To the abbots of Twekyesberry and Haylys, in the diocese of Worcester. Mandate, at the recent petition of the prior and convent of St. Giles's, Malvern (Malvernie), O.S.B., in the diocese of Worcester (containing that the said priory has divers chapels and parish churches annexed to it in the dioceses of Dublin, Meath and Ardagh, which are of little profit to it, being a hundred and forty miles distant, by reason of which distance and the dangers of the journey the said prior and convent have to bear sundry expenses in sending messengers to collect the fruits, etc.), if they find the facts to be as stated, and that it would be to the manifest profit of the said priory, to grant licence to the said prior and convent, with the assent of the ordinary and patrons, to grant the said fruits, etc., on perpetual lease, under an annual rent, to the abbot and convent of St. Mary the Virgin, near Dublin, O.Cist. Mandate, after absolving them from excommunication incurred, and enjoining penance, to dispense William Barkeley, layman, of his diocese, and Anne Fynes, mulier, of the diocese of Chichester, both of noble birth, to remain in the marriage which they formerly contracted per verba legitime de presenti, carnali copula inter eos tamen non subsecuta, not in ignorance that they were related in the second and fourth degrees of affinity; decreeing legitimate the offspring to be born of the said marriage. To James and Margaret, king and queen of Scots. Indult that the confessor of their choice, secular or regular of any order, may absolve them, being contrite and having confessed, from all sentences of excommunication, etc., and from any vows and oaths, perjuries, and other sins, etc., however enormous, (fn. 2) short of the laying of violent hands on any ecclesiastical prelate, even in cases reserved to the apostolic see, every year for life on the feasts of St. John Baptist and All Saints, and in other cases as often as opportune, grant them plenary remission of all their sins and enjoin a salutary penance, grant them in the hour of death plenary remission of all their sins, and commute any vows and release any oaths; with further grant that by visiting yearly on the said feasts seven altars in any church or churches they may gain the same indulgence as they would gain by personally visiting certain churches within and without Rome in the year of Jubilee. If, trusting to the present grant, they commit any [sins], it shall be null and void as far as regards the said plenary remission. Magne devocionis affectus. (In the margin at the beginning: ‘L. To Richard FitzJames, rector of the parish church of Alze in the diocese of Bath and Wells, S.T.M. Decree, as below. His recent petition contained that when holding the parish church of Spestebury [sic] (fn. 3), in the diocese of Salisbury, he wrote to a friend in the Roman court to obtain for him a papal dispensation to hold for life, and to exchange, two benefices with cure or otherwise incompatible, even if parish churches, etc., and that, believing that the papal letters had been obtained and expedited, he obtained by collation of the ordinary the parish church of Trent in the diocese of Bath and Wells, and detained both churches together for some days, but for less than a month, before he had certain knowledge of the said dispensation; that, after having knowledge thereof he continued his possession of the said churches, and, after having exchanged them and other benefices, in virtue of the said dispensation, obtained by collation of the ordinary the parish church of Alze, and the perpetual vicarage of the parish church of Mynlhede [sic] in the said diocese of Bath and Wells, which he is still holding under pretext of the said dispensation, taking the fruits, etc., in good faith. Seeing that, as the said petition added, at the time of the collation of the said church of Trent the said dispensation had not yet been granted, nor the letters in the matter thereof expedited, although they were expedited within a month from the said collation, the pope hereby decrees that the said dispensation shall hold good from the date of these presents, so that he may retain for life the said church and vicarage, and also any other benefices without cure, compatible with one another and with the said church and vicarage, which may have been collated to him since he obtained the said churches of Trent and Spestebury, etc. (fn. 3)Litteraram sciencia, vite etc. [3 pp.]

Indulgence, as below. The pope, having learned that the buildings of the church of Salisbury, which is very famous amongst the cathedral churches of those parts, have in these latter days greatly suffered from the commotions in those parts, as have also the revenues of the episcopal mensa, (fn. 4) and desiring the honour and repair, etc., of the said church, of which Thomas, who has been sent to the pope as the orator of Richard, king of England, to do obedience to the pope on behalf of the said king, is bishop, (fn. 5) hereby grants to all who, being penitent and having confessed, visit the said church on the feast of the Annunciation and during its octave, from the first to the second vespers, and give alms for its repair and restoration, plenary indulgence of all their sins; with faculty to the said bishop or his deputy to appoint as many priests, secular or regular, as he shall think good, to hear the confessions of those who resort to the said church in order to gain the said indulgence (except in cases reserved to the apostolic see), on the two days preceding the said feast and the days of the said octave, etc.; these presents to hold good for three years only. To Richard, bishop of St. Asaph. Dispensation, as below. After Sixtus IV had made provision to him of the see of St. Asaph, he dispensed him to retain therewith in commendam for life the monastery of St. Mary Magdalen, Shap (de Sheppa alias de Heppa), O. Praem., in the diocese of Carlisle, and also to retain in titulum vel commendam with any other cathedral church, even metropolitan, to which he should be translated, the said monastery and any benefices which he should be holding, as is more fully contained in divers letters of the said pope. The pope now, out of regard for Richard, king of England, who has petitioned on behalf of the said bishop, his counsellor, dispenses him to receive and retain in commendam with the said church of St. Asaph, of which he is still bishop, and with the said monastery, which he is still holding in commendam by papal dispensation, the yearly value of both not exceeding 1300 gold florins of the Camera, any benefice with or without cure wont to be held by secular clerks, even if a parish church or its perpetual vicarage, etc., and to resign it, simply or for exchange, etc. Exigit tue devocionis sinceritas.
