To the abbot of Neubotil in the diocese of St. Andrews. Mandate, as below. The recent petition of abbot Archibald and the convent of Holyrood, Edinburg, O.S.A., in the diocese of St. Andrews, contained that a number of parish churches or their perpetual vicarages, to wit, de Faukirk de Tranent S. Cut[h]bert de Kingorn de Baro et de Kineil de Vr cum gleba sua de Blaket de Kirkeubreth de Balmagi, ac prioratus beate Marie de Trayl, in the dioceses of St. Andrews, Glasgow and Whiteherne (Candide case), have been wont from time immemorial to be held by canons of the said monastery, and by no others, that the said abbot and convent are in peaceable possession of all of the foregoing, and that the priors of the said priory have been hitherto removable at the pleasure of the said abbot. At the petition, therefore, of James, king of Scots, and the said abbot Archibald and convent, lest the said monastery be defrauded in its said possession, etc., and lest its claustral canons, who serve God and receive part of the fruits of the said vicarages, suffer grave loss, the pope hereby orders the above abbot of Neubotil, if he find the facts to be as stated, to ordain that in future, for ever, no secular or regular of the said or other order, but only a canon regular who has made his profession in the said monastery, may hold the said priory or any of the said parish churches or vicarages (provided that they be prebends wont to be held by canons regular of the said monastery (fn. 2) ), even in virtue of any papal letters, unless the express consent of the abbot be given, or unless such papal letters contain specific and express, and not merely by general clauses, mention of the tenour of the present letters.Inter curas multiplices. To the abbot of the monastery of Ballintober (de fonee [recte fonte] Sancti Patritii) in the diocese of Tuam. Mandate (the pope having been informed by Tadhg [Thicus] Omullanayll, a canon of St. Michael's, Mayo, O.S.A., in the diocese of Tuam, that Malachy Omullanayll, abbot thereof, has committed simony, has been an open concubinary, and has dilapidated and alienated the precious goods of the said monastery, about which things he is in no small measure defamed in those parts), if the said Tadhg (fn. 3) (who was lately dispensed by papal authority on account of illegitimacy, as the son of unmarried parents, to be promoted to all, even holy orders and hold a benefice even with cure, and who has made his profession of the said order), will accuse the said Malachy before the above abbot, to summon Malachy and others concerned, and if he find the foregoing to be true, to deprive and remove Malachy, and in that event, and if he find the said Tadhg to be fit, to make provision to him of the said monastery, value not exceeding 24 marks sterling. The pope hereby grants him faculty to be blessed by any catholic bishop in communion with the apostolic see; without prejudice to the archbishop of Tuam, to whom the said monastery is by ordinary right subject. Mandate to collate and assign to John Odonogan, priest, of the diocese of Killala, who alleges that he has no benefice, the perpetual vicarage of the parish church of Killiglassci (fn. 5) in the said diocese, value not exceeding 8 marks sterling, void by the death without the Roman court of Rory Oluachi. To the chancellor of Glasgow. Mandate, as below. The recent petition of Robert Cotis, clerk, of the diocese of Glasgow, M.A., contained that upon a cause arising lately between Thomas Pyl and William Mowat, clerks, of the dioceses of Glasgow and Aberdeen, about the perpetual vicarage of the parish church of Drunmany in the diocese of St. Andrews, the said Thomas alleging that on its voidance by the death of James Mowbray, collation and provision were made to him by papal authority, and that the said William unjustly opposed and prevented him from obtaining possession, whilst the said William alleged that it lawfully belonged to him, the present pope, at the said Thomas's instance, committed the said cause, although it had not lawfully devolved to the Roman court, to Master Nicholas de Ubaldis, a papal chaplain and auditor, who promulgated a definitive sentence in favour of Thomas and against William, from which the latter appealed to the apostolic see; that the pope, at the latter's instance, committed the appeal to Master John de Cesarinis, also a papal chaplain and auditor, who is said to have proceeded, short of a conclusion. Seeing that whilst the cause has been pending before the said auditor, the said Thomas and William have by their proctor John Edwardi, priest, of the diocese of St. Andrews, given up to the pope the said cause and all their right in or to the said vicarage, that the pope has admitted the same, and that the said vicarage is still void as above, he hereby orders the above chancellor to collate and assign it, value not exceeding 9l. sterling, to the said Robert, if he find him fit.
