Relaxation of two years and two quarantines of enjoined penance to penitents who on the feast of the Exaltation of Holy Cross visit and give alms for the repair of the parish church of Berghstede in the diocese of Canterbury, to which on the feasts of the Invention and Exaltation of Holy Cross a great multitude resorts, and in which is a representation (ymago) of the Crucifixion. To John Wer, rector of Lyne in the diocese of Glasgow, bachelor of canon law. Dispensation as below. The pope lately [above, p. 101] made provision to him of a canonry of Glasgow with reservation of a prebend and dignity etc., and of a benefice with or without cure, wont to be assigned to secular clerks, even if a dignity etc., in the gift of the bishop and the prior and chapter of St. Andrews, dispensing him to hold for seven years with Lyne such dignity etc., with the usual condition of exchanging meanwhile, or after the said period resigning Lyne. The pope hereby annuls the said letters as far as regards the said dispensation only, and dispenses him, who is a priest and is by both parents of noble and royal race, to hold for life with the said church one such dignity etc. which he shall obtain by virtue of the said letters, or any other benefice with cure or otherwise incompatible with his said church, and to resign both, simply or for exchange, as often as he wishes. To Edward Trevor, archdeacon of St. Asaph, B.C.L. Prolongation as below. The pope lately dispensed him to hold for five years with the said archdeaconry, a non-major dignity, even if it had cure, any other benefice with cure or otherwise incompatible, with the condition of resigning the archdeaconry if he did not meanwhile make the usual exchange. At his recent petition, containing that after the said dispensation he obtained by collation of the ordinary the parish church of Llandrunio in the diocese of St. Asaph, and is holding it with the said archdeaconry, value not exceeding 40 and 60 marks respectively, the pope prolongs by seven years the said period of five, which is about to expire. After the said seven years Edward, who says that he is by both parents of a great noble race, is to resign the archdeaconry. Nobilitas generis, litterarum etc. |

Confirmation of the dispensation granted to them by Henry, bishop of Winchester (to whom the pope lately granted, inter alia, faculty to dispense thirty persons of both sexes in the realm or other dominions of the king of England, to marry persons related to them in the third or more remote degree of kindred), to marry, notwithstanding that they were related in the third and fourth degree of kindred, in virtue of which dispensation they have been married. To Robert Frend', canon of Houeden in the diocese of York. Declaration, as below. It was recently set forth by him to the pope that after he, then a subdeacon, had received indult by authority of the ordinary not to be bound, for a certain number of years, then expressed, whilst studying letters at an university, to be ordained priest on account of his parish church of Waltham in Lyndesay in the diocese of Lincoln, of the patronage of laymen, he, who was then and had for several years been in the service of Thomas, bishop of Durham, continued to be not promoted to the priesthood for more than a year after having obtained peaceable possession of the said church, relying on the common belief (communi. . reputacioni inherens) of those parts by which the holders of benefices there, even with cure and of the patronage of laymen, are said to be excused from taking orders whilst in the service of the said laymen, the said bishop being chancellor of the late king Henry, patron of the said church in virtue of his duchy of Lancaster; and that John Sadyngton, priest, of the said diocese, on the strength of (innitentes) a lay presentation of himself to the said church, made on account of Robert's said non-promotion, although at the time when the said presentation was made there was, for certain reasons, no ground for it, even if by reason of such non-promotion the church ought to have been deemed to be void, has endeavoured and endeavours to molest Robert in regard to the said church, on account of which Robert has appealed to the apostolic see. The pope hereby declares that Robert, who is a deacon, and holds besides the said church the canonry and prebend of Saltmersshe in Houeden, value not exceeding 52 and 20 marks respectively, could and can lawfully hold the said church, and that it ought not to have been and ought not to be deemed void by the fact that he has not yet been ordained priest, the reason of his non-promotion having been, not malice, but simplicity and the said indult and common belief (illa communis assercio siue reputacio). Mandate, at the petition of Archibald de Douglas, donsel, and Eufemia de Graham, damsel, of the dioceses of Glasgow and Dunblane (containing that they formerly, after dispensation was by papal authority ordered to be granted to them to marry notwithstanding that they were related in the double third degree of kindred on one side and the double fourth on the other, arising from divers stocks [see above, pp. 251, 254], contracted marriage per verba legitime de presenti before execution of the said mandate, thereby incurring excommunication), to absolve them, enjoining a penance, and, after temporary separation, to dispense them to contract marriage anew, decreeing past and future offspring legitimate. Rehabilitation, at his recent petition, containing that he received papal dispensation, as the son of a married man and a nun, (i) to be promoted to all, even holy orders and hold a benefice even with cure, (ii) to hold two or three other mutually compatible benefices, even if one had cure, and to resign them, simply or for exchange; that lately— the statutes of Le Mans, Orleans and St. Martin's, Tours, forbidding the admission as a canon of any one of illegitimate birth, and requiring an oath accordingly—John, who is reputed legitimate by several of those parts who know him, and is one of the ambassadors sent to the pope by Charles, king of the French, in order to be admitted to canonries and prebends of those churches, took the oath, thereby incurring the guilt of perjury. The late Peter de Luna, called Benedict XIII, granted him, who had received papal dispensation on account of illegitimacy (not here defined) to be promoted to all, even holy orders and hold a number of benefices, that he should not be bound in future papal graces concerning benefices to mention his said illegitimacy aud dispensations; and the present pope confirmed the said grant etc. The pope now grants to Gray, who is one of the ambassadors sent to the pope by Charles, king of the French, and is also M.A., that he is not bound and cannot be compelled to exhibit in judicio vel extra the aforesaid dispensations and grant.
