To the official of St. Andrews. Mandate, as below. The recent petition of Hugh Martini, clerk, of the diocese of St. Andrews, (fn. 3) contained that on the voidance of the perpetual vicarage of the parish church of Fordene in the said diocese by the death of Stephen Mortimar extra R.c., the prior and chapter of the church of St. Andrews, O.S.A., to whom the presentation by ancient custom belongs, presented the said Hugh to William, archbishop of St. Andrews, and that the said archbishop, refusing to institute him, collated the said vicarage to Patrick Sinson [sic], clerk; and that the pope committed the said Hugh's appeal to the apostolic see from the said refusal and collation, and the principal matter, at the said Hugh's instance, to John Anthony, bishop of Alessandria (Alexandrino), holding the place of a papal auditor, who promulgated an unjust definitive sentence in favour of the said Patrick, and against the said Hugh, from which the latter appealed to the said see, which appeal the pope committed to Master William de Perreriis, a papal chaplain and auditor, who is said to have proceeded, short of a conclusion. Seeing that whilst the said cause has been pending before auditor William, the said Patrick has this day by his proctor, John Wallate [sic], clerk, of the diocese of Glasgow, given up to the pope the said suit and all his right in or to the said vicarage; and seeing that, as the said petition added, the said Hugh doubts whether the said presentation holds good, and that, as the pope has learned, the said vicarage is still void as above, the pope, hereby calling up the said cause to himself, and extinguishing the suit, orders the above official, if he find the said Hugh to be fit, to collate and assign to him the said vicarage, yearly value not exceeding 9l. sterling.
