To the prior of the monastery of Holy Trinity, Lochwochdayr wont to be governed by a prior, in the diocese of Kilmore. Mandate, as below. The pope has been informed by Cornelius Offergayl, dean of Ardagh (Ardakaden.), that Patrick Macgillaregin, [now] a monk of the monastery of St. Mary, Granard (de Guanardo [sic]) (fn. 2)alias de Leathen, O.Cist., in the diocese of Ardagh, then only a clerk, desired to serve God in the said monastery along with William, [now] bishop of Ardagh, then abbot of the said monastery, and the convent thereof; that the said William. [now] bishop, then abbot, refused to receive him as a monk, give him the regular habit, and receive his profession, unless he paid him a certain sum of money, or bound himself to pay it after he had been received as a monk, and unless he gave surety to pay; that the said bishop, then abbot, upon the said bond and surety being given, received the said Patrick as a monk of the said monastery, gave him the habit, and received his profession. by his ordinary authority; that he has also received several sums of money, horses, and other goods from persons to whom he has made collation and provision of benefices in his gift as bishop of Ardagh, thereby contracting simony and incurring the sentences [of excommunication], etc., therefor; that (a matter in respect of which he is greatly defamed in those parts) he has committed notorious fornication with several women; and that he has, being under the said sentences, etc., celebrated masses and other divine offices. and taken part therein, thereby incurring irregularity, to the peril of his soul and to the shame of the episopal and of the whole clerical order. etc. The pope, therefore, considering that if the foregoing things are true the said William has rendered himself unworthy of the rule and administration of the said monastery, which he holds in commendam by papal grant and dispensation, and that he is deserving of deprivation, hereby orders the above prior, if the said Cornelius, who (after the present pope had ordered provision to be made to him of the rectory of the rural church of St. Patrick, Cnocratha, in the said diocese, and of the said deanery, or had ordered a grant to be made to him that the collations and provisions otherwise made to him thereof, etc., should hold good) has been dispensed by the pope, notwithstanding his illegitimacy arising from the fact that his parents had contracted marriage, being related in the simple fourth degree of affinity and having obtained no dispensation, to use the clerical character which he had received, (fn. 3) and be promoted to all, even holy orders and receive any benefices compatible with one another and with the said deanery and rectory, even if canonries and prebends, dignities, etc., and to retain them all, will accuse before him the said William, bishop and commendatary, to summon the same, and if he find the foregoing to be true, to deprive and remove him from the said commenda, and, in the event of his so doing, to grant the said monastery, which depends on the monastery of St. Mary the Virgin by Dublin, of the said Order, and the yearly value of which does not exceed 100 marks sterling, to the said Cornelius, to be held by him in commendam for life with the said deanery and rectory, and with any other benefices with or without cure. The said prior is moreover to receive him, after he has obtained possession of the rule and administration of the said monastery in virtue of the said commenda, etc., as a monk thereof, give him the regular habit, and receive his profession, and thereupon to make him provision of the said monastery, the said commenda whereof the pope decrees shall then cease. The pope further specially dispenses him to receive the said commenda and, when he has made his profession, to be appointed abbot and receive and retain the rule and administration, notwithstanding the said defect, etc., and grants him indult to be blessed by any catholic bishop in communion with the apostolic see. After he has made his profession he is to resign the said rectory and deanery, and all his other benefices with and without cure. Ex suscepto servitutis officio. To John Elvysshe, prior called abbot of the monastery called an abbey, wont to be governed by a prior called an abbot, of St. Mary, Creke, O.S.A., in the diocese of Norwich. Dispensation to receive and retain for life with the said priory, or with any other benefice of the said order, or without them, any other benefice with or without cure wont to be held by secular clerks, even if it be a parish church or its perpetual vicarage, etc., and to resign it, etc.; with grant that if he resign the said priory he may have his canon's portion, his stall in the choir, and voice in the chapter of the said monastery. To the bishop of Clonfert, the