Same to the Victualling Commissioners. My Lords
agree to your report concerning the hire of ships
to carry provisions and soldiers to the West Indies.
You are to contract for the transports accordingly.
They will take care to furnish the moneys necessary.
Appending : said report, dated July 29. In 1690
we sent several prisoners to the West Indies, freight
free [in his Majesty's ships] : but in the case of
one ship which laded wholly with provisions we
agreed to 30s. a ton for the one half and the other
half to go freight free : which was 15s. a ton for
the whole. In May, 1691, we had likewise provisions
on some ships carried freight free. To one
which carried only bread and oil we gave 17s. a
ton in cask, which was about 34s. per ton [of] the
usual tonnage for bread. In September, 1691,
we laded about 440 tons of provisions. On 110
tons thereof, laden in three ships, we paid but 20s.
a ton ; on 205 tons, laden in two ships, 30s. a ton ;
and on 125 tons, laden in one ship, we paid 40s. a
ton. All the freight was to be paid here in London
on certificates of delivery in the West Indies.
We think the proposed freight of 20s. a ton is
moderate for ships carrying any considerable
quantity ; but those that carry less in proportion
may accept of a less freight. If there be a considerable
quantity of provisions to send, as we
apprehend there may be, it will be impossible to
procure freight at the proposed price unless all
ships be obliged to take a proportion of the freight.
As to the freight for carrying soldiers, we have
never had to do with that matter, but have heard
that 4l. per head has been given when the owners
of the ship found provisions for the soldiers. We
think this is much dearer than what is now proposed.
For we account the voyage may be performed in
two months, and so the provisions for the men
cannot at the most come to more than 40s. per man.
Therefore we think the proposal of 20s. per man
is indifferent ; nothing being reckoned for the
freight of the provisions laden for them. Unless
all the ships permitted to go be obliged to carry
their proportion, no number of men can be transported
on the terms proposed.
Six Freinds, 280 tons, 20 guns, 28 men : proposed
by Capt. Hum. South and Richard Diamond :
offers to carry provisions or stores from Portsmouth
to the West Indies to the quantity of 200 tons at
20s. per ton : also a number of soldiers not exceeding
150 at 20s. per head, the King finding them provisions
and hammocks to lie in ; the tonnage of
their provisions to be accounted as part of the
above 200 tons, but no freight to be reckoned for
it : [further] proposeth to carry any provisions
or stores [from London] to Portsmouth on their
way on condition of protection for her men : the
stores and soldiers for the West Indies to be shipped
before Sept. 30 and the freight to be paid here [in
London].

and up to 50 soldiors on terms as above.

Report to the Treasury Lords from William Blathwaite
[as Auditor of the Plantations] on the petition
of John Addis, ut supra, p. 1727. By letters of
Mar. 4 last from Col. Kendall, Governor in Chief of
Barbados, to the Committee of Trade and Plantations,
it appears that upon the coming of the French
squadron of ships of war into the West Indies
and the danger he apprehended to the Leeward
Islands and the merchants' fleet there, Col. Kendall
hired a small vessel on purpose to give the speediest
account that might be of the condition and circumstances
of their Majesties' affairs as well in relation
to the ships of war as other matters of importance
there. This vessel he certified to the Navy Commissioners
to be the brigantine Expedition, Samuel
Harris master, and that the master is to be allowed
90l. for that service. Col. Kendal has drawn a
bill for 90l. on the said Commissioners. If the
Treasury do not enable them to satisfy same it will
discourage masters of ships in the West Indies from
hiring their vessels for their Majesties' service upon
the like emergency. |

Royal warrant, under the Queen's sign manual, to
the Attorney or Solicitor General for a great seal
for a grant to Sir Joseph Herne et al. of quit rents
as follows in the form of an indenture [subsequently]
dated Aug. 9, between their Majesties of the one
part and Sir Joseph Herne, Sir Stephen Evance of
London, kts., and William Scawen of London, esq.
The said three persons have advanced or lent, or
agreed forthwith to advance 30,000l. sterling and
further before Michaelmas, 1694, will lend hereafter
"some further sum" for their Majesties' occasions
in Ireland, according to agreements to be made
between them and the Chief Governors of Ireland.
In consideration thereof and to secure the repayment
thereof with 10 per cent. interest (being the
lawful interest in the kingdom of Ireland), their
Majesties hereby demise, grant, bargain and sell to
them all the quit rents of 3d. per English acre
per an. in the Province of Leinster ; and of 2¼d.
per acre per an. in the Province of Munster ; and of
1½d. per acre per an. in the Province of Connaught ;
and of 2d. per acre per an. in the Province of Ulster ;
and of 1s. 6d. yearly out of every 20s. rent for
which any house or tenements were granted in
any Corporations in Ireland which were allotted
to any person to satisfy arrears due to any commissioned
officer who served Charles I or Charles II
in the wars in Ireland before 5 June, 1649 ; and
of all and every the annual quit rents payable by
adventurers, soldiers, reprized persons or officers
under the Act of Settlement and Act of Explanation
or by any other Act of Parliament whatsoever or
payable likewise on lands set out for the augmentation
of bishoprics, for endowments of parochial
churches with glebes, for the support of Trinity
College, the maintenance of Duncannon Fort, the
benefit of the Corporation of Bandon Bridge, or on
lands enjoyed by transplanted persons in the
Province of Connaught in County Clare and on all
other lands seized and sequestered by reason of
the Rebellion : and also all chief rents, Crown rents,
rents service, rents of inheritance, rents of assize,
rents charge, rents seck or dry rents, fee farm rents,
rents or leases, custodiam rents, composition rents
or composition money, Exchequer rents, rents
nomine decimae or vicesimae, assart rents, rents due
for purprestures arrented, copyhold rents and other
rents payable to their Majesties in Ireland now in
charge or existent : all to hold to them and the
said Herne, Evance and Scawen, their assigns etc.
for 21 years : they paying therefor a peppercorn rent
yearly on May 1 at Strongbow's tomb in Dublin.
The said Herne, Evance and Scawen undertake
within 60 days of the making of this indenture to
pay the said 30,000l. into the Exchequer, Ireland.
Full aid of the Exchequer to be given them in
getting in the said rents and they to have access
to all records relating thereto.
Nevertheless the Crown to have the right during
said term of 21 years to moderate the quit rents
upon the most coarse and barren and insolvent
lands in Ireland so as to encourage plantation
answerable to the clause in the Act of Explanation.
Provided also that on due repayment by the Crown
of said 30,000l. (viz. by successive quarters thereof
at Lady day, 1693, Michaelmas, 1693, Lady day, 1694,
and Michaelmas, 1694), and on due repayment (at
dates to be agreed hereafter) of any such "further
sum" as above and interest thereon ; then the
present demise shall be void and of none effect :
but in default of such repayment they shall hereby
quietly enjoy the full of said term. But until some
such default be made in the repayment of the said
moneys it shall be lawful for their Majesties to
receive and enjoy the said rents to their own use
and behoof without impediment or interruption
from the said Herne, Evance and Scawen. |

