Exhortation to all faithful (the pope having learned that in the parishes and towns of Slebech and Mynwer in the diocese of St. Davids, which are very near the sea shore, there is an arm of the sea (aqua maris) which at times greatly swells, so that the parishioners and inhabitants and others who have to cross it cannot do so without danger of drowning, a fate which has overtaken many in times past) to give alms in aid of the proposed building by the said parishioners and inhabitants of a causeway over the said water; with relaxation hereby, during ten years, of a year and forty days of enjoined penance to penitents who do so. The pope forbids the present letters to be sent by questuarii, and declares them null if this be done, as also if any other indulgence, perpetual or for a period not yet expired, have been granted by him for the same object. The said sum is to be paid in the church of Lincoln, half at Easter, half at Michaelmas, under pain of excommunication. Personam tuam.

VI, p. 255]; who, after some years’ peaceable possession, was despoiled by Donald Ocuhan, clerk, of the diocese of Derry, who is still in possession of the vicarage, which vicarage some assert to have become and to be void otherwise than as above), to summon Donald, on account of whose power in the city and diocese of Derry John has no hope of obtaining justice, and others concerned, to hear and decide the cause, and, if they find that the vicarage, whose value does not exceed 8 marks, is void as above or in any other way, to collate and assign it to John. Prolongation by five years of the period of ten years, about to expire, during which John XXIII (to whose obedience those parts belonged), who had made provision to him of the said see, granted him to hold in commendam therewith the Cistercian monastery of St. Mary, Vale Crucis (de Vallecrucis), in the said diocese, which he held at the time of his said provision; his recent petition containing that, whilst he so had held the monastery, he repaired it after its destruction by fire, and that whilst he has been holding the monastery in commendam, he has to a large extent repaired the said church [of St. Asaph], after its destruction, even to its walls, by a like fire, and that he desires the church to be completely rebuilt and repaired, for which purpose the revenues of its fabric and of his mensa are insufficient. Mandate (at the petition of David ap Gruffud Goch and Catherine verch Jeva[n] of the dioceses of St. Asaph and Lichfield, containing that David, not in ignorance that he would become related to Catherine in the second and third degrees of affinity because he had committed fornication with a woman related to Catherine in those degrees of kindred, contracted marriage per verba de presenti with Catherine, and that they consummated it and have had offspring), John, bishop of Lichfield, who ought to have been written to in the matter, being resident at present in the Roman court, to absolve David from excommunication incurred, enjoining a salutary penance, and, if he think expedient, to dispense him and Catherine to remain in their said marriage, notwithstanding the impediment of affinity as above, and to declare past and future offspring legitimate. Benedict XIII granted him, then a canon of Moray, that in the event of his promotion to a see, he might retain in commendam for a year after obtaining possession of its temporalities, his canonry and prebend of Moray, parish church of Essy and hospital, of lay patronage, of Edynhame in the diocese of St. Andrews. To William (who has this day resigned to the pope the said commenda of the said canonry and prebend; who is proctor in the Roman court of Robert, duke of Albany, governor of the realm of Scotland; who has been sent to the pope as ambassador of the inhabitants of the said realm; to whom the pope has recently granted in commendam the said church of Essy and canonry and prebend, after the pope had made to him, having resigned the said hospital, provision of the church of Dunblane; and who, under the said commenda, has held and holds Essy) the pope grants in commendam, for a year after obtaining possession of the temporalities of the see of Orkney (some of which are in the hands of certain laymen of those parts), the said parish church of Essy, and that of Gogar in the same diocese, value not exceeding 18 marks of old sterlings, of which, previously reserved, papal provision was made to William Croysar, and which has become void at the apostolic see, and therefore reserved to the pope, by Croysar's resignation there, without having had possession, made to Charles, cardinal deacon of St. George's in Velabro, who had verbal mandate from the pope to receive the resignation; notwithstanding that he holds in commendam, as above, the said church of Essy, value not exceeding 22l. After receiving papal dispensation, as the son of an unmarried man and an unmarried woman, to be promoted etc. as above, f. 32d, he was so promoted [added in f. 285] and obtained a certain perpetual vicarage without cure in Hereford. Subsequently he obtained from Edmund Ryall, canon of Hereford, vicar-general in spirituals of bishop Edmund, without having any other dispensation, collation and provision of a certain perpetual benefice called the first portion in the parish church of Holgot in the diocese of Hereford, on its voidance by the resignation, made to the said vicar, of the late John Hyngen. Mandate, if he find the facts to be as stated, to relax the oath under which Edeynna, relict of John Clerck alias Teversham, of the diocese of Ely, promised John on his deathbed, at his earnest prayer, never to take another husband. Her petition adds that she, who is still young and desires to be a mother, was above all led to make the promise because if she had not given John, who loved her tenderly, this consolation, he might have died in a state of sin (in eius anime preiudicium) on account of his excessive grief, or, if he had recovered, he might have loved her less and less every day. A penance is to be imposed for her incautious oath. Exhibita nobis.

