.

Ordered, That an Abstract of the Return to an Order of the House, dated the 13th March 1829, for "A Return of the number of Causes and Matters pending in the High Court of Chancery, to the credit of which any sum of money is vested in the Bank Annuities or in Cash; distinguishing the amount of Principal and Interest in each, the period when each Cause or Matter was instituted, with the nature and date of the last Proceeding taken therein;" which was presented to the House upon the 4th day of June 1829; showing the total number of Accounts; the number of Accounts in which any sum is invested under the head of Securities; the number of Accounts in which the sum so invested is not above £.100, the number above £.100 and not exceeding £.200, above £.200 and not exceeding £.500, above £.500 and not exceeding £.1,000, above £.1,000 and not exceeding £.5,000, above £.5,000 and not exceeding £.10,000, and the number exceeding £.10,000; and the aggregate sums of the entire Return under the heads of Cash and Securities; together with Copies of the four Accounts annexed to the Return, and the explanatory Observations of the Accountant General, be prepared and laid before the House.

St. Katharine Dock Petition.

A Petition of the Directors of the Saint Katharine Dock Company, was presented, and read; reciting an Act of the 6th year of His present Majesty, for making and constructing certain Wet Docks, Warehouses and other Works in the Parish of Saint Botolph-without-Aldgate, and in the Parish or Precinct of Saint Katharine, near the Tower of London, in the County of Middlesex; and setting forth, That the Petitioners, with certain other persons therein named, were constituted a Joint Stock Company for the purpose of carrying the object of the said Act into effect by the name and style of the Saint Katharine Dock Company; and that, in pursuance of the powers for that purpose vested in the Directors of the said Company, they immediately proceeded in the construction of the proposed works, and have completed two navigable Docks, with an entrance basin and lock communicating with the River Thames, and have also erected several warehouses, vaults, buildings and other works, quays and wharfs, and others are now in progress towards completion; and that the capital stock of the said Company was fixed by the said Act at the sum of 1,352,752£., with power to augment the same by any sum not exceeding in the whole the further sum of 500,000£., or to borrow any part of such additional sum at interest upon the security of the Rates to be received by virtue of the said Act; and that in pursuance of the powers so given by the said Act, and by another Act passed in the 10th year of the reign of His present Majesty, the whole of the said capital stock of 1,352,752£. has been raised; and the further sum of 500,000£. has been borrowed upon the security of the Rates, as authorized by the said Acts; and that in the progress of the construction of the said Docks, Buildings, Quays, Wharfs and other works, it has been found necessary, and judged expedient, to make several additions, alterations and improvements, and in the purchase of the site and execution of the buildings and works originally contemplated, the outlay has exceeded the estimates; and that, in order to enable the Petitioners to complete the several buildings, quays, wharfs and other works now in progress, and to provide further warehouse-room for the accommodation of the public, it is necessary that they should be empowered to raise a further sum of Money not exceeding 300,000£.; and praying, That leave may be given to bring in a Bill for the same.

Lunatic Licensing Balances Bill, ordered.

Mr. William Peel presented to the House, pursuant to their Addresses to His Majesty in the last Session of Parliament, a Return of all Fees paid in one year by the High Sheriff of each County in England and Wales, on entering into that office, and during the continuance thereof; stating under what authority such Fees are demanded, the amount thereof, and for whose use the same are paid; also stating, whether any and what allowances are made to each of the said High Sheriffs, to enable them to perform the duties of the office.

A Return of the number of persons who, having been committed for offences in execution of a sentence of Court or order of Magistrates, have been discharged, during the years 1827 and 1828, from the Hulks and the various Gaols and Houses of Correction in England and Wales, distinguishing Males from Females, and stating whether confined for Felony or Misdemeanor.

Petitions for repeal of Malt and Beer Duties.

A Petition of Landowners, Farmers and Tradesmen resident in the parishes of Wittersham, Stone, and Ebony, in the Isle of Oxney, in the county of Kent;-of Inhabitants of Wrotham;-and of Benenden,-were presented, and read; setting forth, That the labourers, tradesmen, and the occupiers and owners of land in that part of the country are suffering under great and increasing difficulties and distress, and the Petitioners see too much reason to apprehend that a large proportion of the yeomen and farmers must be utterly ruined, if measures be not adopted by the House for their immediate relief; and praying, That the Duties on Malt and Beer may be totally repealed; and that such other measures may be adopted as the House may deem most likely to restore prosperity to this now distressed country.

And the said Petitions were ordered to lie upon the Table; and to be printed.

Resolved, That an humble Address be presented to His Majesty, that He will be graciously pleased to give directions, that there be laid before this House, a Return of the number of Prisoners for Debt committed to the custody of the Keepers of the King's Bench, the Fleet, Whitecross-street, the Marshalsea, and Horsemonger-lane Prisons, in the year 1829; distinguishing those in custody under Mesne Process, or under Judgments recovered, or for Costs of Suit; stating how many for sums above £.100, for sums between £.50 and £.100, for sums between £.50 and £.20, and the number of sums under £.20 (excluding Crown Debtors, prisoners for Contempt of Court, and persons committed by process out of Courts of Request); stating also, the number in custody in each of those prisons on 1st January 1830.

Resolved, That an humble Address be presented to His Majesty, that He will be graciously pleased to give directions, that there be laid before this House, a Return of the number of Warrants granted for Debt; distinguishing whether upon Mesne Process or on Writs of Execution against the person, by the Sheriffs of London and Middlesex, and by the Sheriff of Surrey, and the number of bailable processes executed by them in the year 1829.

Resolved, That an humble Address be presented to His Majesty, that He will be graciously pleased to give directions, that there be laid before this House, a Return of the number of Debtors committed to the Whitecross-street and Horsemonger-lane prisons, on process out of the Courts of Request, during each of the last two years ending 1st January 1830; stating the aggregate amount of debts and costs separately, in each prison, in each year; showing, in classes, the number confined from one to less than ten days, for ten days and less than thirty, fifty, seventy, and one hundred days, in each year; stating also, the amount paid out of the County or other Rates for the maintenance and support of such prisoners, in each year, as accurately as possible.
