Feb. 2. Treasury warrant to the Clerk of the Pipe for a lease to John Gibbons of Chipping Wycombe, gent., of a wood, underwood and woodland, called St. John's Wood, in the parish of Chipping Wycombe, co. Bucks, containing 275 acres, formerly in the tenure of Robert Rannce and late in that of Sir Robert Johnson, and demised to Henry Seymour by patent dated 1661, Oct. 2, etc., ut supra, p. 1348, the premises being of the clear yearly value of 40l. The present lease is to be for 31 years from the termination of Seymour's term in being ; at 30l. per an. rent from the actual commencement, which the Surveyor General [of Crown Lands] thinks is the full present value of the premises : with covenants as before for felling the woods at fit times, but not above once in 10 years, and leaving sufficient standards etc.

Same to the Customs Commissioners to take only the lesser duty on coals exported or to be exported to the Plantations as follows. In a memorial of Dec. 23 last the said Commissioners represented that by the Act of Tonnage and Poundage, 12 Car. II, c. 4, sea coals exported in English ships are to pay 5s. the chaldron London measure and 8s. Newcastle measure. By the Act of Trade, 15 Car. II, c. 7, the said duty, with particular regard to the encouragement of the English Plantations, was lessened to 1s. London measure and 1s. 8d. Newcastle measure. The Act of Tonnage and Poundage now subsisting [2 Wm. and Mary, c. 4] grants the said duties for four years according to the rates as in the Act of 12 Car. II, c. 4, and rules and orders thereto annexed "other than such concerning which it is otherwise provided or ordained by any Act made in the last Parliament." "Now though this last grant is passed as a Public Aid, and so to be construed most beneficially for their Majesties' advantage, and though the said Act of 15 Car. II, c. 7, be not particularly mentioned therein as revived (as many others are), yet inasmuch as the said Act of Trade is generally looked upon to be a perpetual law and that the Plantations do not deserve less encouragement now than when that law was first passed in their favour, the question arises whether the greater or lesser duties upon coals is now to be taken : and we [the Treasury Lords] having received the opinion of their Majesties' Attorney General that the law is not clear in this case, but it is a probable opinion that the lesser duty may be taken according to the Act 15 Car. II [c. 7], that the law was understood and practised so in the reign of King James II, that the most favourable construction is to be used for the publique good and this lowering is affirmed to be a prudent policy for the encouragement of the Plantations and the increase of navigation." Feb. 8. Treasury warrant to the Surveyor General of Crown Lands for a particular and ratal of several parcels of land, in order to a lease thereof to Robert Price for 29 years in reversion of the existing term : at 3l. 18s. 0d. per an. rent and fine of 3l.
Prefixing : report by William Tailer, Deputy Surveyor General of Crown Lands, on said Price's petition for said lease. A particular was made out 1687, Oct. 31, pursuant to a Treasury warrant of 1687, June 16 (supra, Calendar of Treasury Books, Vol. VIII, p. 1693), but before the same was rated Mr. Fisher, then Deputy Surveyor of Crown Lands, found that some of the premises were assigned to another person, and Mr. Price was thereby unable to make a surrender of the lease in being. Therefore Mr. Fisher advised a reversionary lease for 25½ years from 1693, Michaelmas, at 3l. 18s. 0d. per an. rent and fine of 40s. But Mr. Fisher dying soon after that report, it was not proceeded in. According to Fisher's report, the premises seem scarce worth the charge of passing a lease.
[The warrant to the Clerk of the Pipe for this lease does not appear in the Treasury records : but there is an undated entry of the Treasury Lords' signature of the docquet of a lease to Robert Price, esq., of several lands and tenements in Clifford, Huntington and the city of Hereford and of two cottages in Tenbury in co. Worcester for the term, rent and fine as above.]

Treasury warrant to the Commissioners [of Excise and of] the late revenue of Hearthmoney and to the auditors of same to forbear and surcease all process against Charles Deering (Dearing), late Comptroller of that revenue, on account of the debt of 260l., representing money in his hands at the time of his Majestys' landing in England, which he was forced to make use of to enable himself and his brothers to declare for his Majesty's service ; his employment being taken away by the ceasing of the said revenue, whereby he has been utterly unable to repay same : his Majesty having signified his pleasure to remit the debt. Henry Guy to the Auditor of the Receipt to issue (out of any unappropriated arrears of taxes) 156l. to Dr. Titus Oates on his order of the 6th inst., ut supra, p. 1479 : "taking only such fees as were directed by their Lordships' order, dated June [July] 8 last," supra, pp. 1221-2. Same to the Mayor and Recorder of Plymouth. Complaint has been made to my Lords by the Commissioners for Victualling the Navy that you caused their Majesties' Victualling Office to be taxed for the last year at 12s. per month and caused the collectors, Thomas Rashley and John Crabb, to distrain for the same on their Majesties' goods and to take 7l. 10s. 0d. for redemption thereof. I am commanded to ask you to give their Lordships a speedy account upon what reason the same was done, "because their Majesties' houses being for public use are noe where taxed." Treasury warrant to the Surveyor General of Crown Lands for a particular and ratal of the two Hundreds of Toseland and Leighton[stone], co. Huntingdon, in order to a new lease thereof to Charles, Earl of Manchester, for 31 years from 1692, Lady day, at 57s. 9d. rent.
Prefixing : report by William Tailer, Deputy Surveyor General of Crown Lands, on the said Earl's petition, ut supra, p. 1436. The said Hundreds are rather honorary than profitable and have been long in petitioner's family, the last lease being 1660-1, Mar. 22, to Edward, Earl of Manchester, at the same rental, which was very near the full value of the certain rents. The casualties are very inconsiderable.

Royal warrant [to the Treasury Lords] to allow to Charles Fox and Thomas Coningsby in their account to Dec. 31 of the Forces in Ireland the sum of 24,097l. 15s. 3½d., which by the King's directions they have paid to Jacob Vander Esch "without deductions on the several days mentioned in the accompt [missing] hereunto annexed" ; they producing to you acquittances vouching the payment of same.
