To Walter Blake, a canon of Annaghdown (Enechdunen. [sic]). Mandate, as below. The recent petition of Thady Omygean, priest, of the diocese of Tuam, contained that after Martin V's (fn. 1) renewal of his predecessors’ sentences against simoniacs, on the voidance of a canonry of Tuam and the prebend of Kylmacnek alias Tempollergeal or Thechsaosan therein, and of the perpetual vicarage of Trachssasa (? recte Teachssasa[n]) in the diocese of Tuam, he made a bargain with the then officials of Tuam to the effect that if, in virtue of the special faculty which they had from the archbishop, they made provision to him of the said canonry and prebend and vicarage he would pay them a sum of money, thereby incurring simony and the sentences etc; therefor; that the said officials, after receiving the said sum, made him collation and provision, under pretext of which he obtained possession and has detained it for about twenty years, thereby incurring disability; and that, being under the said penalties, he has celebrated masses and other divine offices, but not in contempt of the Keys, etc., thereby contracting irregularity. The said collation and provision being therefore without force, the pope hereby orders the above canon to absolve the said Thady from simony and the said sentences, enjoining a salutary penance, dispense him on account of irregularity and rehabilitate him, and in the event of his so doing to collate and assign to him the said canonry and prebend and vicarage, value 2 and 1 marks sterling, respectively. To Alexander Culan, a canon of Aberdeen. Mandate, as below. The recent petition of John Malyssone, priest, of the diocese of Aberdeen, contained that after the renewal by Martin V and Eugenius IV and Paul II of their predecessors’ sentences of excommunication against simoniacs, he made a bargain with Alexander Ramsy, perpetual vicar of Bourty in the said diocese, to the effect that if the said Alexander resigned the said vicarage in his favour he would allow him to take all the fruits etc. for a year and a half; that the said Alexander accordingly resigned the said vicarage to Robert, bishop of Aberdeen, who, perhaps ignorant of the said bargain, made de facto collation and provision to the said John, who under pretext thereof obtained possession, and still detains it (the said Alexander having taken the said fruits for a year and half), thereby incurring simony and the sentences etc. therefore. The said collation and provision being therefore without force, and the said vicarage being still void as above, and the said John having, after the said simony, celebrated masses, etc., in ignorance of the law, but not in contempt of the Keys, the pope hereby orders the above canon to absolve … rehabilitate him (as in the preceding), and in the event of his so doing to collate and assign to him the said vicarage, value 6l. sterling, but he is first to give it up to him. To John de Burgo, a canon of Tuam. Mandate, as below. The pope has been informed by David Omury, rector of Kyllhyre[r]yn (fn. 2)alias Moynthyrhathay (fn. 3) in the diocese of Tuam, contained that Thady Ohanli, rector of Dunmor in the said diocese, of lay patronage, has for a long time kept a concubine, has committed perjury, and has contemned the repeated monitions of the present archbishop of Tuam to put away the said concubine. The pope, therefore, hereby orders the above canon, if the said David (who was lately dispensed by papal authority on account of illegitimacy, as the son of a priest and an unmarried woman, to be promoted to all, even holy orders and hold a benefice even if with cure, and to resign it, etc., after which he was so promoted and obtained the said church of Kyllhyre[r]yn (fn. 2)alias Moynthyrhat[ha]y, (fn. 3) value 8 marks sterling), will accuse the said Thady before him, to summon the latter, and if he find the foregoing to be true, to deprive and remove him, and in that event to collate and assign the said rectory, value 24 marks sterling, to the said David. To the official of Glasgow. Mandate to collate and assign to Robert Pettarn’, clerk, of the diocese of Glasgow, the perpetual vicarage of Colmarel (?) in that diocese, value 9l. sterling, void at the apostolic see, and therefore ipso facto reserved, by the resignation to the pope of William Flemyng, made by his proctor Peter Altissen, a canon of Segorbe (fn. 4) (Segobri[c]en.). To the archdeacon of Derry (Deren.). Mandate, as below. The pope has learned that the monastery of St. [Mary], Macosquin (de Clarofonte), O. Cist., in the diocese of Derry, has been so long void by the death of abbot Henry Olonhan extra R.c. that its provision has lapsed to the apostolic see, although Raymund Odonyll, a monk thereof, intruded himself into the rule etc. and has detained the said monastery for between one and three years after the said lapse, without any title or right, and still detains it. The pope, therefore, hereby orders the above archdeacon to summon the said Raymond and others concerned, and receive Maurice Okahan, clerk, of the said diocese (who was lately dispensed by papal authority on account of illegitimacy, as the son of a priest and an unmarried woman, to be promoted to all, even holy orders and hold a benefice even if with cure, after which he had himself made a clerk), as a monk of the said monastery, give him the regular habit, and receive his profession, and thereupon to make provision to him of the said monastery, value 8 marks sterling. The pope further grants him faculty to be blessed by any catholic bishop of his choice in communion with the apostolic see. Debitum pastoralis officii. [2½ pp.]
