To the archbishop of Canterbury, (fn. 2) the bishop of Winchester and the dean of London. Mandate etc. as below. The pope recapitulates Martin V's confirmation, granted [on Feb. 21, 1430, above, p. 174] at the petition of the wardens and guardians of the art or mistery of barbers dwelling in the city of London, of the statute made by the late archbishop Thomas and suffragans in a provincial council against barbers who kept their houses and shops open on Sundays for the exercise of their art, and the mandate of the same pope for the execution of the said statute. At the recent petition of the said wardens and guardians, containing that some of the said art or mistery, dwelling within the bounds of churches and monasteries of the province of Canterbury and the city and diocese of London, especially of St. Martin's-le-Grand, London, and the monastery of Westminster, under pretext of the exemptions granted to them and to the said places by papal and royal authority, still keep their houses and shops open on Sundays, in contempt of the said statute and mandate, the pope hereby declares that such exempt persons and places are comprised in the said statute and mandate, and orders the above three to cause the said statute to be observed thereby and therein in accordance with his said predecessor's letters. The recent petition of John May, rector of the parish church of Staneweye, and of all the inhabitants of Little Staneweye in the said diocese, contained that a cause arose lately between them, and was brought before [the late] bishop Robert (fn. 4) [Braybrooke], not by papal delegation, the said inhabitants asserting that the rector for the time being was bound to depute at his expense a chaplain, to celebrate mass etc. daily in the chapel of the said place, which is a daughter chapel of the said church, and the said John asserting that the said inhabitants were bound to bear a share of the repair of the nave, which was collapsed, and of the belltower of the said church, as well as of the enclosure of its cemetery, and of certain other burdens; and that the said bishop by a definitive sentence declared the said John and the said inhabitants to be respectively bound, as above. Formerly, in the hope that his agent in the Roman court had obtained or would shortly obtain for him a dispensation to hold two incompatible benefices, even if two parish churches, he consented to the collation, made to him by authority of the ordinary, of the parish church of Bisshoppesborne in the diocese of Canterbury, which, however, having had possession, he resigned upon learning that the said dispensation had not been obtained. Martin V dispensed him to hold for seven years with his parish church of Kyngion (sic) Magna in the diocese of Salisbury one other benefice with cure or otherwise incompatible, and to resign both, simply or for exchange, as often as he pleased [Cal. Subsequently, on Nicholas, who is of noble birth, setting forth to the said pope that after the said dispensation he obtained the church of Witrisham, value not exceeding 30 marks [see ibid., p. 403] and, after holding it for some time with Kyngion Magna, resigned the latter and obtained in its stead the church of Yden, value not exceeding 20, in the dioceses of Canterbury and Chichester, which last he was holding with Witrisham in virtue of the said dispensation, pope Martin, on 6 Kal. Mandate, at the recent petition of the Benedictine abbot and convent of St. Albans, immediately subject to the Roman church—containing that they formerly, on account of the uncertainty of the times and the instability of prosperity, decided that, with a view to the collection and keeping of certain fruits and emoluments for the needs of the monastery and its inmates, a certain chest should be perpetually kept in the monastery, and made divers statutes for meeting emergencies; that they instituted, moreover, for the repair and maintenance of the buildings of the church of the monastery and (fn. 9) the payment of moneys for the rooms of the brethren and the pittances, a certain office, under the name of the office of the works (officium operarie), whose possessor should be bound to maintain the said buildings and pay the moneys for the said rooms and pittances; and that they assigned to the said office certain goods for the support of the burdens which they had imposed on the said possessor on account of the said office, and willed that what remained every year after the said burdens had been deducted should be handed over by the said possessor to the keepers of the said chest, etc.—if he find the aforesaid reasonable, to approve and confirm the same. To Dermit Macgaedagan, clerk, of the diocese of Elphin. A like decree, and for the same reason, in regard to the belowmentioned dated letters of Martin V. That pope ordered provision to be made to Dermit of the rural rectory, without cure, and value not exceeding 8 marks, of the rural lands of Druymeliab (rectius Druymcliab) in the said diocese, void by the death of Thomas Otarpa [above, p. 5]. Subsequently, namely on Non. Dec. anno 14 [1430], the said pope—on its being set forth to him by Dermit that he feared lest the said letters, in virtue of which he had obtained possession, should be impugned as surreptitious and invalid, because it was asserted by some that the said rectory at the time of the date thereof was void otherwise than in the way stated, and had been void so long that there was no certain