Treasury warrant to the Principal Officers of the Ordnance to charge upon the account of Sir George Wharton, late Treasurer and Paymaster of the Ordnance, the item of 611l. 4s. 11¾d. as following. By the said Wharton's last state of cash, dated 1681, Aug. 12, there remained 2,533l. 13s. 6d. of the King's money in his hands, which sum was transferred to the account of Charles Bertie, present Treasurer and Paymaster of the Ordnance, by a privy seal of 1681-2, Jan. 31. But said Bertie has really received from the executors of the said Wharton only 1,922l. 8s. 6¼d., "by reason it since appeared by a more strict enquiry into the accounts of the said Sir George Wharton that he had not so much cash in his hands." Bertie is therefore hereby to have a debenture for the balance of 611l. 4s. 11¾d. and Wharton's account is to be charged with the same, he having had credit therein for the said balance, being more than his executors actually paid. Same to Sir John Sommers, Attorney General, to enter a noli prosequi to the information against Cornelius Noortwick and Derick Meyn, "owner" of the ship St. Martin, for importing 400 casks of refined Hars, which they alleged were manufactured and made in Holland of natural and coarse Hars without any rosen used therein or any of those materials of which rosen is made ; but being Dutchmen and not knowing the right English name of the goods they entered it as rosin, "which it seems is prohibited to be imported from Holland" ; and the Customs Commissioners having reported that the commodity in question is of a distinct species from that of rosin, the latter being made of French turpentine and is called in Holland by the name of Harpuijs, whereas the former is made of a gum or pitch of the product of Muscovia, and was actually manufactured or made up at Edam in Holland and is distinguished by the name of Hars : wherefore the said Commissioners are of opinion that although by the Act of Frauds [14 Car. II, c. 11, § 23] no sort of rozin may be imported from Germany or the Netherlands, yet this being a distinct production from that commonly called rosin and really the manufacture of Holland (though it seems to be of the same kind and bears the same figure with rosin and serves for the same uses and purposes) their case may be favourably considered, the rather because the rosin of France is at this time prohibited and the commodity at this time very useful. Treasury reference to the Attorney General of the petition of William Claver, shewing that, being a Customs officer at Weymouth, he prosecuted one Richard Strong for transporting wool, who was found guilty and fined 90l. ; that Strong brought an action for 170l., money lent by his son and others, and this and the 300l. costs of the suit has forced petitioner to sell all he had ; that he has since brought an action for perjury against John Strong, and Richard Strong is willing to repair petitioner's damages if the proceedings can be stayed : therefore petitioner prays a noli prosequi to the said proceedings. Treasury warrant to the King's Remembrancer for a constat or particular of the capital messuage lately called Clarendon House and divers lands there built or in building and other estates either in fee or for term of years and debts and other things which by several writs of extent and inquisitions thereon were found to belong to John Hind, late of London, goldsmith, or others in trust for him, and were seized into the hands of Charles II or James II for satisfaction of several debts. Same to the Excise Commissioners to discharge Michael Arnold of Westminster, brewer, of the 102l. 13s. 6½d. which his father, Major Arnold (who was brewer to the late King James II), was indebted for the Excise of beer and ale brewed by him in his late brewhouse in St. Peter Street between 1687, Aug. 13, and Feb. 11 following ; and for which the said Commissioners have passed judgment against the father whereby the brewing vessels are liable ; whereas it appears that Michael purchased same from his father two years before the latter's death, who has not left assets to pay the debt ; but that 200l. remains due to him from James II for beer and ale delivered into that King's cellar at Whitehall. The present discharge is to be in lieu and satisfaction of the said 200l. Ibid, p. 51.

Prefixing : (a) Order of the Privy Council, dated Whitehall, July 21 inst., granting leave to the ship Mary of London, Henry Young master, 70 tons, eight men and a boy, to sail to Jamaica ; on the petition of William Bird, John Pargiter and others of London, merchants, setting forth that they are in contract with the Spaniards to furnish them [the Spaniards] with 200 negroes at 28l. per head from Jamaica, to be delivered at Havanna within a time limited and under a penalty, which contract will expire about the latter end of October next, therefore praying leave for said ship to sail with advice and instructions necessary upon this matter.

The premises are part of the seven tenements and an orchard which were granted to John Rook for 31 years from 1663, four whereof had been built by persons who had purchased from the late [Usurped] Powers. The other tenements were Bremblecomb's tenement, since passed to Andrews by lease of Dec., 1687 ; and Hen. Fitz Williams' tenement ; and three still held by said Rooke.

