1428. 6 Kal. Nov. SS. Apostoli, Rome. (f. 26.)	To the chancellor of Limerick. Mandate to collate and assign to Thady Otigernaid, priest, of the diocese of Killaloe, the perpetual vicarage of Glyndogra in the diocese of Limerick, value not exceeding 5 marks, to which, on its voidance by the death of David Omayr, he was presented by the patrons, the Augustinian prior and convent of Athasel in the diocese of Cashel, to bishop Cornelius, who instituted him, in virtue of which presentation and institution, whose validity he now doubts, he obtained possession; notwithstanding that the pope has recently ordered provision to be made to him of the canonry and prebend of the church of Dicertenagassa in the diocese of Limerick, value not exceeding 8 marks. 1428. 16 Kal. Dec. SS. Apostoli, Rome. (f. 73.)	To the bishops of Alet and St. Andrews, and the abbot of Melors in the diocese of Glasgow. Mandate as below. The petition of William Croyser, archdeacon of Teviotdale in Glasgow, contained that although he obtained possession of the said archdeaconry by collation made to him by papal authority, after he had held it for some time John Boumaker, priest, of the diocese of Glasgow, falsely asserted that it belonged to him; that the pope committed the cause, the parties being then sufficiently present in the Roman court, first to Master John de Opiczis, at Boumaker's instance, and then to Master John Walling, papal chaplains and auditors, the latter of whom by an unjust definitive sentence adjudged the archdeaconry to Boumaker and imposed perpetual silence on Croyser, who appealed therefrom to the apostolic see; that the pope, at Croyser's instance, committed the cause of the appeal and nullity to Master William Aragonis, papal chaplain and auditor, who decreed the nullity of the proceedings of the said John Walling, and condemned Boumaker in the costs of the proceedings before himself and Walling, which he afterwards assessed at 30 florins of gold of the camera. The said petition adding that Croyser doubts whether Boumaker, under pretext of the said definitive sentence, has not ejected him from the archdeaconry and intruded himself, and whether he will obey the proceedings to be taken under the said sentence of Master William and the present letters, the pope orders the above three to execute the same, publish the said sentence of Master William, and cause satisfaction to be made to Croyser in respect of the said costs, invoking if necessary the aid of the secular arm, etc. Exhibita nobis. 5 Kal. Nov. SS. Apostoli, Rome. (f. 153d.)	To the abbot of St. Mary's, Easdara, in the diocese of Achonry, and Cormac Oheara and Dermit Magaedagan, canon[s] of Achonry. Mandate as below. John XXIII, learning that the administration called the provostship of the church of Killala was void because Alan Ochanmchy, priest, of the diocese of Killala, when holding it, obtained the deanery of the same church, both being dignities, ordered it to be given in commendam for life to John Bared, Augustinian canon of St. Thomas the Martyr's by Buttevant (juxta Botoniam) in the diocese of Cloyne. The pope, having recently learned from Charles Ohanmohy, clerk, of the diocese of Killala, that the said John Bared, after obtaining possession of the said administration, abandoned his said monastery and the regular habit, alienated and dilapidated the possessions of the said administration and committed fornication more than once, hereby orders the above three, if the said Charles, inasmuch as he cannot safely meet the said John within the city and diocese of Killala, will accuse John before them, to summon John, and if they find the aforesaid to be true, to annul the said commenda, and in that event to collate and assign the said administration, a non-major non-elective dignity, value not exceeding 8 marks, even if it have cure, to the said Charles, who lately received papal dispensation, as the son of a priest and an unmarried woman, to be promoted to all, even holy orders and hold a benefice even with cure; notwithstanding that provision was lately ordered by papal authority to be made to him of the perpetual benefice without cure (simplex), called the prebend or rectory of Kylluog in the said diocese of Killala, value not exceeding 3 marks. 6 Kal. Nov. SS. Apostoli, Rome. (f. 159.)	To Cormac Cheadra (rectius Oheadra), canon of Elphin, and Dermit Magacda[ga]n and Maurice Oconchubair, canons of Killala. Mandate to collate and assign to John Oheara, canon of Achonry, the deanery of that church, a major dignity with cure and elective, value not exceeding 8 marks, void and reserved, under the pope's late general reservation of all major dignities in cathedral churches, by the death of Donald Oraegaily, summoning and removing Philip Oclinnan, priest, of the diocese of Achonry, who, as the said John asserts, has without papal provision or other right, detained possession for more than three years; John being unable, as he also asserts, to have in the city or diocese of Achonry any judge not liable to be refused as suspect; notwithstanding that John holds a canonry of the said church and the prebend of Kyllnathruid, value not exceeding 3 marks. Mandate to collate and assign to Henry Ocormacayn, clerk, of the diocese of Killaloe, who lately, without mentioning his illegitimacy as the son of an unmarried man and an unmarried woman, had himself tonsured, the precentorship of Killaloe, a non-major nonelective dignity with cure, value not exceeding 6 marks, void and reserved because Odo Ohogayn, [now] dean of the same church, when holding the said precentorship, obtained, collated to him by authority of letters of the present pope, the said deanery, which is a major dignity. 