abbot of the monastery of Abbeygormacan (de Via nova) in the diocese of Clonfert, and the dean of Clonfert. Mandate, as below. The recent petition of Donald Ikellyd, a canon of the monastery of St. Mary, Clontuosgertamane, O.S.A., in the diocese of Clonfert (Clotfernen. [sic]), contained that formerly, upon Maurice Ofallum [sic], a canon of the monastery of St. Mary, Rahigila, of the said Order, in the diocese of Limerick, falsely relating to the apostolic see that Donatus Okellid, prior of the said monastery of Cloneuosgertamane [sic], wont to be governed by a prior, had committed divers crimes, the said see ordered Malachy Okonqueun, a canon of Tuam, if the said Malachy (recte Maurice) would accuse the said Donatus before him, to summon the latter, and if he found what was thus related to be true, to deprive and remove him; that the said canon, after the said Maurice had thus accused the said Donatus, proceeded to the execution of the said mandate and, inasmuch as he did not find that the said charges were true, promulgated a definitive sentence by which he absolved the said Donatus from the said accusation, from which sentence the said Maurice appealed to the said see; that, the latter not having prosecuted the said appeal for more than two years, and the said Donatus having obtained confirmation of the said sentence by papal authority, the said Maurice, without making mention of the said confirmation, obtained papal letters addressed to Robert de Yllyn (recte Deyllyn), William Obragriy [sic], and Cristinus Omullon, then named by him canons of Clonmacnois, (fn. 4) in the matter of the said appeal, and under pretext thereof caused the said Donatus to be summoned before the said alleged canons, (fn. 5) who by their unjust sentence revoked that of the said Malachy, deprived the said Donatus of the said priory, made provision of it, as being thus void, to the said Maurice, and transferred him from the said monastery of Rahigila to that of Clontuosgertamane, from which sentence the said Donatus appealed to the said see, although, being in doubt of the judge's coming, the messenger sent by him to receive the apostolic [letters] did not wait the day for getting them until nightfall. (fn. 6) Seeing that, the cause being still pending, the said Donatus proposes to cede the said suit and all his right in or to the said priory; and seeing that, as the said petition added, the said Donald formerly accused before a certain judge the said Donatus, then prior of the said monastery of Clontuosgert[amane], of divers crimes, to the end that he should be deprived thereof, and from the same judge, who had been corrupted by the said Donald with money and other goods, obtained a sentence in his favour, even after he [Donald] had been inhibited by a certain [other] judge appointed at the instance of the said Donatus, and that under pretext thereof he has for between one and two years received some fruits, although not peacefully; that, being content with receiving a certain yearly pension for life assigned to him by his said adversary from the fruits of the said priory, he has given up the said sentence delivered in his favour and the said suit, and has desisted from further molesting the said adversary; that he has had himself promoted to all holy, even priest's orders, and has celebrated masses and other divine offices, but not in contempt of the Keys, and has taken part therein; and that, urged by wine (?) and anger he has struck two canons of the said monastery of Clontuosgert[omany] with arms and bloodshed, but short of killing and mutilating them, (fn. 7) the pope, at the said petition of the said Donald (who alleges that he has impetrated letters of the pope's penitentiary in the matter of absolution from the said violence, and that in virtue thereof he has been absolved), (fn. 8) hereby orders the above three to absolve him from simony and the other excesses, etc., aforesaid, enjoining a salutary penance, etc., dispense him on account of irregularity and rehabilitate him, receive the said Donatus's said proposed cession, and, in the event of their so doing, to surrogate the said Donald in and to all right belonging to the said Donatus in or to the said priory at the time of such cession, and make him collation and provision of such right, etc., and, moreover, to make collation and provision to him of the priory itself, which is conventual, and the yearly value of which does not exceed 60 marks sterling. The pope further specially dispenses him to receive and retain it, notwithstanding his illegitimacy as the son of a deacon, a canon professed of Clontuosgert[omane], and an unmarried woman. The said judges are further to see that in the matter of the said cession there be no corruption between the said Donatus and Donald. Apostolice sedis indefessa clementia.
