To John, duke of Bedford. Indult as below. The late Alexander V granted him indult [Cal. Lett. VI, p. 150] to have, wherever he might reside, a chapel in which he might cause mass and other divine offices to be celebrated, even with music, in presence of himself and his household, by his own or other fit priests and clerks, of which priests one might, as dean, wear an almuce of vair and grey (almucia de vario et griseo uti), (fn. 3) and might, as also the rest of the said priests, administer the sacraments to the said duke and the members of his household, receive his and their oblations and convert them to their own and other lawful uses; saving the right of the parish church, and of any other. At the petition of the duke, who in virtue of the said indult has deputed chapel, priests and clerks for the said offices, the pope hereby grants indult for the dean to have and exercise cure of souls in regard to the duke and (fn. 4) the said members of his household, and all parochial rights, and to use and enjoy the said rights in the same way as the rectors of parish churches of the realm of England have been wont to do in their churches and parishes; but not burials of the members of the duke's household. To Roger atte Herne, alias Heron, rector of Scherston in the diocese of Salisbury. Dispensation as below. John XXIII dispensed him to hold for ten years with the above church any other benefice with cure or otherwise incompatible, and to resign both, simply or for exchange, as often as he pleased, with the usual condition of exchanging or resigning, after which dispensation he obtained the parish church of Terryng in the diocese of Canterbury, which he still holds with Scherston, value not exceeding 100 and 30 marks respectively. The pope hereby dispenses him—who holds also a free chapel without cure within the precincts of the Augustinian monastery of St. Augustine, Bristol, wont to be assigned to secular clerks, and another within the bounds of the parish of Scherston Pynkenay, value not exceeding 10½ and 7½ marks respectively, the wardenship, which is an office without cure (simplex), of Maydeston, and a canonry and a certain prebend in St. Michael's, South Mallyng, a canonry and cursal prebend of St. Davids, and a canonry and the prebend of Hova Villa in Chichester, value not exceeding 30, 30 and 7½ marks sterling, and 45 marks sterling and 10s. of English money, respectively—to hold together for life, after the lapse of the said period, the end of which is at hand, the said two churches of Scherston and Terryng, and to resign them, simply or for exchange, as often as he pleases. Lately the pope—after Alexander had received papal dispensation, as the son of an unmarried man and an unmarried woman, (i) to be promoted to all, even holy orders and hold any compatible benefices of any number and kind, with or without cure, and to resign them, simply or for exchange, as often as he pleased, (ii) to hold for three years with the church of Maydynneweton any other benefice with cure or otherwise incompatible, even if a dignity, personatus or office with or without cure in a metropolitan or other cathedral or a collegiate church, or a parish church or a perpetual vicarage, even if such dignity etc. were elective, provided that such dignity were not major in a metropolitan or cathedral nor principal in a collegiate church—prolonged to five the said three years, then about to end. The pope now grants to him (who holds the canonry and prebend of Axfort in Salisbury, a canonry and prebend called cursal in St. Davids, the said church, and the treasurership of London, a non-major dignity, value not exceeding 12 and 6 marks, and 40l. and 50l. respectively) that the said dispensation about incompatible benefices shall hold good from the present date, even if such incompatible benefice be a major dignity in a metropolitan or cathedral or a principal dignity in a collegiate church, and such dignity be, as above, elective, in such wise that he may retain during the said five years such major or principal dignity even together with another dignity, not major in a cathedral or not principal in a collegiate church, (fn. 13) notwithstanding everything in the said letters to the contrary. At his recent petition— containing that he obtained and held for some time with Valdegrave the perpetual vicarage, value not exceeding 5 marks, of Careswale in the diocese (fn. 14) of Lichfield, and has resigned it, simply, to the ordinary—the pope dispenses him—who holds, besides Waldegrave, a canonry and the seventh prebend, commonly called ‘of the Cross’ (prebendam scptimam prebendam Crucis communiter nuncupatam), in St. John's, Chester, value not exceeding 40 and 6 marks respectively—to hold for life with Waldegrave any other benefice with cure or otherwise incompatible, and to resign both, simply or for exchange, as often as he pleases. Mandate, at the recent petition of Malachy Yfergail, priest, of the diocese of Ardagh—containing that formerly some of his friends gave one mark of pure silver to a layman in order that he might intercede and be a mediator for the reception of Malachy into the Augustinian monastery of St. Mary, Saints Island (Insula Omnium Sanctorum), in the said diocese, and 6s. of like silver to a canon of the said monastery in order that he might give his assent in the matter of the said reception, and that, after the said gift[s], they procured the reception of Malachy as a canon by the prior and convent; and adding that Malachy subsequently, in ignorance of the law, caused himself to be promoted to all holy orders and has ministered therein more than once,— to absolve him from excommunication etc. incurred, enjoining a salutary penance etc., to rehabilitate him, and to dispense him to minister in the said orders. A salutary penance is to be imposed, and after temporary separation they are to be dispensed to contract and solemnize marriage anew, past and future offspring being decreed legitimate. To Nemeas Obeollayn, perpetual vicar of Drumcheclyd in the diocese of Elphin. Absolution etc. as below. His recent petition contained that although formerly, in his cause against Dermit (Dermissius) Ochoneil, clerk, of the diocese of Elphin, about the above vicarage, which Nemeas had accepted and had had provision made to him in virtue of certain letters of the present pope, which vicarage the said Dermit claimed and detained, he obtained from the executors of the said letters, Philip, Augustinian abbot of Cel[l]ani[g]ra in the diocese of Derry and Cornelius Machdonchreny, dean of Elphin, a joint definitive sentence by which the said vicarage was adjudged to him, and perpetual silence imposed on the said Dermit, and that he obtained induction; but that afterwards, dreading possible vexations by appeals etc., of the said Dermit, he promised by oath to pay him a certain sum of money yearly, on account of which and of a doubt whether the said executors could lawfully proceed jointly, he fears molestation in respect of the vicarage. The pope hereby absolves him from the said sworn promise, rehabilitates him, and grants that the said joint proceedings shall hold good, as if one executor alone had proceeded, or both had been able lawfully to proceed jointly. The pope lately dispensed him to hold during five years with the above precentorship, which is a non-major dignity with cure, one other benefice with cure or otherwise incompatible, with the usual condition of exchanging during the said period, or thereafter resigning the precentorship. At his recent petition, containing that after the said dispensation he obtained the parish church of Warnefford’ in the diocese of Winchester, and holds it and the said precentorship, value together not exceeding 133 marks, in virtue of the said dispensation, the pope prolongs by three years the said period of five, which is not yet expired, with the like condition as above. Mandate—at the recent petition of the inhabitants of the chapel (sic) of Martynglee within the bounds of the parish church of Heghffyld in the diocese of Winchester, containing that the said chapel has all parochial insignia and rights except burial, and is distant two miles from the said mother church, on account of which, and of floods of the waters which flow between, it is inconvenient to carry to Heghffyld their dead—to grant licence to the said inhabitants to have a cemetery at the said chapel.