The pope, after making him provision of the see of Bangor, granted him, who was not yet consecrated, indult to hold for two years therewith (the episcopal mensa having become much impoverished by the long wars) the canonry and prebend of St. Botolph in Lincoln and the parish church of Schyrryngton in the diocese of Lincoln, value altogether not exceeding 40 marks, which he held at the time of the said provision [above, p. 46]. At his recent petition, containing that at least ten years will be needed to recover and amend the revenues of the mensa, the pope prolongs the above period by other two years in respect of the said parish church only, bishop William having resigned the canonry and prebend. John, who is a continual household chaplain of Richard, bishop of London, formerly received papal dispensation, when holding inter alia the parish church of Stone in the diocese of Rochester, to hold the same for two years together with any other benefice with cure or otherwise incompatible, and meanwhile to exchange one of them for a compatible benefice. Having in due course obtained the parish church of Confelde Parva in the diocese of London, he held it or some time with Stone in virtue of his said dispensation, resigned it, and obtained and, in ignorance of the law, believing it to be allowed by his said dispensation, held for more than a month with Stone the parish church of Hakeney in the diocese of London. The recent petition of the inhabitants of Lepyngton in the diocese of York contained that archbishop Henry found, in course of a diocesan visitation, that although from time immemorial the rectors of Scrayngham, within the bounds of which parish Lepyngton is situate, had been bound to keep at the said (sic) chapel a priest to celebrate mass and other divine offices and administer all sacramentals and sacraments, but not burial, nevertheless Peter Bolton, the present rector, had withdrawn the said priest; and that the said archbishop, to whose arbitration both parties submitted, decreed that out of the fruits etc. due from the said inhabitants to the said church and its rector such chaplain should be kept as heretofore, eight marks a year being reserved therefrom for Peter and his successors. The above abbot is ordered, if he find the facts to be as stated, to confirm the archbishop's decree. Iis que pro divini cultus.

To John Magillabugi, priest, of the diocese of Dromore. Rehabilitation, on account of the following. On the voidance of the see of Dromore, dean Odo and the chapter, in accordance with their right, created him (who had received papal dispensation [defect not mentioned] to be tonsured and promoted to all orders and hold a benefice with or without cure, and who had been tonsured) a canon, acting from fear of Odo Megyngussa, layman, of the said diocese, and the loss of their goods. The late John, archbishop of Armagh, confirmed the creation, and subsequently archbishop Nicholas, on the voidance of a canonry of the said church and of the prebend of Achadeyrg by the death of Thomas Omustrad, made collation and provision to John of the said prebend, claiming that its collation belonged to him for that turn. John is to resign the said canonry, thus collated, and prebend. Sedes apostolica, pia mater.

To the abbot of Tavistok in the diocese of Exeter. Mandate as below. The recent petition of the perpetual vicars of the choir of the church of Exeter contained that in the said church there have been from its original foundation, as is believed, as many perpetual vicars as canons, namely twenty-four, by whom divine services are performed in the stead of the canons, and to each of whom 20s. a year is assigned from each prebend; that the late Henry, bishop of Exeter, appropriated to them the parish church of Wodebury, adding, with consent of the archdeacon of the place, that the said parish church and its ministers and persone should be free from all archidiaconal customs and exactions like the ministers and parishioners of the [cathedral] church of St. Peter, Exeter: that subsequently the late king Henry, seeing that the said vicars possessed a certain lodging (hospicium) in the cemetery of the church of Exeter, a number of lands, tenements, rents etc. and the above parish church, granted that they should be called in perpetuity the college of vicars of the church of Exeter, one of them to be elected warden in accordance with an ordinance to be made by them without the royal licence and assent, and should have a common seal, and have in other respects [detailed] the legal status of a college etc.; that the said vicars have ordained that the wardenship shall be a yearly office and that those of them who are in Exeter shall, without summoning those who are absent and without waiting for them, on the vigil of St. Matthew the Apostle meet for the election of a warden. At the said petition, which asserts that the value of the said parish church does not exceed 70 marks, that of the college (except the 20s. paid to each vicar yearly as above) not exceeding 100, the pope orders the above abbot, if he find the facts to be as stated, to confirm all the above, and to grant to the vicars the enjoyment in perpetuity of all the insignia of a college. Mandate, if he find the facts to be as stated, to grant or let for life to John Olasci, perpetual vicar of Fathain in the diocese of Derry (the fruits etc. of which, not exceeding 6 marks in value, are insufficient for his maintenance, for keeping hospitality, etc.), the third part of all the fruits etc. of the said church, called the bishop's church, which part has been wont to be let or assigned by the bishops of Derry to certain secular clerks, under a yearly pension (which John is to continue to pay) to the bishop for the time being, and is at present unlawfully detained by a number of lay persons of those parts, from whom John hopes to be able to recover it, and whom the above official is to remove. Confirmation of John XXIII's mandate of provision to him (who had had papal dispensation, as the son of an unmarried man and an unmarried woman, to be promoted etc. as above, f. 32d) of the deanery of Killaloe, a major dignity, value not exceeding 7 marks, which became void because the late Dermit Olonirgayn, when holding the rectory of the parish church of Clunenlag of the half cantred of Yblayd (medie Cantride Deyblayd) in the diocese of Killaloe, obtained the deanery and held both together for some time without dispensation super hoc; notwithstanding that the value of the deanery, which James has obtained under the said mandate, should have been stated as amounting to 12 marks a year.
