Erection, at the recent petition of Archibald Quhytlaw, archdeacon of Lothian (Lodouen.) in the church of St. Andrews, of a perpetual vicarage in the parish church of Curie in the diocese of St. Andrews (which is united to the said archdeaconry), for a perpetual vicar to exercise the cure of souls of the parishioners of the said parish church, with 24 marks a year of the money of Scotland from the fruits etc. of the said church, which are worth 100 like marks, a piece of land called an acre belonging to the said church, and a habitation in the house of the said church; with statute that the collation, provision, etc., of the said vicarage, as often as it becomes void, except this first turn, shall belong to the said Archibald, and to the archdeacon of Lothian for the time being. To John Bradi, perpetual vicar of Striueling in the diocese of St. Andrews. Reservation, as below. His recent petition contained that in order to put an end to the litigation which had been going on in those parts between him and Thomas Maklennoquhy, a canon of Dunbar in the diocese of St. Andrews, about a canonry of the said church and the prebend of Duns(e) therein, which are of the patronage of the king of Scots, and which both of them claimed, he has left the said Thomas in peaceful possession. The pope, therefore, at the petition also of James, king of Scots, hereby reserves to the said John, with the consent of the said Thomas, which has been given by his proctor, Master Peter Altissen, a papal scriptor and member of the pope's household, a yearly pension of 40l. of the money of Scotland, amounting to 9l. sterling, from the fruits etc. of the said canonry and prebend, value 24l. sterling, for life or until, with the help of the said Thomas, provision is made to him of a benefice or benefices of the same value as the said pension, the said pension to be paid by the said Thomas and his successors, half at St. John Baptist's, and half at Christmas; with the usual sanctions for non-payment, etc. Vite etc.

  • 5. Independently of the surname, the mention of the constitutions of Otto and Ottobon, sometime papal legates in England, decides his nationality.
  • 6. DatumSeptimo Kal. Junii anno tertiodecimo, which was the date of the provision, just above. There is a cross in the margin, which usually points to an error, the error in this case being ‘Septimo.’ The faculty was, in fact, often dated a day or two later than the provision, and in such cases begins ‘Cum nos nuper,’ or ‘Cum nos pradem,’ as here. See, however, the faculty to the archbishop elect of Dublin, just below, and cf. above, pp. 824–7, and note on p. 825.
  • 7. Preterea volumus quod formam huiusmodi a te tunc prestiti iuramenti nobis de verbo ad verbum per tuas patentes litteras tuo sigillo signatas per proprium nuntium quantotius destinare procures.