10 Kal. Nov. SS. Apostoli, Rome. (f. 198d.)	To the abbot of Inysgad and the priors of Monaincha (Insula vivencium) and Inyscronayn, in the diocese of Killaloe. Mandate as below. Lately the pope—being informed by Odo Ohegayn (cf. f. 192d), precentor of Killaloe, that James Olonyrgayn, dean of Killaloe, simoniacally bargained that Malachy alias Matraych Maelmuyro, priest, of the diocese of Killaloe, should give up his claim to the deanery in exchange for a life possession of the perpetual vicarage of Tyrdaglas annexed thereto and certain lands etc. in the town of Drumyndinyt in the said diocese, all which Malachy actually obtained, and whereof he unduly detained possession for more than a year, and that James should further pay, as long as he held the deanery, a yearly sum of 10s. sterling of the money of those parts to Malachy from its fruits etc., which sum James actually paid—ordered the prior of St. John Baptist's by le Naenach in the said diocese, if the said Odo would accuse James before him, to summon James, and if he found the above or enough thereof to be true, to deprive him, and in that event to collate and assign the deanery to Odo. Subsequently, as the pope has learned from John Ocormacayn, rector of the parish churches of Oconmyllyd Ardacha and Lelynne [alias] of Fyecall Kyllwarayn and Oconmyllyd in the said diocese, the said Odo caused the said James to be cited, in virtue of the pope's said mandate, before the late William, prior of the said monastery, who by a definitive sentence deprived James, and made collation and provision of the deanery to Odo; that from this sentence James appealed to the apostolic see, and that he impetrated letters of the pope addressed in the matter of the appeal, the said prior William having meanwhile died, to the prior of the same monastery, in virtue of which he caused Odo to be cited before prior Dermit, who had taken certain proceedings when the said Odo made with James a simonical arrangement by which James was to give up all right in or to the deanery, and Odo was to pay him 16 marks, of which sum Odo, who obtained and at present detains the deanery, has actually paid 10. The pope therefore orders the above abbot and priors, if the said John (who is a priest, has studied canon and civil law for some time, and lately received papal dispensation, as the son of an unmarried man and an unmarried woman, nobles, related in the second and second degrees of affinity, to be promoted etc. as above, f. 153d) will accuse Odo before them, to summon Odo, and if they find the aforesaid to be true, to deprive him of his right, and to remove him from such right and from the deanery, and in that event to collate and assign the deanery, a major elective dignity with cure, value not exceeding 10 marks, to John; notwithstanding that he holds the rectory, value not exceeding 15 marks, of the above parish churches, with which he is hereby dispensed to hold together the said deanery for life, and to resign both, simply or for exchange, as often as he pleases. Kal. Oct. SS. Apostoli, Rome. (f. 224.)	To the bishop, the archdeacon and the official of Kilmore. Mandate to collate and assign to Philip Magbradaych, priest, of the diocese of Kilmore, who is of noble race, the perpetual vicarage, value not exceeding 6 marks, of the plebs de Culbridin, alias of the parish church of St. Patrick de Casselterram, in the said diocese, of the patronage of laymen, so long void, because John Mecbradych, some time perpetual vicar of the said plebs or church held it for more than a year without being ordained priest, that its collation has lapsed to the apostolic see, John Magangassa, priest, of the said diocese, who has unduly detained possession for about eight years under pretext of a collation made to him after the said lapse by the ordinary, being summoned and removed; whether it became void in the way stated, or by the death of Malachy Mecbradaich, or in any other way; and notwithstanding that the pope has lately [above, pp. 70, 71] ordered provision to be made to Philip of the perpetual vicarage of Disertfyngely in the said diocese, value not exceeding 8 marks. Mandate to collate and assign to Matthew Maccleridh, priest, of the diocese of Clogher (who lately received papal dispensation, as the son of a priest and an unmarried woman, to be promoted etc. as above, f. 153d) the perpetual vicarage, value not exceeding 5 marks, of the parish church of Cluay[n]tibrat alias of the plebs of Teallachgelagayn, in the said diocese, so long void by the death of Philip Odubfaydf that its collation has lapsed to the apostolic see, although Patrick Oluban, priest, of the same diocese, who is to be summoned and removed, has unduly detained possession for more than five years under pretext of a collation made to him by the ordinary after the said lapse.Dignum etc. (Ri. xx. Mary and Edward, alias of Holy Cross, Limerick, of the order of St. Augustine, the priorship of which house, a conventual dignity, is held in commendam by papal authority by Edmund Fyzadann (sic), canon of Limerick, Walter Haket, priest, of the diocese of Emly, who lately … Cupientibus vitam ducere religiosam.
