Bullarum Liber XLI.

5 Innocent VIII.

St. Peter's, Rome.
(f. 21v.)
To the bishop of Ross, and William Ohyerlachy and John [son] of Edmund de Geraldinis, canons of Cloyne (Clonen.). Mandate, as below. The pope has learned that the priorship of the monastery of St. Mary the Virgin, Bridgetown (Villepontis), O.S.A., in the diocese of Cloyne, wont to be governed by a prior, and the perpetual vicarage of the parish church, called the prebendal [church] (fn. 2) of Kyllinodonoch, in the same diocese, have been so long void that by the Lateran statutes their collation has lapsed to the apostolic see, although Nicholas, who behaves as bishop of Lismore and Waterford, has under pretext, as is said, of certain letters surreptitiously extorted from the pope, detained for some years and still detains possession of the said priorship, and although Cornelius Ochohych, who behaves as a priest, has detained for some years, and still detains, possession of the said vicarage, without any title. (fn. 3) The pope has also learned that Maurice Odahyll, a canon of Emly, desires to serve God with the convent of the said monastery under the regular habit. He, therefore, absolving the said Maurice, who is a priest, from any oath which he may have taken not to impetrate the said priorship and vicarage, and holding as expressed by these presents the time during which the said Nicholas has detained the said priorship, but short of three years, (fn. 4) and the time during which the said Cornelius has detained the said vicarage, hereby orders the above three to receive the said Maurice as a canon of the said monastery, give him the regular habit, and receive his profession, and if, after summoning the said Nicholas and Cornelius, they find that the said priory, which is conventual, and the said vicarage, yearly value not exceeding 120 and 12 marks sterling, respectively, are void in any ways, to collate and assign the said priorship to the said Maurice, even before they receive him as a canon of the said monastery, and before the habit is given to him, and before he makes his profession, and to grant to him the said vicarage in commendam, inducting him, and removing the said Nicholas and Cornelius. The pope further specially dispenses him to receive the said priorship, even being a secular priest, and, so long as he obtains peaceful possession of it, (fn. 5) to retain it without having taken the habit, and without having made his profession. Apostolice sedis providentia circumspecta. [4½ pp.]

(f. 176v.)
To the abbot of the monastery of St. Mary, Abbeyleix (de Lege dey), in the diocese of Leighlin, and the chancellor and the official of Leighlin. Mandate, as below. The recent petition of Donatus Olecgluair, priest, of the diocese of Leighlin, contained that after he had been dispensed by papal authority on account of illegitimacy, as the son of unmarried parents, to be promoted to all, even holy orders, and hold a benefice even with cure, he, having been made a clerk, accepted the then void perpetual vicarage of the parish church of Cluyn[c]heneche in the said diocese, in virtue of letters granted to him by Sixtus IV, and got provision made to him thereof, in virtue of which acceptance and provision he obtained possession. The said petition added that the said Donatus, who was afterwards promoted to all, even holy orders, doubts whether the said acceptance and provision hold good, and the pope has learned that the said vicarage is still void, as above, and also that the perpetual vicarage de Srubo [sic] alias de Span, in the said diocese, has been so long void that by the Lateran statutes its collation has lapsed to the apostolic see, although Semundus Omakayll, priest, of the said diocese, has detained it for several years without any title. The pope has also been informed by the said Donatus that Philip Okonorayn, perpetual vicar of the parish church de Villa fontis alias de Thratinoig, in the same diocese, has shared the said vicarage and its fruits, etc., with John Okellay, priest, of the said diocese, thereby incurring simony. He therefore hereby orders the above three, if the said Donatus will accuse the said Philip before them, to summon the latter, and if they find the foregoing to be true, to deprive and remove him from the said vicarage de Villa fontis, and in the event of their so doing, to summon the said Semundus, and if they find the said vicarage de Scubo to be void, as above, to collate and assign the said vicarages de Cluyncheneche and de Villa fontis, yearly values not exceeding 12 and 8 marks sterling, respectively, to the said Donatus, and to unite and appropriate the said vicarage de Scubo, yearly value not exceeding 8 marks, to that of Cluyncheneche, for as a long as he shall hold the latter. The pope further specially dispenses him to receive and retain for life with the said vicarages any one other benefice, or without them any two other benefices, with cure or otherwise incompatible, and to resign them, etc., notwithstanding the said defect, etc. Apostolice sedis providentia circumspecta. To the bishop of Elphin, and John Occoner and Charles Offallun, canons of Elphin. Mandate (the pope having learned that Magonius Cicinllalyd (?), perpetual vicar of the parish church of Athasgrach, to which is canonically united for his lifetime the perpetual vicarage of the parish church of Killosagileayn, [both] in the diocese of Elphin, proposes to consent to the dissolution of the said union), if the said Magonius freely consents, to dissolve the same and, in the event of their so doing, to collate and assign the said vicarage of Kyllosagyleain, (fn. 6) yearly value not exceeding 8 marks sterling, to Thady Machaharrd, priest, of the diocese of Clonfert (Clotferden. [sic]). Vite ac morum. (Gratis pro deo. Juravit.) [2 pp.]

