To William de Foulis, clerk, of the diocese of St. Andrews, M.A. Rehabilitation as below. Lately (on its being set forth to the pope on his behalf that formerly, on the voidance of the perpetual vicarage of Edenburch in the said diocese, by the death of James Leonis, he was presented by the patron, king James, to bishop Henry, who refused to institute him, and that he appealed to the apostolic see) the pope ordered (by letters which have not yet begun to be executed) certain judges to summon the said bishop and others concerned, to hear and decide the appeal and the principal matter, and if they found the said patronage and presentation lawful, to collate and assign to him the vicarage, which the pope dispensed him to hold for two years with his provostship of the church of Bothwile in the diocese of Glasgow, a principal [elective, cf. Reg. CCXLV, f. 216] dignity with cure, requiring him to exchange one or the other for a compatible benefice, and if not, to resign the provostship after the said two years. At the recent petition of the said William, who is chancellor of Archibald, duke of Touraine (containing that before he was presented and instituted to, and before he obtained the said provostship, which is of lay patronage, on its voidance by the death of John de Merton, he obtained and held together for some years the parish churches, also of the patronage of laymen, of Cambuslang and Seton in the dioceses of Glasgow and St. Andrews, and has afterwards, having resigned Cambuslang, held together for some months the said provostship and Seton without dispensation, and still detains them), he is hereby rehabilitated, but is to resign both the provostship and Seton. To William Croysier, canon of Glasgow, M.A. Grant as below. The late Benedict XIII granted to him in commendam for life and as long as the Cistercian monastery of Holme in the diocese of Carlisle should remain without the said pope's obedience, the parish church of Kyrkgonzan in the diocese of Glasgow, which was said to be united to the said monastery [see above, p. 67]. Afterwards, upon William's setting forth to the present pope that, taking possession, by virtue of the said commenda, of the said church, after the lapse of some years, he had held and was still holding the fruits etc. to his own uses, and that on account of the wars between England and Scotland the said union, if it existed, was likely to be of small profit to the said monastery, the pope granted to him in commendam anew the said church, to be held by him until the said wars should cease and a lasting peace should be made [above, ibid.]. Subsequently the pope ordered provision to be made to him of a canonry and prebend of Glasgow and the archdeaconry of Teviotdale in that church [above, p. 93], and prolonged the said commenda for five years from the time of his obtaining the archdeaconry, after the expiry of which period the commenda was to cease. At his recent petition (containing that he has obtained and holds the said canonry and prebend and archdeaconry, and that the end of the said period is at hand; that he holds also a canonry and the prebend of Opney in Dunkeld, value, with that of the said canonry and prebend and archdeaconry, not exceeding 80l. sterling, that of the said parish church not exceeding 20l. sterling [cf. p. 67]; that the pope lately ordered provision to be made to him of two benefices with or without cure, even if canonries and prebends etc., in the common or several gift of the bishops and chapters of St. Andrews and Aberdeen, dispensing him to hold such two incompatible benefices for life, and to resign them, simply or for exchange, afterwards dispensing him to hold with the above archdeaconry during the pleasure of the apostolic see the perpetual vicarage of Enverlithan in the said diocese, provision of which the pope ordered [see above, pp. 73, 99] to be made him, and to resign them, simply or for exchange, which vicarage and all right thereto he, without having had possession, resigned at the apostolic see to the late Charles, cardinal deacon of St. George's) the pope hereby grants that the said commenda may continue even after the said five years. To Peter Schelton, rector of Tudynham in the diocese of Norwich, B.C.L. The late John XXIII dispensed him, already M.A. and holding the above church, to hold therewith for five years any other benefice with cure or otherwise incompatible, and to resign both, simply or for exchange, as often as he pleased [Cal. Lett. VI. p. 216]. At his recent petition (containing that he afterwards obtained and held with Tudynham, as he still does, the parish church of St. Mary in the Marsh (de Marisco) in Norwich, value not exceeding 36 and 15 marks respectively), the pope prolongs by another five years the said period, which is about to expire. To Robert, bishop of St. Asaph. Lately John XXIII granted to him in commendam for ten years the Cistercian monastery of St. Mary, Valle Crucis, in the diocese of St. Asaph, which he was ruling at the time of the provision made to him by the said pope [Cal. Lett. VI, p. 198] of the see of St. Asaph. Afterwards, at his petition—containing that the end of the ten years was at hand, that during his rule of the said monastery he had repaired it after its destruction by fire, that he had in great measure repaired the said church [of St. Asaph], which had been destroyed, even in its walls, by a like fire, and desired to complete the repair, for which the resources of his episcopal mensa were insufficient,—the present pope prolonged the said period by five years [above, p. 117]. At his recent petition, containing that the said five years is about to end, and that on account of expenditure on books, chalices etc. for the said church, he has been and is unable to carry out his intention, the pope hereby prolongs the said period by a further five years. Prolongation by other five of the unexpired period of five years during which he was lately [above, p. 155] dispensed by the present pope to hold with the above church any other benefice with cure or otherwise incompatible, with the usual condition, which is here repeated, of exchanging, or of resigning the said church; his recent petition containing that after the said dispensation he obtained the perpetual vicarage of Sutton by Plymouth, which he at present holds with Alwyngton, that he lately received papal dispensation, as the son of an unmarried man and an unmarried woman, (i) to be promoted etc. as above f. 56d, (ii) having been ordained priest and having obtained the parish church of St. Ewin (Sancti Audoeni), London, to hold any mutually compatible benefices of any number and kind, with or without cure, and to resign them, simply or for exchange, as often as he pleased, that he is a bachelor of canon law, and that he holds, besides the said vicarage and church, value not exceeding 50 and 15l. respectively, a canonry and prebend of Exeter, value not exceeding 6l.
