Mandate, at the recent petition of Alexander de Lawedre, archdeacon of Dunkeld, licentiate of canon law—containing that formerly, before being admitted to the said degree in the university of Paris, where he received it by examination, he took oath to the late John Jarson (Gerson), then chancellor, that he would not receive the insignia of doctor of canon law in any other university; and adding that by reason of wars etc. he has not yet been able to receive the said insignia at Paris, and probably could not soon do so—to relax the said oath, and to grant that he may receive the said insignia in any other university. To the prior of Plymton in the diocese of Exeter. Mandate, at the recent petition of Edmund, bishop of Exeter—containing that although it was ordained of old that there should be twenty-four vicars and sixteen boys for divine offices in the choir of the church of Exeter, the rents assigned have been so much diminished by pestilences and other calamities that sixteen vicars can hardly be maintained therefrom, whilst the maintenance of the boys depends on the alms etc. of their friends—to appropriate to the episcopal mensa (to which the late king Henry gave his consent for the appropriation of some parish church in the diocese), for the support of the said vicars and boys, provided that the assent of the patrons be given, the parish church of Cornwode in the diocese, value not exceeding 40l., that of the said mensa not exceeding 950l., to take effect on the resignation or death of the rector, a perpetual vicar's portion being reserved. If any bishop of Exeter wittingly usurp or convert to his own uses any of the fruits etc. of the said church he shall eo ipso incur excommunication. Regimini universalis ecclesie. Rehabilitation, at his recent petition, containing that formerly, on the resignation to bishop Robert by John Wincestre of the perpetual vicarage of Alitht in the diocese of Aberdeen, the said bishop made collation and provision thereof to him, who is by both parents of a race of knights and barons and is a subdeacon, and was in about his twenty-second year, and had no canonical dispensation, in virtue of which collation and provision he obtained possession and has detained it for about two months, without taking as fruits more than one mark sterling. To David de Ogilbi, canon of Brechin, M.A. Rehabilitation, at his recent petition, containing that formerly, on the voidance of the rectory of Fethirkerne in the diocese of St. Andrews by the death of Henry de Guthry, bishop Henry made collation and provision thereof to him, who is by both parents of a race of knights and barons and is a subdeacon, is now in his twentythird, and was then in his twenty-second year, and had no canonical dispensation, in virtue of which collation and provision he obtained possession and has detained it for a year and a half, without taking as fruits more than 12l. sterling. Lately—after he, who is of a great noble race, had been dispensed, as the son of an unmarried man and an unmarried woman related in the fourth and fourth degrees of kindred, to be promoted to all, even holy orders and hold four compatible benefices with or without cure, even if canonries and prebends, dignities etc., and to resign them, simply or for exchange, as often as he pleased—the pope ordered [above. p. 12] provision to be made to him of the rectories, [of the patronage of laymen], of Gnobes (sic) and Gnomor in the said diocese, and at the same time dispensed him to hold for life them or any two benefices with cure or otherwise incompatible, and to resign the same, simply or for exchange, [as often as he pleased]. At his recent petition, containing that the pope's said first letters of dispensation did not mention that the said man and woman were related also in the third and third degrees of kindred, the pope grants that the said first and later letters shall hold good from the date of these presents, and that the executors of the said mandate may and shall proceed to execution, notwithstanding the said omission. To Thady Omigyr, perpetual vicar of Drumglyeb in the diocese of Killaloe. Grant as below. His recent petition contained that after he had received papal dispensation, as the son of a priest and an unmarried woman, to be promoted etc. as above, f. 61d, he obtained, after collation and provision made to him by authority of papal letters, and still holds, the said vicarage, which became void because Matthew Omigyr held it for more than a year without having himself ordained priest. At his said petition, which added that some assert that the said vicarage was void at the time of the said letters, and is void, not as above, but by the death of Denis Ymigyr, or otherwise, the pope grants to Thady, who is a priest and, by another special dispensation, holds together with the said vicarage the rectory without cure in ecclesiastical fee of the said church, that the said collation and provision shall hold good from the date of these presents, even if the said vicarage, value not exceeding 8 marks, that of the said rectory not exceeding 3, be void by the said death, or in any other way. He is further dispensed to hold for five years two other benefices compatible with one another and with the said vicarage and rectory, and to resign them simply or for exchange, as often as he pleases. To the abbot of Holywood (Sacri nemoris) in the diocese of Glasgow. Mandate as below. The recent petition of bishop John and the dean and chapter of Glasgow contained that formerly the said bishop—seeing that the fruits etc. of the capitular mensa, for division as daily distributions amongst the canons in residence, were so slight that they did not reside and be present at divine offices, a canon who resided and was so present not receiving from the said distributions more than the value of eight florins of the camera a year, wherefore divine service was diminished, etc.