(f. 234v.)
To the prior of the monastery of St. Mary, Clontuesgert Omane, wont to be governed by a prior, in the diocese of Clonfert, and the dean and the archdeacon of Clonfert. Mandate, as below. The pope has learned that William, abbot of the monastery of St. Mary de Portupuro, Clonfert, O.S.A. (against whom William Obrogay, a canon of the said monastery, falsely alleging that the said abbot William had perpetrated divers excesses and crimes, impetrated certain letters surreptiously extorted from the present pope to certain judges in those parts, which judges, wrongfully proceeding, promulgated an unjust definitive sentence in favour of the said William Obrogay, and against the said abbot William, from which the latter has appealed to the apostolic see, in the matter of which appeal he has impetrated other papal letters, perhaps not yet presented, to certain other judges in those parts), proposes, after the said sentence has been annulled, (fn. 7) to cede the rule and administration of the said monastery. And the recent petition of Matthew, bishop of Clonfert, and the said abbot William, contained that the fruits of the church of Clonfert have become so much reduced in value that they are insufficient for the support of the pontifical dignity, and that its immovable goods are wrongfully occupied by divers laymen, and that for the recovery of them the said bishop is not strong enough, on account of the power of the occupiers; and that in the said monastery the observance of the regular discipline and divine worship are so much neglected, and the care of its buildings so much wanting, that the buildings of the house thereof are falling to ruin, and that, moreover, there is no hope of the said observance being restored, and of the buildings being repaired, if the said monastery be governed by an abbot, as hitherto, (fn. 8) inasmuch as the canons, disregarding the obedience and authority of the abbot for the time being, or rather despising the same, share amongst themselves and occupy the greater part of the monastery's goods, and connive at their being occupied by others, (fn. 9) to the great hurt of the said monastery and the evil example and scandal of very many persons, especially of the vulgar sort, who ought to receive an exemplary life from the said canons; that the said bishop has no suitable habitation in the city of Clonfert, that the said monastery is situate in that city, and that if the abbatial dignity were suppressed, and the said monastery united and appropriated in perpetuity to the episcopal mensa, and the perpetual vicarage of the parish church of Lochryach in the diocese of Clonfert were united and appropriated anew (de novo) to the said monastery (its former union thereto having been dissolved by authority of the ordinary), the said Matthew and the bishop for the time being would cause the said buildings to be repaired, and would keep such canons in the said monastery that by their exemplary and laudable life divine worship would be increased therein and regular discipline observed, and the said Matthew and the bishop for the time being could more easily see to the recovery and restoration of the goods of the said monastery and church, make a fitting habitation for themselves in the houses of the said monastery, and more becomingly keep up their state as the pontifical dignity demands. At the said petition, therefore, of the said bishop Matthew and abbot William, who allege that the yearly values of the episcopal mensa, of the monastery and its annexes, and of the said vicarage do not exceed 100, 40, and 10 marks sterling, respectively, the pope hereby orders the above three to receive from the said abbot William the said cession, after the said sentence has been annulled; and thereupon to suppress the abbatial dignity in the said monastery, thereby void, and to unite and appropriate in perpetuity the said monastery to the said mensa, and unite and appropriate anew, with consent of the present vicar, the said vicarage to the said monastery, etc. They are to see that between the said bishop and abbot William there be no corruption. Dispositione divina. [4 pp. In the margin at the end: ‘Jan(uarii).’]

(f. 263v.)
To the abbot of the monastery of St. Mary, Abbeyleix (de Lege dei), in the diocese of Leighlin, the archdeacon of Leighlin, and Fintan Olocgluar [sic], a canon of the same. Mandate, as below. The recent petition of Thady Obergyn, [priest], (fn. 10) of the diocese of Ossory, contained that on the voidance of the rectory of the parish church of St. Muicin (?) (sancti Mugessy), Rosconayl, in the said diocese, the then bishop of Ossory made him collation and provision thereof by his ordinary authority, in virtue whereof he obtained possession, taking the fruits in good faith. His said petition adding that he doubts whether the said collation and provision hold good because, as is alleged, the said rectory had been so long void that its collation had lawfully lapsed to the apostolic see, and for certain other reasons. The pope, therefore, having learned that the said rectory is still void, as above, and that the rectory of the parish church of St. Canice (sancti Kenici), Achabo, in the said diocese, of lay patronage, has been so long void that by the Lateran statutes its collation has lapsed to the said see, although John Maccostygin alias Macgillayadri, priest, of the said diocese, has detained possession of it for some years, without any title, hereby remits to the said Thady (who was lately dispensed by papal authority on account of illegitimacy, as the son of a priest and an unmarried woman, to be promoted to all, even holy orders and hold a benefice even with cure, after which he was so promoted) the fruits received by him from the said rectory of St. Muicin (?), and rehabilitates him on account of any irregularity which he may have thereby incurred, and orders the above three to collate and assign to him the said rectory of St. Muicin (?) and, after summoning the said John and others concerned, that of Achabo, yearly values not exceeding 8 and 30 marks sterling, respectively, inducting him, and removing the said John. The pope further dispenses him to receive and retain them for life, and to resign them, simply or for exchange, as often as he pleases, and hold instead, also for life, two other rectories or parish churches, notwithstanding the said defect, etc. Vite etc. [5½ pp. In the margin at the end: ‘Fe(bruarii).’ Below the text is:
