To the bishop of Alet, Dermit Ofathyd, canon of Clonfert, and the official of Killaloe. Mandate to collate and assign to John Odubgilla, priest, perpetual vicar of Kylenayn in the diocese of Kilmacduagh, the still void canonry and prebend of Croscurnayn in Kilmacduagh, value not exceeding 2 marks of silver, collation and provision of which he received from the late Maurice, archbishop of Tuam, having been so long void by the death of James Cachir that by the Lateran statutes its collation had lapsed to the metropolitan. He doubts whether the said collation and provision hold good. The new collation is to be made notwithstanding that he holds the said vicarage, and that the pope has recently [above, pp. 266, 267] ordered provision to be made to him of the perpetual vicarage of Ardrachayn, of which he has not got possession, value not exceeding 3 and 7 marks of silver respectively. Mandate to collate and assign to William Adeson, priest, of the diocese of Glasgow, the still void perpetual vicarage of Lynton in the said diocese, value not exceeding 20l. sterling, which he obtained by presentation, in accordance with ancient custom, by the Benedictine abbot and convent of Kilcow in the diocese of St. Andrews, and institution, by his ordinary authority, by bishop William, on its becoming void because John de Borthtvyk, when holding it, obtained by authority of the ordinary the rectory of St. Mary's, Forest (de Foresta) in the diocese of Glasgow. To the bishop of Alet, the abbot of Balmurinagh in the diocese of St. Andrews, and the official of St. Andrews. Mandate to collate and assign to George de Penykuk, priest, of the diocese of St. Andrews, bachelor of canon law, who is of knightly birth, the still void perpetual vicarage of Kilconkar in the said diocese, value not exceeding 20l. sterling, which he obtained by presentation, in accordance with ancient custom, by Maud (Methtilda), Cistercian prioress, and the convent of North Berwyke in the same diocese, and institution, by his ordinary authority, by bishop Henry, on its voidance by the death of Thomas de Thynyngham. He doubts, as in the preceding. The collation is to be made whether the vicarage became void as above, or by the resignation of the said Thomas, or otherwise, and notwithstanding that George holds a certain yearly pension, reserved to him by papal authority, of 24 marks sterling from the fruits etc. of the archdeaconry of Lothian in St. Andrews, and that the pope lately granted him provision of a canonry with reservation of a prebend and of a non-major dignity etc. of Glasgow, and of a benefice with or without cure, wont to be assigned to secular clerks, in the gift of the Benedictine abbot and convent of Dunfermlyn in the said diocese. The said grant shall, upon his obtaining the said vicarage under these presents, be void as far as regards a dignity or personatus, or as regards an office with cure and such benefice with cure only. Mandate to collate and assign to Rory Odubda, canon of Killala, who says that he is of a race of kings (de regali prosapia procreatus), the still void rectory of Culcnamba in the diocese of Killala, value not exceeding 16 marks, which he obtained by collation and provision, by his ordinary authority, of bishop Thomas (sic), on its voidance by the death of Fergallus Oflanngali. To Master William Maligeneri, papal chaplain and auditor. Mandate as below. The recent petition of Robert Stewart, rector of Torbolton in the diocese of Glasgow, bachelor of canon law, of noble birth, contained that formerly John Busby, priest, and the late John Erskine exchanged the parish church of Eglishoone, in the said diocese, and the chancellorship of Glasgow, the exchange being carried out by bishop William; that the cause which arose between Busby and John Wer, clerk, of the said diocese, about the said chancellorship, was committed by the present pope, although not by its nature lawfully devolved to the apostolic see, to Master Geminianus de Prato, at Wer's instance, and then to Master Hartung de Capell, papal chaplains and auditors, the latter of whom gave a definitive sentence in favour of Busby, Wer's appeal from which to the apostolic see the pope committed to the above Master William. Seeing that, as the pope has learned, Busby is so old and feeble that, the cause being before the said William, he proposes to give up the suit and all right in or to the chancellorship, the pope orders the said auditor to receive Busby's resignation and to surrogate the above Robert Stewart to his said right, and moreover to collate and assign to him the chancellorship itself, a non-major non-elective dignity with cure, to which a canonry and prebend are annexed, value altogether not exceeding 60l. of old sterlings, and to reserve to Busby a reasonable pension for life, to be paid by the said Robert and his successors; notwithstanding that the said Robert (who was lately dispensed by Peter de Luna, called Benedict XIII, to hold for three years, with the perpetual vicarage of Dunlop in the said diocese, one other incompatible benefice, with or without cure, which period of three years was prolonged by the said Peter, after Robert had obtained Torbolton and was litigating about it, by two and subsequently by five years, the latter period being prolonged by the present pope to the term of Robert's life; and has been dispensed by the present pope to resign Torbolton and the said vicarage, simply or for exchange, as often as he pleases, and hold instead two other incompatible benefices for life [above, p. 210]) holds the said vicarage and the said rectory, which is of the patronage of laymen, of Torbolton, value together not exceeding 50l. of old sterlings. He is hereby dispensed to hold the said chancellorship for seven years together with Torbolton and the said vicarage, on condition that he meanwhile exchange one of the three for a benefice compatible with the remaining two: if not, he is thereafter to resign the said vicarage. To the bishop of Alet, the abbot of Saint-Pierre-de-l'Ile (de Insula) in the diocese of Bordeaux, and the archdeacon of Blaye (Blauien.) in Bordeaux. Mandate as below. The recent petition of Elias Ruffelli, clerk, of the diocese of Saintes, B.A., contained that he and Richard Peteworth exchanged one (sic) chaplaincy in the cathedral (maiori) church and the parish church of Sainte-Eulalie, Bordeaux, another in the church of Saint-Médard-en-Jalle (in Jalesio), and another in the church of St. Emilion, de Saint-Emilion, in the diocese of Bordeaux, of the one part, and a canonry and prebend in the cathedral (maiori) church of Bordeaux, of the other part, the exchange being carried out by archbishop David. The said petition added that Elias doubts whether the collation and provision of the said canonry and prebend made to him by archbishop David hold good because Poggio (Pogius) Gucii, clerk, of the diocese of Arezzo (Aretin.), writer and abbreviator of papal letters, to whom provision of the same was lately made by papal authority, as void by the death of Arnald [son] of William de Marina, has ceded them and all right thereto, without having had possession, to the said archbishop, and for certain other reasons. Seeing that, as the pope has learned, the said canonry and prebend are still void as above he, admitting hereby the said cession, orders the above executors to collate and assign to Elias the said canonry and prebend, value not exceeding 100l. petits tournois, howsoever void, and even if reserved, e.g. by the said cession of Poggio; notwithstanding that the pope lately ordered provision to be made to Elias of one or two benefices in the gift of the said archbishop and the deans and chapters of the cathedral (maioris) church of Bordeaux and the church of St. Seurin (Saneti Severini) without the walls of Bordeaux.