—appropriated, for purpose of the said distributions, to the said mensa, value not exceeding 80l. sterling, the parish church of Leberton in the diocese, value not exceeding 20l. sterling, belonging to the gift of the said chapter, on its voidance by the resignation to the said bishop of its rector, John de Vaux, a fit portion being reserved for a perpetual vicar. At the said petition, adding that the dean and chapter doubt the validity of the said appropriation, under pretext of which they took and hold possession, the pope orders the above abbot to make the appropriation by papal authority. Confirmation, at the recent petition of the dean and chapter of Brechin, of the gift made to them by Walter, earl of Athol and Caithness, for purpose of appropriation to the capitular mensa, of his patronage of the parish church of Cortowquhy in the diocese of Brechin, and of bishop John's appropriation of the said church to the said mensa, value not exceeding 20l. and 25l. sterling respectively, subject to a reservation of 10l. of the usual money of Scotland as a portion for a perpetual vicar. Exemplification is given of (i) the letters of donation, Quia inter ceteras ecclesias, dated and sealed at his castle of Brechyn, October 20, 1429, of Walter, earl palatine of Stratherne, Athol and Caithness, and lord of Brechyn and Cortowquhy, whereby, besides making the gift of the patronage, he ordains and grants that Sir William [de] Heslyhope, the then rector and vicar, shall obey in future the dean and canons of Brechin as his patron; (ii) the letters of appropriation, Universitati vestre notum esse facimus, sealed with his own seal and the common seal of the chapter, and dated at Brechin, November 8, 1429, of bishop John, which add to the earl's style ‘son of the king of Scotland,’ have the spellings ‘Cortouchy’ and ‘William de Heslyhop,’ and mention, besides the above portion of 10l. of the usual money of Scotland, the customary house, toft and croft. Confirmation, at the recent petition of John, bishop of Brechin, Walter, earl of Athol and Caithness, and the dean and chapter of Brechin, of the following grant of the said earl to the church of Brechin; with exemplification, after inspection and examination in the pope's chancery, of (i), the sealed letters Vestra noverit universitas, dated at his castle of Brechin, October 22, 1429, of Walter, earl palatine of Strathern, Athol and Caithness, lord of Brechine and Cortowquhy, relating his gift to the cathedral church of Holy Trinity, Brechyn, of 40l. of yearly rent from his lands of Corthowquhy within the shire of Forfare, payable in equal portions at the usual two terms, Whitsuntide and Martinmas, to the common proctor of the church of Brechyn, for the maintenance of two chaplains and six boys, to be presented (in a manner described) by the earl and his heirs and successors and to have yearly, the said two chaplains 10l. apiece, and the said six boys 5 marks apiece until they reach the age of twenty years and no longer, for the perpetual celebration (in a manner described) of divine offices, to live together (in a manner described) in a common house, the said sum, in case the said lands on account of war etc. are unable to furnish it, being payable from the earl's lands of his domain of Brechyn, etc. etc.; (ii) the letters (adding to the earl's style ‘the king's son’) Sciatis nos unanimi consensu of bishop John and the dean and chapter, sealed with their seals and those of the precentor and chancellor, and dated at Brechin, October 20, 1429, promising to observe the contents of earl Walter's above charter respecting the said foundation, e.g. the perpetual maintenance of a third chaplain, to have 12 marks a year, and to be presented by the said earl and his heirs and successors, the clothing of the said boys with surplices and hoods lined, and the maintenance of the said house, all at the expense of the dean and chapter, the perpetual maintenance at the expense of the said bishop of a fourth chaplain, etc. etc. Ad perp. rei mem. Grant as below. It was lately set forth to the pope by prior Robert (sic) and the convent of the Benedictine priory of St. Oswald's, Nostel, in the diocese of York, and the prioress and convent of the priory, immediately belonging to the Roman church, of St. Sixtus, Rome (de Urbe), living under the care and according to the institutes of the Friars Preachers, that a dispute formerly arose between the prior and convent of St. Oswald's, of the one part, and the prioress and convent of St. Sixtus's, of the other part, the latter claiming that the former were bound to pay them a yearly pension of 50 marks sterling on account of the fruits etc. of the parish church of Bamburgh (de Samburgo) in the diocese of Durham, which the said prior and convent hold to their own uses; that at length Master Herman Dwerg, provost of St. Lebuinus's, Deventer, in the diocese of Utrecht, doctor of canon law, papal notary and referendary, acting as proctor of the said prior and convent, made an agreement with the said prioress and convent, to wit, that the said proctor, in lieu of the said pension of 50 marks, which were worth 200 florins, should give to the said prioress and convent the farmhouse (casale), commonly called de salice, situate in Trastevere without the Porta Pertusa (fn. 7) (extra portam Pertuse), formerly belonging to one Paul Stati (or Scati), a Roman citizen, and bought by the said proctor for St. Oswald's, and that for all alleged neglected payments of pensions he should pay the said prioress and convent 3,000 gold florins of the camera, as is contained in a public instrument which the pope has caused to be inserted in other his letters. At the recent petition of [John de Hudresfeld] the present prior and the convent of St. Oswald's, the pope—who at the petition of the said prior Robert (sic) and convent confirmed by his said letters the said agreement, donation, etc.