Treasury reference to the Customs Commissioners of the petition of James Kenny, owner of the ship St. Patrick of Galway, shewing that said ship was laden at Cadiz with Spanish wine and salt for petitioner's account, and was taken by the French and carried into Brest ; therefore praying licence to redeem the ship and cargo, he giving security that no French goods shall be laden on her : said petition being referred to the Treasury from the Privy Council the 21st inst. July 25. Henry Guy to the Auditor of the Receipt to issue to Edward Russell, Treasurer of the Navy, on the unsatisfied order in his name for the service of the Navy the 4,500l. which said Russell will lend into the Exchequer on the three fourths of the Customs, together with the 6,724l. 13s. 7d. and 13,275l. 6s. 5d. which he will also lend on the credit of the Exchequer in general : making in all 24,500l. My Lords desire that out of the 3,751l. 10s. 0d., which was directed the 21st inst., supra, p. 1734, to be put into the hands of the Treasurer of the Navy (for four months to the officers of the Marine Regiment) 1,998l. 15s. 0d. may be issued to the Earl of Danby for the officers of his Regiment (the Clerk of the Cheque and his two deputies being established in that Regiment), and the remaining 1,752l. 15s. 0d. to Admiral Killegrew for the officers of that [other] Regiment. Same to the Auditor of the Receipt to issue to Charles Fox and Lord Coningsby on their unsatisfied order for the service of the Forces late in Ireland the 6,768l. 5s. 0d., which said Fox will lend into the Exchequer on the three fourths of the Customs : same being intended to be paid to Ebenezer Donwell et al. for clothing furnished to the Regiments of Nassau, [Lord] Cutts, [Col.] Lloyd, [Col. Richard] Brewer and [Col. Samuel] Venner. It is agreed that 6 per cent. interest be paid on 1,768l. 5s. 0d., part of said loan, from the date of the tallies of the loan, and on the remaining 5,000l. of it from Oct. 15 next. Ibid, p. 156.
Henry Guy to the Auditor of the Receipt to issue to Charles Fox and Lord Coningsby on the like order the 6,000l. which said Fox will lend on credit of the Exchequer in general and the 6,000l. which he will lend on the three fourths of the Customs. Both these sums are intended for the Danish Forces. A postscript to this order (to the effect that the interest on the 6,000l. lent on the Customs is only to commence from Dec. 1 next) is cancelled. The East India Company demand 5l. per hundredweight for brown saltpetre and 5l. 10s. 0d. for the white, "which at a General Court held the 6th of this inst. was then declared to be under the present market price." Please inform my Lords what quantity of saltpetre may be bought abroad and at what rates. Ibid.
Same to Mr. Edward Wigg. I have read to my Lords your memorial desiring convoy for the clothing for Sir John Hanmer's Regiment, "which [clothing] is to be sent to Cork." Are the clothes here or at Bristol? Ibid.
Same to Mr. [Charles] Fox, enclosing a list [missing] of the officers that came in upon the capitulation of Limerick, with an account of money due to them, amounting to 332l. 10s. 0d. You are to pay them in the proportions set down and put the money in your [next weekly] memorial for money. Ibid.
Same to Mr. [Auditor] Aldworth. There is 11,183l. 1s. 0d. due from the Office of Ordnance to Mr. Schulenburg for provisions [of war] bought by him in Holland. His Majesty agreed in January last that this should be satisfied by 1,000l. per week after payment of what was then due to Schulenburg from the Earl of Ranelagh, the first weekly payment to commence from Feb. 4, and in case of failure of any of those payments he was to have 6 per cent. interest and 2 per cent. gratuity.
Also, there were bills drawn by Schulenburg for money paid in Flanders for the Troops of Saxe Gotha which should have been paid by said Earl on the last days of grace, viz. 5,300l. on Mar. 11 last and 892l. on April 29 last, with the like interest and gratuity in case of failure.
Of these sums only 1,000l. was paid Mar. 8 last by the Treasurer of the Ordnance. You are therefore to compute the interest and gratuity on the unpaid balances.

Treasury reference to the Customs Commissioners of the petition of Rob. Heysham and Tho. Merritt of London, merchants, shewing that two ships arrived in the Hope from Barbados are ordered to perform quarantine ; that the men are in good health ; therefore praying that the quarantine period may be reduced to half. Reference Book VI, p. 413.
Same to the Attorney and Solicitor General of the petition of Sir Cornwall Bradshaw et al., Managers of the Hearthmoney for the five years ended 1684, Lady day, shewing that, in aid of petitioners, extents issued against Hind and Toplady and divers lands and houses etc. were seized into the hands of the late King : therefore praying a grant of such seized estate. Royal warrant to same to allow to Richard Savage, esq., Clerk of the Crown in the King's Bench [Ireland], 40s. each for the persons by him indicted and convicted for treason : it appearing from his petition that he has prosecuted about 4,000 persons in Ireland (who were lately in arms against their Majesties) for high treason, of which they stand outlawed, and their estates by virtue thereof seized and vested in the Crown to a great value, but that he has not received any recompense for himself or servants who have been employed for more than a year in that service. On which petition you, the Lords Justices, have reported that in the Rebellion of 1641 the Clerk of the Crown in the King's Bench was allowed as above by order of the then Government for indicting and attainting and that same was paid in money or grants of forfeited lands in custodiam and further that the petitioner's salary is but 7l. 10s. 0d. per an. and his office in that [year's] time was of no profit to him [in the way of fees].
