Royal warrant to the Attorney or Solicitor General
for a great seal for 22,500l. to the East India Company
for 500 tons of brown saltpetre which on
Aug. 30 last said Company furnished into the
[Ordnance] stores at 45l. per ton, the price agreed
on : same to be payable out of the Customs of
East India goods imported by said Company since
Aug. 1 last from within the limits of their charter,
excepting the Customs on the goods lately imported
in the ships Loyal Merchant and Bengala Merchant
and excepting also the Customs on such goods
which from Michaelmas, 1689, are appropriated
by Act of Parliament to the satisfaction of moneys
due to the States General and to the arrears of
the servants of Charles II. The said 22,500l. is
hereby to be issued to the Treasurer of the Ordnance
on imprest, who shall pay said Company by tallies
to be levied on the said Customs to the amount of

Charles II took Windsor Great Park out of charge
from payments to any land taxes raised upon the
several towns that are within the said park ; and
he therefore desires a discharge from the assessments
to the present Aid. From the report of the 30th
inst. hereon from the Agents for Taxes it appears
that in the 1670 subsidy the Receiver was discharged
of 14l. assessed on the park, but in the
subsequent taxes (the Seventeen Months', Eighteen
Months' and Six Months' Assessments) the Receiver
was not discharged of any sum on this head : but
they think the premises should be discharged of
the present Aid unless the petitioner or some other
in possession make benefit by agistments or otherwise.
Inform yourself as to this and discharge
the remainder of the said assessment and lay the
sum, as discharged, upon other lands in the county
so that the King may not lose any part of the
money granted by the Act. |

that the grants of all three manors will
expire in 1691 and that of Mere is now in possession
of Sir Math. Andrews by assignment from Phelips.

Treasury warrant to the Excise Commissioners to
admit to entry on payment only of the old duty of
1s. 4d. per gallon the four tons of brandy imported
by Thomas Whitehorn, master of the Leonora of
London, who, when out on a trading voyage about
12 months since, did take in in France a lading of
wine and brandy for the Spanish West Indies and
so proceeded to one of the Bahama Islands called
Gordo, where about April last he met an English
pirate named Isaack Robinson with 120 men on
board, who robbed him of most of his lading, rigging
and provisions, which forced him to make for
Newfoundland, and he arrived in the Channel
July 29 last with nothing to pay his seamen's
wages but his small vessel of 30 tons and four tons
of brandy, being part of what the pirates left ;
for which additional duty is demanded, as he
arrived four or five days after the late [made] Act
was [put] in force, although said brandy had been
out of France this twelvemonth : and the Customs
Commissioners having reported that said statements
are true and that said Whitehorn's case is deplorable
and he a fit object of charity. |

Royal warrant to the Clerk of the Signet for a privy
seal, in the usual form, for authorising the Exchequer
Court (the Treasury Lords, the Barons of
the Exchequer and the Attorney General) to make
regulations and compositions in the matter of
Customs seizures and forfeitures : all by reason
that such forfeitures etc. may arise sometimes
through want of knowledge of the laws of the
realm, negligence of servants, want of true intelligence
by letters and invoices, diversity of weights
and measures therein as between English and
foreign weights, or poverty of the owners ; which
circumstances have encouraged informers to make
idle and frivolous informations, and further by
reason that sometimes after seizures made the
officers themselves agree and compound with the
offenders without due warrant and sometimes said
officers having licence out of the Exchequer or
other Court for compounding their share of such
seizures, they return same into said Courts "with
nomination what such persons had who had such
letters of licence and so the suit is ended" and the
King reaps no benefit thereby : and some names
are put in for the owner of the goods that cannot
be heard of whereby the King is deceived of his
part or else the goods are demised in the hands of
some pauper who knows nothing thereof or is
unable to bear any loss ; and oftentimes fines
have been stricken so low that little or nothing
accrues to the Crown thereby and commonly also
the goods are appraised at under values and dispersed
where the seizer thinks fit, leaving the
King's part to be sought after, which in truth comes
to little or nothing. For remedy whereof the said
Treasury Lords, Barons and Attorney General are
hereby authorised to take order herein in mitigating
or increasing fines as they think fit and to prevent
the daily abuse of multitudes of informations and
private compositions ; and no licence, writ of
delivery or other warrant to compound is to be
given without their consent. All persons making
a seizure are instantly to deliver a true note of the
same to the Register for [Seizures or] Forfeited
Goods, London port, who is from time to time to
inform the said Treasury Lords etc., and no prosecution
is to be commenced until such note be delivered
and until the Attorney or Clerk of the Court be
authorised to enter same by a note in writing from
said Lords etc. Further to take special order for
delivering all seizures to such persons only as said
Lords etc. shall authorise and for seeing that the
King's share be so much as in conscience it ought
to be : and to order the Register of Seizures to
oversee all writs of appraisements returned from
the outports and to stay those under-appraised :
and to take order for punishing such underappraisors.
The Register of Seizures is hereby to
receive for the King's use all fines under 5l., giving
his acquittance for same, which is hereby to be a
legal discharge. But no fines are to be set at less
than half so much as the informer is to receive for
his part. |