—grants that his said letters and the agreement, donation, etc. contained therein shall hold good as if the said prior's name had been rightly given in the pope's said letters as ‘John [de Hudresfeld]’ and not ‘Robert [de Quixley].’ Ad fut. rei mem. The recent petition of John Crosby, clerk, of his diocese, contained that formerly a certain layman, a glover (cirothecarius), promised to make him a pair of gloves by a certain day, but failed to keep his promise, whereby John was delayed in the prosecution of certain business; that after the said day there was an exchange of insults between John and the said layman, who was old and turgid; that upon the said layman taking up a knife and hastening to strike John, he, seeing himself in danger of death, and firmly believing that if he fled he would not escape, in self-defence drew a knife which he was carrying and, casually and without intent to kill or mutilate, inflicted on the said layman a wound from which in a brief space he died. At John's said petition, which added that he has no goods from which he could be maintained, and desires to minister in all holy orders, the pope orders the above bishop, if he find the facts to be as stated, to dispense him on account of irregularity contracted, to dispense him to be promoted to all the said orders and minister therein, and hold a benefice with or without cure, even if a parish church etc., and resign it, simply or for exchange, as often as he pleases, and to rehabilitate him. The recent petition of the wardens and guardians of the art or mistery of barbers dwelling in the city of London contained that formerly in a provincial council held by [the late] Thomas, archbishop of Canterbury, primate of England and legate of the apostolic see, and his suffragans and other prelates of the province, it was reported that the barbers of the cities, towns and places of the province, and especially of the city of London and its suburbs, kept their houses and shops open on Sunday for the exercise of their art, and that the said archbishop, with consent and assent of the said suffragans etc., ordered the said barbers to abstain from so doing, and gave commission to certain ecclesiastical persons to publish and cause to be published in church, on every Sunday and feast-day, the said ordinance, and to enforce it, by pain of excommunication, against the said barbers. Mary the Virgin and Bridget, Syon, of the order of St. Augustine, called St. Saviour's, in the diocese of London, has been profitable by his salutary doctrines and counsels to her and many other faithful of those parts, and that he (who for a number of years after making his profession has in the said monastery been zealous in divine services, vigils, fastings, prayers and preachings to the people, hearing confessions etc.) is so ill and weak that he cannot without bodily danger continue to undergo the said observances nor with a good conscience remain in the said monastery—to license Simon to transfer himself to another monastery, even of another order and of more lax observance and rule, and remain there perpetually, notwithstanding the pope's late letters prohibiting any person of the said order from migrating from the monastery in which such person made profession, under pain of apostasy, etc. After Simon has thus migrated, he shall be unable to hold ecclesiastical benefices. Dispensation, at his own recent petition (containing that he, a Friar Minor, received by papal authority provision of the see of Elphin and was duly consecrated, that, having been deprived of the said church, he has remained a bishop in the universal church, and that he has no means to support the episcopal dignity), and at the petition also of Thomas, bishop of Durham (containing that the said Robert has been wont to exercise pontifical offices for him in the city and diocese of Durham), to be able to be presented to any, even a secular benefice with or without cure, be instituted therein, and receive and hold it during the pleasure of the apostolic see, and resign it, simply or for exchange, as often as he pleases. IV (Rome, 1831). p. 239, to have been pierced early in the fifteenth century perhaps under John XXIII (1410–1415). Piale states that mention is made of the gate as existing as late as 1550. In this case it must be supposed that advantage was not taken of a grant by Leo X dated March 11, 1515, for Alexander de Neronibus, preceptor of the hospital of Santo Spirito in Sassia, to block up the ‘Porta Pertusa retro basilicam Principis Apostolorum,’ described as being already ruinous and useless, and to open in its stead another gate in the Leonine wall at the adjacent tower (i.e the present observatory), the new gate being given to the hospital, together with the tower and the surrounding ground (vol. 1192 of the Vatican series of Registers, fol. 24).
