said brethren sacramentals etc., but that the institutes of the said monastery and order forbid the brethren to leave the said enclosure and have dealings with secular persons), that the said brethren may, as often as she wishes, and without licence of the diocesan or any superiors of the said order, leave the precincts up to a distance of two miles of those parts, in order to hear her confession and grant her absolution, enjoining penance, except in cases reserved to the apostolic see, minister to her sacraments and sacramentals, and have dealings with secular persons in the matter of making her will. To Henry, archbishop of Canterbury. Annulment etc. as below. Lately the pope, informed by a number of persons of no little authority and estate that the said archbishop, who is legatus natus of the apostolic see, on account of the customary emoluments arising from the cathedral churches of his province at voidance, not only neglected to defend the rights and honour of the said see but also became daily more prone to oppose apostolic provisions, suspended him during the pleasure of the pope and the said see from his legateship and from all jurisdiction and power of receiving emoluments of other cathedral churches of the realm. Subsequently, by letters and envoys of the bishops and prelates and many others, and especially of the dukes of Gloucester and Norfolk, and of divers earls and barons of the realm, as also of the chancellor and masters of the university of Oxford, the pope was better informed as to the archbishop's singular devotion, obedience and reverence towards the pope and the [Roman] church, and his vigilant defence of the rights and honour of the said see and of the pope, the said bishops etc. asserting that the aforesaid had been evilly reported to the pope, and therefore supplicating him, as did also the archbishop himself, to restore him to his former estate and rights and to revoke the said suspension. But, however much inclined by such testimony to take for granted the archbishop's innocence, inasmuch as it was with great deliberation that the pope proceeded to the said suspension, he decided to wait until parliament met, in order to have greater certainty as to the archbishop's efforts therein for the defence of the rights of the Roman church, and the increase and
preservation of the dignity of the said see. The pope now knows, by the report of very many, that for the preservation of the rights and honour of the Roman church the archbishop has laboured with intrepidity, and has not feared to incur the penalties said to be contained in royal statutes. In order, therefore, to encourage him in his efforts for the defence of ecclesiastical liberty and for the recovery of the rights which are oppressed in the realm, and in response to the said petitions, the pope hereby revokes and annuls the said suspension, restores the archbishop to his said legateship and jurisdiction and power, and otherwise rehabilitates him. Peter and Paul, Llandaff; it having been recently set forth to the pope by the bishop and the chapter and canons that the said church, to which resorts a great multitude out of reverence for SS. Lately, upon its being set forth to the pope on behalf of the said William and the late Eleanor Brokesburne, damsel, that they, he being [not] ignorant, and she being quite unaware, that they were related in the second degree of affinity, had contracted marriage per verba legitime de presenti and had begotten offspring, the pope ordered the bishop of London to absolve William from the sentence of excommunication which he had incurred on account of the aforesaid, enjoining upon him a salutary penance, and to dispense him and Eleanor, after temporary separation, to contract marriage [anew] and remain therein, and to declare past and future offspring legitimate, the pope's will being that if William survived Eleanor, he should remain perpetually unwed. At William's recent petition, containing that bishop Richard made the said absolution and dispensation, that William and Eleanor contracted marriage anew, that Eleanor has died, and that he wishes to marry again, the pope grants him indult that this time, and as often as he shall be without a wife, he may contract marriage with any woman, the pope's said will notwithstanding. Lately it was set forth to the pope on his behalf that (after receiving papal dispensation, as the son of a priest, a religious professed of the order of St. Augustine, and an unmarried woman, to be promoted etc. as above, f. 93d, in virtue of which he was so promoted and obtained the rectory of Ynismagisanith in the diocese of Clogher) he had obtained without further dispensation, under pretext of a collation and provision made to him by bishop Arthur, and was holding together, first the priorship of the secular and collegiate church of St. Lassrianus de Daminys in the said diocese, a principal dignity with cure, and subsequently, having resigned Ynismagisanith, the rectory or plebania, called the comorbanship, of the same church, which is also a parish church, void because John Magugir held them for more than a year without being ordained priest. The pope therefore rehabilitated him, and required him to resign both [Cal. Lett. VII, p. 497]. Further the pope, learning that the said rectory or plebania was become void by the resignation of Maurice Macmagnassa, made to the said bishop, ordered provision to be made thereof to the said Nicholas, whether it were thus void, or by the above non-promotion, or in any other way. At his petition, containing that he fears lest the said mandate may be held surreptitious, because, as some assert, the said rectory or plebania, called a comorbanship, is a dignity, not principal, in the said church, and that it became and is void by the death of Medocius Othaichlych, the pope hereby grants that the said mandate shall hold good and may be executed, as if it contained special and explicit mention of the said two assertions. VII, p. 554] granted him indult that the confessor of his choice might grant him, being penitent and having confessed, plenary remission, once in life, and once in the hour of death, requiring him, amongst other things, to fast every
Friday for a year from the time of the said grant coming to his knowledge, and in the event of his being already bound by precept of the church or by vow or otherwise to fast on the said day, to do so on another day of the week, and, if lawfully hindered during the said year or part of it, to complete such fasting during the following year or as soon as possible; with further indult, in the event of its being inconvenient for him to perform the said fasting in whole or in part, that the confessor whom he should choose for the purpose might commute it into other works of piety; if not, the said indult should be null and void. At his petition, containing that even before the date of the said indult he was wont to fast on the said Fridays and on Saturdays and that, not having, for purpose of the said indult, fasted since on other days, he fears lest it may be deprived of its effect, the pope hereby grants him indult that the said confessor may grant him the said remission without his being obliged, during a year from the time of his receiving these presents, to fast on other than the said Fridays and Saturdays and the other fast days appointed by the church. Mandate, at the recent petition of Thomas Wynchecumbe, priest, of the diocese of Worcester (containing that he formerly for gain joined a number of forgers of apostolic letters and, although having incurred excommunication thereby, celebrated masses and other divine offices; that, after keeping secrecy for some time, he repented and denounced the said forgers to Thomas, bishop of Worcester, who caused him and the others to be taken and imprisoned; and that, after keeping him in prison for some time, bishop Thomas remitted him to the apostolic see) to absolve the said Thomas from excommunication etc. incurred, enjoining a salutary penance etc., dispense him on account of irregularity contracted, after temporary suspension, to minister in his orders, and rehabilitate him. The recent petition of Philip Macbradaych, priest, of the diocese of Kilmore, contained that although he formerly obtained, collated to him by papal authority, the perpetual vicarage of St. Bridget's de Disertfinchilly in the said diocese on its voidance by the death of David Macburdaych (sic), David Omochan, clerk, of the said diocese, asserting that the present pope had ordered provision to be made to him thereof, caused Philip to be summoned before [Eneas] Ocairbry, canon of Clogher, executor of the said mandate, and that the said Eneas delivered a definitive and
unjust sentence against Philip, who appealed therefrom to the apostolic see. At the said petition, adding that some assert that neither the said Philip nor David has a right, the pope orders the above prior etc. (Philip asserting that in the city and diocese of Kilmore he cannot have a judge not liable to be refused as suspect) to proceed in the appeal cause, and to confirm or annul the said sentence, without appeal; and if they find that neither Philip nor David has a right, to collate and assign the said vicarage, value not exceeding 8 marks, to Philip, whether it be void in the way stated, or by the resignation of Donatus Oganband (sic), or in any other way.