knowledge of the true manner of voidance, that the fruits etc. exceeded the above value, although they were not worth more than 10 marks, and that the said rectory, although it was actually without cure, was to be deemed as habitually having cure (ipsamque rectoriam, licet ei actu cura non immineret animarum, habitu tamen curatam censendam fore)—granted to him (who asserted that he had not yet received any of the fruits on account of divers impediments of lay power, and to whom the said pope had lately [above, p. 117] made provision of a canonry of Achonry and another of Killala, with reservation of as many prebends) that the said first letters and their consequences should hold good from the said date, as if in them the said mode of voidance had been omitted and the rectory had been described as having been so long void etc.as above, as if the fruits etc. had been stated to not exceed 10 marks, and as if the rectory had been stated to have cure.Racioni etc. (An. and H. To the bishop of Rochester. Decree and mandate, as below. Upon its being set forth to Martin V by Henry, archbishop of Canterbury, that he desired to found within the parish of Hiegham Ferrers in the diocese of Lincoln a college of secular chaplains and clerks under the name of St. Mary and SS. Thomas the Martyr and Edward the Confessor, with a church, bell-tower, bells, houses, gardens etc., for the perpetual saying and celebration of masses and other divine offices, and to endow it for a master and seven or eight or more priests and other secular clerks, the said pope granted him licence to so found and endow and to make the needful statutes, and to reserve the patronage of the said college to the archbishops of Canterbury in perpetuity [see Cal. Lett. VII, p. 298]. Subsequently—upon its being set forth by archbishop Henry to the said pope that he had founded the said college within the said parish, in such wise that one of the said college should be called master or warden, that the mastership or wardenship should be considered to be an office without cure compatible with any other benefice, that the said master or warden should be presented to the perpetual vicarage of the parish church of Hiegham Ferrers by the dean and chapter of the collegiate church, which was also a parish church, of St. Mary, Leicester, to which Hiegham Ferrers is appropriated (as had been ordained in a composition made between the said archbishop and the said dean and chapter), and that the said master or warden should be bound by oath to keep continual personal residence at the said collegiate and parish church of Hiegham Ferrers and exercise its cure of souls, etc.—the said pope, on Non. June anno 9 [1426], ordered a certain judge, if the facts were so, to confirm the aforesaid, and moreover to dispense John Smale, then rector of Sandrisch in the diocese of Rochester, who was the first to be instituted in the said wardenship, to hold together for life the said church of Sandrisch, the said vicarage (when he should be presented and instituted) and the said mastership or wardenship, value not exceeding 30, 24 and 40 (fn. 11) marks sterling respectively, or, after resigning Sandrisch, to hold for life (as in like manner his successors in the said mastership or wardenship), together with the said vicarage, one other benefice with cure or otherwise incompatible, and to resign such other benefice, simply or for exchange, as often as he and they pleased. At the said archbishop's recent petition, containing that, the said wardenship becoming void by the resignation made to him of the said John, he collated it to Elias Holcote, priest, of the diocese of Lincoln, M.A., the pope, inasmuch as the said letters of Martin V in the matter of the said dispensation etc. were, by reason of his death, not drawn up, hereby decrees that the said dispensation etc. shall nevertheless hold good from the said date, and that these presents shall be sufficient proof thereof, and orders the above bishop to inquire into the truth of and to confirm all the foregoing, and to dispense the said Elias and his successors in accordance with the will of pope Martin. The petition of John, son of Gilbert de Alburgham, and Alice de Pynygton, of the diocese of Lichfield, contained that they formerly, in ignorance of the existence of any impediment, contracted marriage per verba legitime de presenti and consummated it, and that, upon their afterwards learning that the said John had, before the said marriage was contracted and before its solemnization, carnally known a certain woman related to Alice in a forbidden degree of kindred, and that they therefore could not lawfully remain in the said marriage, the said John, with a view to obtain the dissolution of the said marriage, a divorce, and a separation (super hoc petendo matrimonium huiusmodi diuidendum fore et inter ipsos diuortium fieri ipsosque ab inuicem separandos fore), caused Alice to be cited for judgment before the official of the archdeacon of Chester (the cognisance of marriage cases between persons of the said diocese belonging to the said archdeacon), who promulgated a definitive sentence in favour of John and against Alice, condemning John to restore to Alice all goods received by him from her by reason of the said marriage. At the petition of the said John for papal confirmation of the said sentence, the pope orders the above abbot, if he find that it was justly delivered, to confirm it by papal authority.