and all earth, soils and ground for the making of
saltpetre and all minerals, earths, stones and salts
whatsoever, open or not and discovered or not,
within all and every their Majesties' Plantations or
Colonies in America, excepting only the Colonies
of New England, Virginia and all parts northward
of Carolina : with free liberty to him to search,
dig and open etc., etc. ; to hold for 51 years from
date hereof : rendering to the Crown a sixth part
of the gold and silver, to be paid into the Exchequer,
England ; and a sixth part of the saltpetre, to be
served into the Ordnance Office Stores ; and a tenth
part of all lead, tin, copper, minerals and other the
said premises. He to keep and render fair accounts,
to be open to Treasury inspection. Neale is further
hereby empowered to enter and work upon any
mines or minerals formerly granted to Christopher,
Duke of Albemarle, deceased, or any others, in all
cases where the grants thereof are void by reason
of not working or for any other reason. This grant
to be void if Neale do not open or work some mine
or mines within each of the herein Colonies or

Prefixing : (a) Order of the Queen in Council, dated
Whitehall, Aug. 1 inst., for ships to do quarantine
at the Hope as follows ; allowing to ships which
have remained in any port of Ireland, Scotland,
the Scilly Isles or Isle of Man a deduction of the
time they have stayed there. At the end of the
quarantine the Customs officers concerned are to
certify that they have frequently mustered the
men on board during the quarantine and the ship's
master is to take an oath before a mayor or magistrate
as to the ship's health before the ship be
discharged. The present order is made on a report
from the Customs Commissioners dated July 27
last. The information of the sickness at Jamaica
and the Leeward Islands came from Mr. Napper,
surveyor of Customs at Penzance, the 10th inst.,
giving an account of two vessels arrived from
Jamaica, one of which had lost five men and the
other agreed that the sickness increased rather than
diminished at Jamaica. Major Lane, surveyor of
the Navigation [Act], and Mr. Whitehall were
instructed to repair down the river to execute the
quarantine at Hole Haven, but reported that the
Hope is more a convenient and safe place for ships
from the West Indies. Capt. Nash, an officer of
good experience, who remembers the keeping a
former quarantine on ships from Holland, agrees
therewith, as generally the ships from the West
Indies are of larger burthen. |

Report to the Queen from the Treasury Lords on the
petition of John St. Leger, esq. By the report of
the Lord Lieutenant herewith [missing] thereon it
appears that St. Leger has suffered in his estate
by the rebels there to the value of above 6,000l.,
and thereby he and his family are reduced to great
necessity. Petitioner offers to discover some concealments
of mortgages, bonds etc. utterly unknown
to the Revenue Commissioners, Ireland, and prays
a grant of what he shall recover thereof to the
Crown on his answering one fourth thereof to the
Crown. We think petitioner may have the aid of
the Exchequer for recovery of the said moneys and
that a third thereof may go to the Crown and two
thirds to him as royal bounty. |

Treasury warrant to the Surveyor General of Crown
Lands for a particular of all those lands called
Whitwell, parcel of the manor of Fordington, co.
Dorset, and of the fishery of said manor, all parcel
of the Duchy of Cornwall ; in order to a new
lease thereof to Eliz. Loup for 31 years at 43s. 4d.
per an. and 20s. per an. for the fishery, and fine
of 50l.
Prefixing : report by William Tailer, Deputy Surveyor
General of Crown Lands, on said Loup's petition.
The premises were granted 1661, Aug. 8, to Thomas
Loup. On 8 May, 1662, he assigned to John Loup,
petitioner's late husband. Sir Charles Harbord
valued them at 12l. per an. : they have been formerly
let for 13l. per an., but petitioner alleges that lands
are much fallen in those parts, and she cannot get
above 10l. per an. for them. They are only a barren
down, incapable of improvement and without a
house. |
